Abstract

Binary options or more often referred to as binary options are financial instruments that are not very familiar to the public at first. However, it became familiar in the community after the recent viral case of fraud under the guise of investment was revealed. This study aims to analyze the elements of gambling (maysir) in the binary options platform. The method applied in this study is a normative legal approach using qualitative methods derived from secondary data. This study examines binary options using the desk research method. Secondary research or desk research methods are research methods whose analysis is through comprehensive library research from secondary industrial data and academic sources. Based on the systematic transaction in the binary options platform, we consider that the practice of binary options contains elements of gambling, namely; there are parties who bet (compete), there are assets at stake, there are winning and losing parties, and the winning party is entitled to the assets of the losing party. This study concludes that binary options are financial instruments that are identical to gambling or can be said to be hidden gambling. This is because transactions on binary options contain four gambling criteria that have been agreed upon by the scholars.

Abstract

The purpose of this research is: (1) To understand the process of clearing estate lawsuit based on the customs of Minangkabau. (2) To understand the obstacles found during the case of clearing estate lawsuit based on the customs of Minangkabau. This research, utilizes empirist method in where law is socially, culturally, and das sein because in this research, the primary datas are collected from real cases. This research proves that; (1) The clearing process of heirloom lawsuit in Minangkabau is accomplished by the system of “Ladder up” and “Stairs down” starting from the neighborhood of clan, the neighborhood of tribe, and the neighborhood of Nagari. If the clearing process were not to reach an agreement, the clearing process shall be continued to the neighborhood of Nagari. (2) The obstacles that I find in the clearing process of heirloom lawsuit can be observed from two points of view. First, from the perspective of cultural leaders is the lack of willingness, the lack of economical resources, and the letter of bequest. Second, from the perspective of prosecutors is the element of time, the lack of agreement that can be mutually reached, and differences of opinion. Based on the data of my research, it is recommended that; (1) in order to avoid the obstacles mentioned by the researcher, the side of the prosecutors should require a person that can act as mediator (not a cultural leader) in order to prevent an event in which the tribal leaders from both side might clash. (2) For the government of West Sumatra to consider making local regulation regarding the inheritance of an estate with cultural value and allow the local regulation be spread in order to avoid further compication regarding estate lawsuit.

Abstract

The cost estimation process is an important aspect of project management. In line with industry 4.0 development, a new concept called building information modeling (BIM) was introduced. However, in the Indonesia construction sector itself, the application of the BIM concept is still not optimal. Many construction actors still using conventional concept using computer aided design (CAD) drawing in estimating project cost. This case study aims to compare the project cost estimation between conventional calculation based on CAD drawing dan calculation with the BIM concept. This case study was designed with quantitative approach where the unit price analysis will refer to The PUPR regulation no 1 of 2022. From the result, it was found that the project cost estimation using conventional calculation based on CAD drawing was Rp.39.249.184.000 meanwhile the project cost estimation based on BIM concept was Rp.38.978.799.000 It can be concluded that the calculation using the BIM concept result a lower cost estimation of RP.270.385.000 or worth 0,69% compared to the cost estimation based on conventional calculation.

Abstract

The government gives freedom to each region to regulate its own government affairs, including the distribution of development funds with the aim of maintaining the continuity of government and improving the quality of public services. The allocation of capital expenditures related to adequate maintenance expenditures is very important to maintain the state of government assets so that they can function properly. Every year, various government work units have budgeted the allocation. However, the allocated budget is sometimes too large, resulting in excess funds and cannot be maximized for other priority expenditures. The purpose of this study is to determine the effect of Fixed Assets partially on Maintenance Expenditure. The research method is basically a scientific way to obtain data with certain purposes and uses.” The type of research used in this research is quantitative method. Quantitative research methods can be defined as research methods based on the philosophy of positivism, used to examine certain populations or samples, data collection using research instruments, statistical quantitative data analysis, with the aim of testing hypotheses that have been determined. In accordance with the provisions of the Decree of the Minister of Finance of the Republic of Indonesia Number 01/KM.12/2001 concerning Guidelines for Capitalization of State Owned Assets in the Government Accounting System as regulated again through Minister of Finance Regulation Number 181/PMK.06/2016 concerning Administration of State Owned Goods, the condition of fixed assets is grouped into good, lightly damaged and heavily damaged. Conclusion: Partially Fixed Asset Value (X1) has no effect and is not significant on Maintenance Expenditure (Y) in the Regency/City of South Sumatra Province. Regional Original Income (X2) has no effect and is not significant on Maintenance Expenditures in the Regency/City of South Sumatra Province.
