Abstract

Certain individuals experience gender identities that do not align strictly with being male or female. These individuals may identify as a blend of both male and female, as different genders at varying times, as having no gender at all, or as questioning the traditional binary understanding of gender. Terms commonly used to describe these identities include "genderqueer" and "non-binary." Such identities, which fall outside the conventional female-male framework, are gaining recognition in legal, medical, and psychological systems, largely due to the growing visibility and advocacy of this population. Population-based studies suggest that while the percentage of non-binary individuals is relatively small, the absolute number is significant. Despite their historical and global existence, non-binary genders remain marginalized. Consequently, individuals with these identities often face heightened risks of victimization, minority stress, and discrimination, although their identities are not inherently pathological or disordered. This paper examines the limited body of literature on this subject and explores how mental health professionals can better support clients with queer or non-binary gender identities and expressions. It discusses potential treatment approaches, along with their associated risks, to provide more informed and inclusive care.

Abstract

The objective of this study is to analyze the legal validity of divorce within the Indonesian Civil Law system and Canon Law of the Catholic Church, as well as to identify its legal implications for Catholics in Indonesia. Under Indonesian Civil Law, divorce is considered valid based on specific grounds such as adultery, domestic violence, and continuous disharmony. In contrast, Canon Law of the Catholic Church views marriage as a perpetual sacrament that cannot be dissolved except through an annulment, which requires specific conditions. This study employs a normative juridical approach using legal analysis through literature reviews and relevant legislation. The findings reveal that the conflict between civil law and canon law significantly impacts the social, moral, and spiritual aspects of Catholics. Divorce under civil law is often not recognized by the Church, leading to divorced individuals being considered still bound by the sacrament of marriage. This situation creates social stigma and alienation from the church community, as well as limits their access to certain sacraments.

Abstract

Abstract This study analyses the implementation of mineral and coal mining management policies in Indonesia in the context of Article 33 paragraph (3) of the 1945 Constitution, which emphasises that natural resources must be used to the greatest extent for the prosperity of the people. The change from the Contract of Work regime to the Mining Business Permit (IUP) aims to strengthen state control, but still faces challenges in the form of overlapping licences, weak supervision, and social conflicts with indigenous peoples. Using the approaches of welfare state theory, middle ground theory, and development law theory, this study shows that an active role for the government is needed to ensure equitable benefit distribution and sustainable resource management. The middle ground approach highlights the need for strict oversight of foreign investment, while development law emphasises the importance of law as an instrument to support social welfare and environmental protection. This research recommends strengthening oversight, renegotiating contracts and involving local communities in mining policy to realise more equitable, sustainable and inclusive natural resource management.

Abstract

This article discusses the authority of the National Land Agency (BPN) in creating land legal certainty in Indonesia, as well as the challenges and strategies needed to improve the effectiveness of land management and dispute resolution. Through an analysis of regulations governing BPN's authority, such as the Basic Agrarian Law and Minister of Agrarian Affairs and Spatial Planning Regulations, it is found that BPN has a vital role in land registration and dispute resolution. However, challenges such as overlapping authority, multiple certificates, and land mafia practices still hinder effective implementation. This research recommends strengthening BPN's authority through the establishment of a clearer and more specific law and the addition of an article on Land Civil Servant Investigators (PPNS) in Law No. 5/1960. Hopefully, these measures can strengthen land law enforcement, improve transparency and accountability, and create better legal certainty for the community. Thus, BPN can contribute more effectively in managing and resolving land disputes, as well as promoting justice in natural resource management in Indonesia.

Abstract

Penelitian ini membahas proses pengambilan putusan Mahkamah Konstitusi terkait batasan usia calon presiden dan wakil presiden, dengan fokus pada penerapan kode etik oleh hakim dalam menjalankan tugasnya. Mahkamah Konstitusi sebagai lembaga peradilan konstitusi memiliki kewenangan untuk menjaga konstitusionalitas undang-undang dan menegakkan prinsip-prinsip checks and balances dalam ketatanegaraan. Dalam memutuskan perkara batasan Usia Calon Presiden dan Wakil Presiden, hakim dituntut untuk menjaga independensi, berpegang pada konstitusi, dan mempertimbangkan kepentingan publik. Penelitian ini menganalisis bagaimana pertimbangan politik hukum, akademis, serta aspirasi masyarakat mempengaruhi keputusan tersebut, terutama dalam konteks pemilu 2024. Selain itu, penelitian ini juga mengevaluasi peran kode etik dalam menjaga integritas hakim agar keputusan yang diambil tidak dipengaruhi oleh tekanan politik atau pihak luar. Putusan mengenai batasan Usia Calon Presiden dan Wakil Presiden yang diambil pada tahun 2023 dijadikan sebagai studi kasus penerapan standar etika dan konstitusi dalam pengambilan keputusan di Mahkamah Konstitusi.

Abstract

The right to education is a human right guaranteed nationally and internationally, including for children in conflict with the law. This study aims to analyse the legal arrangements and implementation of the fulfilment of the right to education for children in Special Development Institutions for Children (LPKA) in Indonesia, and provide recommendations for reconstructing more effective policies. A normative juridical approach is used to examine relevant regulations, such as Law No 11/2012 on the Juvenile Criminal Justice System (SPPA Law) and Law No 2222 on Corrections, with a comparison of international practices in Malaysia and Japan. The results show a significant gap between legal arrangements and implementation. Education in LPKA is still limited to non-formal programmes due to a lack of infrastructure, teaching staff, and coordination between related institutions. To overcome this, a revision of the SPPA Law, strengthening educational infrastructure, improving the competence of teaching staff, and adapting international practices integrated with skills training are needed. In addition, anti-stigma campaigns and better monitoring mechanisms are needed to support children's reintegration into society. These measures are expected to not only guarantee the right to education, but also strengthen the rehabilitation and future of children in conflict with the law..

Abstract

The approach to resolving criminal offences of traffic accidents in Indonesia has so far relied on a conventional criminal justice system that is oriented towards punishment. This approach often ignores victims' needs for recovery and opportunities for perpetrators to take constructive responsibility. This research aims to reconstruct a restorative justice-based traffic accident criminal settlement model, which emphasises dialogue, rapprochement and fair solutions for all parties involved. Using juridical-normative and juridical-empirical approaches, this research analyses existing regulations and legal settlement practices, as well as evaluates the potential of restorative justice implementation. The results show that restorative justice provides a great opportunity to create settlements that are more humane, inclusive, and in accordance with the local values of Indonesian society. The mediation process between offenders and victims, which is formally recognised in the justice system, is a key element in this model. The reconstruction of this model offers various benefits, such as victim recovery, reducing the burden on the justice system, and strengthening social harmony. However, its implementation requires adequate regulatory support, training for law enforcement officials, and education to the public. With these strategic steps, the application of restorative justice can be an effective solution in resolving traffic accidents, while reflecting the values of social justice in Pancasila.

Abstract

This study examines the juridical implications of the Fixed-Time Work Agreement (PKWT) on the welfare of workers in Indonesia. The regulations regulated in Law Number 13 of 2003 concerning Manpower show that there is an imbalance in legal protection between PKWT workers and workers with Indefinite Time Work Agreements (PKWTT). In many cases, PKWT causes job uncertainty, low sense of security, and lack of access to basic workers' rights. This study uses a normative approach with a qualitative analysis of regulations and their implementation. The main findings show that the implementation of PKWT has not fully met the principles of justice and welfare, so it is necessary to revise regulations and policies to protect workers

Abstract

This research focuses on the rights of taxpayers in the cancellation of Tax Assessment Letter (SKP). In Indonesia, taxpayers have the right to apply for cancellation of an SKP that is deemed erroneous. However, some rights such as access to information, the right to clarity of process, and the right to object are often hampered by complex administrative mechanisms. This research aims to identify taxpayers' rights in the context of SKP cancellation and evaluate whether these rights are adequately fulfilled. The results show that there is a gap between regulation and implementation, making it difficult for taxpayers to obtain their rights effectively.

Abstract

This research aims to analyse the effectiveness of consumer legal protection regulations in e-commerce transactions in Indonesia, with a focus on the application of regulations in e-commerce platforms and the obstacles that hinder the optimisation of such protection. This research uses a normative juridical method and analyses various applicable laws and regulations, including the Consumer Protection Law, the Electronic Information and Transaction Law, as well as regulations related to personal data protection and e-commerce. The results show that although the existing regulations provide a strong legal basis, their implementation still faces challenges such as misalignment between regulations and the rapidly growing e-commerce practices, as well as limited supervision and law enforcement. Therefore, this study suggests the need for regulatory updates and increased supervision to create a consumer protection system that is more effective and adaptive to the development of the e-commerce sector.
