Abstract

The realization for creative economy actors by providing opportunities for their work in the form of Intellectual Property Rights (HKI) assets which can be used as fiduciary collateral with the ratification of Government Regulation Number 24 of 2022 concerning Implementing Regulations of Law Number 24 of 2019 concerning the Creative Economy, creates opportunities to develop the economy in Indonesia with the government's recognition of IPR as collateral that can be guaranteed. It is hoped that this research can be a positive contribution for both the government and banks to implementing IPR as a collateral object. This research uses normative juridical analysis with the problem formulation: First: How do the regulations in Bank Indonesia Regulations with Government Regulation Number 24 of 2022 concerning Implementing Regulations of Law Number 24 of 2019 concerning the Creative Economy provide an opportunity for IPR assets to be used as objects of fiduciary collateral? Second: What is the certainty and position of IPR assets as objects of fiduciary guarantees in Indonesia? The results of this research found that regulations in Indonesia have agreed to stipulate that IPR assets can be used as fiduciary collateral, but in practice until today it is difficult to use IPR assets as fiduciary collateral, as can be seen from Bank Indonesia Regulation No. 9/6/PBI/2007 which does not specifically regulate IPR assets that can be used as collateral objects in banks. The certainty of IPR assets as collateral makes it difficult for banks to provide credit because they are constrained by the limited period of IPR protection. It is hoped that the results of this research will be a consideration for providing guarantees for creative economy actors who have IPR assets that can be pledged as collateral so that they can provide legal certainty for the community.

Abstract

The use of the Password Protection Online Course as a Technological Protection Measure (TPM) then gives rise to various dynamics of pros and cons regarding the impacts. So in this case it is necessary to conduct a study regarding the dynamics of using Password Protection Online Courses as a Technological Protection Measure (TPM) and Efforts to Protect Copyright of Online Course Content against Illegal Takeover of Access Rights Through Password Protection. The type of research used is normative research with a normative juridical approach. The results of this research show that Technologies Protection Measures (TPM) is a technology that can be used to protect documents from digital works with copyright. Efforts to realize copyright protection are carried out by creators to protect their creations from piracy or text mining which may be carried out on the online course content they create. The use of password protection utilizes the use of security technology to protect copyright and economic rights as regulated in articles 52 and 53 of the Copyright Law. Thus, it can be concluded that collaborative efforts between security technology or TPM and the legal provisions in the Copyright Law, ITE Law, WIPO and Bern Convention on Corporate Rights are quite good and provide comprehensive protection. Regulating the use of security technology includes protecting the moral and economic rights of a work. This provides benefits for creators in protecting their creative works in digital form and their distribution, the regulations for which have been implemented in the Copyright Law.

Abstract

In the industrial world, a public figure who uses a stage name without giving it legal protection will be prone to causing problems such as being used for personal gain. For example, someone uses the stage name of a public figure to trick consumers so that many of them use the product, even though the product used does not belong to the public figure. The research was conducted using a normative juridical approach using secondary data. Data collection techniques were carried out using literature studies which were analyzed qualitatively. The results obtained from this research are that stage names can be compared to the names of famous people as stated in Article 21 paragraph (2) letter a of Law Number 20 of 2016 concerning Trademarks and Geographical Indications. This article provides legal protection for public figures' stage names from passing off actions carried out by irresponsible people. This article not only prohibits the use of the name of a famous person, but if it is similar, if there are elements that stand out between the trademark and the name of a famous person without the consent of the party concerned, the registration of the trademark must be rejected. There are several legal steps that can be taken by a public figure who feels aggrieved by someone's passing off his/her stage name, such as filing an objection, canceling the brand, suing for compensation, and criminal charges.

Abstract

The concept of droit de suite or the right to receive royalties from the resale of a work (resale royalty rights) for artists is designed so that it can be used as a system to provide a portion of the increase in the value of the work to the artist when his work is resold. In the regulation of the copyright law system in Indonesia, the principle of droit de suite does not yet have a specific arrangement as part of the moral rights contained in Law No. 28 of 2014 concerning Copyright (UUHC), even though the condition for implementing droit de suite is that the state must give permission and legally recognize the droit de suite in the laws and regulations. This study uses a juridical normative method and uses the Statute Approach and the Conceptual Approach which are analyzed descriptively. The results of the study indicate that there is a need for harmony with the resale rights law which will be carried out by transplanting the law into Indonesian law.

Abstract

This research is driven by the issue of widespread violations of intellectual property rights, which have occurred due to insufficient involvement of the Regional Government in intellectual property protection. Unfortunately, legislation concerning intellectual property remains incomplete, posing challenges for local governments in implementing effective protection measures. The objectives of this research are twofold: first, to analyze the role of the Regional Government in providing intellectual property protection; second, to formulate regional-level intellectual property regulations for greater coherence. This study employs a normative juridical approach with a statutory and conceptual framework. The research findings indicate the following: Firstly, despite having authority over intellectual property protection, the Regional Government faces challenges due to the partial nature of intellectual property laws and regulations—comprising at least six statutes. This complexity impedes the Regional Government's ability to comprehend, formulate, and enforce laws related to intellectual property. Therefore, harmonization is essential. Secondly, the harmonization of intellectual property regulations at the regional level involves the Regional Government conducting: a) an inventory of existing intellectual property laws and regulations; b) analysis, evaluation, and harmonization of their content, which will be incorporated into Regional Regulations on Intellectual Property Protection. These regulations must be grounded in a robust philosophical and sociological framework.
