Abstract

This study examines the Wakaf Behind Pawn Practice Reviewed From the Perspective of Sharia Economic Law ( Case Study at the Masjid Ma'mur Tiga Batur, Sungai Tarab District, Tanah Datar Regency). The problem is how wakaf practice is behind pawnbroking, what are the driving factors for wakaf practice behind pawnbroking and how sharia economic law views wakaf practice behind pawnbroking at the Ma'mur Tiga Batur Mosque, Sungai Tarab District, Tanah Datar Regency. This type of research is field research with qualitative descriptive methods with data collection techniques being interviews and documentation. The practice of waqf behind pawnbrokers that are carried out by pawnbrokers starts with the pawnbroker and the pawnbroker and then the pawnbroker manages, utilizes, and there are results. Factors driving the practice of wakaf behind pawnshops include the factors driving the worship and environmental factors of local parties or community leaders and scholars who explain pawnshops and waqf, thus making the wakif interested in. Wakaf is basically allowed from pawnshops, but it is not recommended because the source of the wakaf comes from everything that is not allowed, namely the use of pawnshops by pawnbrokers. Abstract

The main problem in this thesis is how the provisions of the tradition of prohibiting marriage due to babisiak vows in Nagari Lunto, Lembah Segar District, Sawahlunto City and how Islamic Law reviews Islamic law regarding the tradition of prohibiting marriage due to the babisiak oath. The purpose of this discussion is to find out and explain how the provisions of the tradition of prohibiting marriage due to babisiak vows and to find out an overview of Islamic law on the tradition of prohibiting marriage due to babisiak vows in Nagari Lunto, Lembah Segar District, Sawahlunto City. This type of research is field research. Data collection techniques are carried out through interviews and documentation is a process to obtain research data. The data sources for this research are the Chairperson of KAN Lunto, people who are dealing with the babisiak oath or people who currently hold the customary tradition of prohibiting marriage due to a babisiak oath, Niniak mamak 4 jinih, and the community in Nagari Lunto. The results of the research that the authors get, firstly that the provisions of the rules regarding the tradition of prohibiting marriage due to the Babisiak oath are customs that have been passed down from generation to generation which until now are still believed to exist by the people of Nagari Lunto, these rules are not written but are upheld by traditional leaders accompanied by sanctions and trusted there will be disaster and calamity for those who break it. Second, in Islamic Law the tradition of prohibiting marriage due to a babisiak oath is contrary to syara', because there is no text that says that prohibition on marriage such as the tradition of prohibiting marriage due to a babisiak oath is prohibited or forbidden, even those who wish to do marriage are not mahrams, for this it is customary regarding the tradition of prohibiting marriage due to the babisiak oath included in 'urf fasid.

Abstract

Sanctions for duduak basighiah in Jorong Cendrawasih for people who do not carry out this tradition, are prevented from getting married, are not allowed to live in the Jorong, are not allowed to carry out walimah ursy, the family is banished by the niniak mamak. Then, thus the importance of this tradition is carried out to establish family intimacy and strengthen the relationship between the male and female families. The basighiah duduak tradition is carried out before the marriage contract at the women's house by holding alek sakampuang for the sighiah shreds process. This procession is a form of notification to the village community that a girl is getting married. Islamic law review of the tradition of basighiah duduak is a habit that has lived in the midst of society. This custom is classified as urf fasid because it contains disadvantages from the provisions of the basighiah basighiah tradition of sanctions, this sanction applies to couples who are getting married if they do not carry out the basighiah sitting tradition.

Abstract

The results of the author's research in this study that the fulfillment of chidren's rights in positive law is fully regulated by law in which it is regulated explicitly and clearly both the fulfillment of the rights of the child itself and the sanctions for violators. whereas in Islamic constitutional law, the fulfullment of children's rights is explained in the arguments of the Qur'an, hadith, compilations of Islamic law, and also MUI fatwas where are clear. but the similarity is that in positive law and Islamic constitutional law the fulfillment of children's rights is fully guarded and protected so that the child's life is safe and peaceful..

Abstract

In this problem is how the process, paying customary fines for organizing Datuak's funeral and what is the view of Islamic law regarding the delay and payment of fines for organizing Datuak's funeral in Nagari Tanjuang Barulak. This type of research is field research. From the results i found first, if the people could not get a replacement for Datuak's body for 24 hours then their people had to pay the customary fines of the cabiak siriah and if their people did not want to delay the burial of Datuak's body or did not want to wait until they could get a replacement for 24 hours then their people had to pay the customary fine of cabiak siriah is 2x the amount that has been determined. Second, the payment cabiak siriah fines is paid when the batagak penghulu is held with different nominal payment provisions at each Datuak level. Third, in the view of Islamic law that the postponement of holding Datuak's funeral and the payment of customary fines for holding Datuak's funeral is not recommended by the religion which has been explained in the hadith, for this reason these customs do not meet the requirements of 'urf shahih

Abstract

This study examines the value of justice in polygamy from various perspectives, namely the Qur'an, Sunnah, ushul fiqh/fiqh, and positive law. This research is a literature study with data sources in the form of polygamy provisions contained in the Al-Qur'an, Sunnah, ushul fiqh/fiqh, and positive law. In addition, data were also taken from literature related to polygamy. Using a normative approach, this research finds that fairness is an important condition for polygamy. The concept of justice in the Qur'an tends to be related to business that is humanly possible. If someone really wants to do justice with a sincere goal, then he will not be able to do it considering his limitations as a human being. In principle, the concept of fairness in sunnah and ushul fiqh/fiqh refers to the interpretation of the Koran, namely fairness in the areas of living, muamalah, association, and night shifts. Meanwhile, justice in positive law basically emphasizes the husband's ability to be fair to his wives and children, especially in terms of subsistence. This research shows that in both Islamic law and positive law, justice is an important condition that must be met by a husband in polygamy.

Abstract

Studi ini mengakaji tentang Tinjauan Hukum Islam Terhadap Pembagian Warisan Sama Rata di Desa Bumi Mulya, Kecamatan Logas Tanah Darat, Kabupaten Kuantan Singingi, Provinsi Riau. Dari permasalahan tersebut muncul pertanyaan: (1) Apa yang menjadi pertimbangan masyarakat membagi warisan sama rata di desa Bumi Mulya?  (2) Bagaimana pandangan hukum kewarisan Islam terhadap pertimbangan masyarakat yang membagi warisan secara sama rata di desa Bumi Mulya?.  Penelitian ini adalah penelitian lapangan (field research) yang bersifat deskriptif dengan pendekatan kualitatif yaitu penelitian yang memahami tentang apa kejadian fenomena dilapangan, kemudian menganalisa data dengan metode tringulasi sumber. Hasil dari penelitian ini adalah Pertimbangan masyarakat Desa Bumi Mulya menerapkan pembagian warisan sama rata adalah berdasarkan kesepakatan para ahli waris dengan tujuan mencegah terjadinya perselisihan antar ahli waris dikemudian hari, selain itu terdapat  faktor lainnya seperti adat dan budaya turun menurun serta minimnya pengetahuan masyarakat tentang pembagian warisan dalam Islam. Tinjauan Hukum Islam terhadap pertimbangan yang digunakan oleh masyarakat Desa Bumi Mulya dalam menerapkan pembagian warisan sama rata di dalam Islam dibolehkan, dengan mengikuti ketentuan-ketentuan yang berlaku di dalamnya, yakni setiap ahli waris harus mengetahui bagian dari masing-masing ahli waris sebelum harta warisan dibagikan sebagaimana yang terdapat di dalam KHI Pasal 183.
