In Indonesia the development of crypto assets is increasing, therefore this paper aims to accommodate legal instruments to provide a legal basis regarding the high potential for crypto asset insurance protection. In studying this, the author uses qualitative research methods with reasons that are more supportive in understanding the events, behavior, or phenomena of the emergence of this crypto asset. The author made this research to have an impact in creating legal instruments that will underlie crypto asset insurance protection in Indonesia. Because of the large potential digital assets that need to be protected from the start of the system, blockchain and other systems are vulnerable to being stolen, damaged or changed without the permission of the original owner. Referring to legal developments in China, Indonesia can see and study to participate in creating a similar legal basis to protect crypto assets. With the rapid development of technology in the world, it urges the government to form regulations regarding Crypto Assets. That way, there is potential for the creation of these legal instruments to protect crypto assets with insurance.

Penelitian ini bertujuan untuk meninjau akibat hukum yang dapat terjadi jika pelaku usaha/penjual di marketplace tidak mencantumkan identitas/alamatnya dengan lengkap dan sebenar-benarnya. Metode penelitian yang digunakan adalah yuridis normatif yaitu menelaah semua regulasi yang bersangkut paut dengan pelanggaran hukum akibat tidak dicantumkannya identitas pelaku usaha dalam marketplace dan peran marketplace terkait pemenuhan hak konsumen. Hasil penelitian ini menemukan adanya pelanggaran atas tiga peraturan perundang-undangan di Indonesia jika pelaku usaha tidak mencantumkan alamat/identitasnya dengan lengkap dan sebenar-benarnya. Akibatnya terdapat ancaman yang bersifat administratif maupun ancaman pidana kurungan dan denda uang jika pelaku usaha mengindahkannya. Selain dari sisi pelaku usaha, pihak marketplace sebagai tempat yang memfasilitasi penjual dan pembeli sebenarnya juga memiliki peran penting agar hak konsumen dapat terpenuhi. Dari penelitian ini ditemukan adanya beberapa hak konsumen yang sudah dipenuhi dan ada beberapa hak konsumen juga yang belum dijamin oleh pihak marketplace.

Utang piutang timbul diakibatkan oleh ketidak mampuan salah satu pihak membayar kewajibannya tepat waktu. Hal tersebut tentunya merugikan perusahaan piutang untuk memenuhi kewajiban usahanya. Perkara utang piutang usaha bisa diajukan PKPU ke Pengadilan Niaga. Penundaan Kewajiban Pembayaran Utang ataupun PKPU termasuk suatu cara dalam penyelesaian utang agar terhindar dari kepailitan. Adapun Pasal 235 (1) dan Pasal 293 (1) UU No.37 Tahun 2004 tentang Kepailitan dan PKPU, terhadap putusan PKPU tak bisa diajukan upaya hukum apapun. Namun melalui Putusan MK No.23/PUU-XIX/2021 Pasal tersebut dinyatakan inskonstitusional dan tidak mengikat, maka dari itu terhadap Putusan PKPU bisa diajukan upaya hukum kasasi apabila memenuhi syarat. Dalam Putusan PKPU No.07/Pdt.Sus/PKPU/PN.Niaga.Jkt.PSt terjadi suatu kelalaian pembayaran utang terhadap putusan yang telah di Homologasi. Pasca diputuskannya Putusan PKPU, diketahui debitor hingga saat ini belum membayar ataupun bahkan mencicil tagihan utang sesuai skema pembayaran yang telah disetujui. Maka dari itu, kreditor berupaya untuk mendapatkan haknya yang hingga saat ini belum bisa terpenuhi oleh debitor.Kata kunci : Upaya Hukum;PKPU;Homologasi;Perusahaan.

Rights to well-known trademarks need legal protection. The well-known trademark case relates to the trademark dilution doctrine. This research aims to analyze and determine the legal doctrine of trademark dilution in Indonesia. The research used a normative juridical approach so that secondary data was collected by using library research methods. The conclusion of the research is that the regulation of the trademark dilution doctrine in Indonesian national law is still implied. However, provisions related to the trademark dilution doctrine in the Paris Convention for the Protection of Industrial Property Rights and the Agreement on Trade-Related Aspects of Intellectual Property Rights can be applied. The ssolution of violations of the trademark dilution doctrine in Indonesia under the Trademark Law is not optimal. The well-known trademark cases studied in this research meet the trademark dilution doctrine which contains the concept of passing off. The regulation on the trademark dilution of well-known trademark in Indonesia is still not perfect, so it is necessary to improve its legal substances.

In the last two decades, art and technology are increasingly inseparable. Existing technology has developed rapidly, in this case the internet which has given birth to a new era known as the digital era which was followed by the emergence of many legal problems, one of which was copyright infringement. The emergence of Non-Fungible Tokens (NFTs) is said to be able to democratize the arts industry and Indonesia digital economy decentralized. Indonesia has a regulation named the Law of the Republic of Indonesia Number 28 of 2014 which regulates the exclusive rights of creators from the industrial sector to works of art. With the existence of These Non-Fungible Tokens (NFTs) the copyright of a digital artwork is questionable. The unique thing with the existence of this Non-Fungible Tokens (NFTs) is that Non-Fungible Tokens (NFTs) does not have the same values, each unique asset cannot be exchanged, so the artists use Non-Fungible Tokens (NFTs) as a certificate of ownership of a rare digital asset. However, because there is no specific regulation regarding Non-Fungible Tokens (NFTs) either in copyright regulations or its protection by the government, there have been cases of copyright infringement intentionally or unintentionally. This research aims to analyze how Indonesian government set the pace to protect copyrights of digital artworks as a preparation for the Indonesia 2030 Digital Economy Development.

Buying and selling transactions through information technology media and the internet (e-commerce) have positive and negative sides. Several problems often occur in its implementation, which often requires the seller’s accountability to not harm consumer rights. However, one element that is often forgotten by sellers and buyers is the inclusion of the identity or address of the business actor in the marketplace. As a result, fulfilling the responsibilities of the seller is often difficult and the buyer becomes disadvantaged. Not only the seller, the marketplace as a place that facilitates sellers and buyers also has an important role so that consumer rights can be fulfilled. Not including the identity/address of business actors in the marketplace also creates legal consequences that differ from several laws and regulations in Indonesia, requiring more attention from the government

As the largest archipelagic country in the world with cultural pluralism in its people, Indonesia, the 1945 Constitution of the Republic of Indonesia has guaranteed the existence of unique or special regional government units. However, in practice, the implementation of special autonomy has been slow in realizing the welfare of the local community. The focus of this research seeks to answer two problems: First, how is the design of special autonomy arrangements in the 1945 Constitution of the Republic of Indonesia? Second, is the implementation of special autonomy in Indonesia following the ideals of regional government regulation in the 1945 Constitution of the Republic of Indonesia? The method used in this research is normative legal research with data collection techniques in library research. The study results reveal that the 1945 Constitution of the Republic of Indonesia has provided space for regions to organize an asymmetrical government. However, in reality, the implementation of special autonomy in Indonesia is not based on the design of regional diversity awareness in the 1945 Constitution of the Republic of Indonesia. In addition, implementing special autonomy in Indonesia still leaves various problems.

Islamic law, especially jinayah (Islamic criminal law) is a legal system, which cannot be ignored in a country where the majority of the population is Muslim. Enacting the law for adherents of a religion is basically a form of religious adherence to their religion. For this reason, the prohibition of a religion in carrying out its teachings, including part of a constitutional violation, which is technically protected. As a former Dutch colony, the colonial legal system is the most colorful in the country's system. Thus, the existing legal system is often marginalized as a legal system in the country. The formulation of the problem in this research is why Islamic criminal law has not become a legal system in Muslim-majority countries, and whether the substance of Islamic criminal law is absorbed in the draft criminal law code.In this study using juridical empirime as a methodology, using a approach to the concept of legal politics and historis process of legislation. The conclusion in this study, that the substance of Islamic criminal law has not become the dominant color as a legal system in a Muslim-majority country, this is due to the lack of strong legal politics that fights for the substance of Islamic criminal law to give its war against the criminal law that will be enforced.

Any case arising from society could cause disharmony and inbalencing among the society. Taking the case to formal court, will take time, and spend money. The solution to overcome the number of cases in formal court, it needs to set up informal court wellknown “Peradilan Adat”. A lot of cases arising from society in Aceh rural area settled by Aceh Customary Institution Court which is called Peradilan adat Aceh. There are eighteen cases under competency of the court that conducted by justice providers, consist of head of village, Islamic sholars, and other trusted public figures. Dispute settlement run based on both parties consensus voluntarily. Therefore, the decision is “win win solution”. The nature of decision (verdict) is final and binding. Provincial Police institution of Aceh, which is called POLDA, and Aceh Customay Assembly have an MoU signing in order to recoqnize and respect the decision of Customary Court of Aceh.

Pembangunan infrastruktur membutuhkan dana yang tidak sedikit. Rencana Pembangunan Jangka Menengah Nasional (RPJMN) 2020-2024 mengamanatkan penjajakan mekanisme pembiayaan yang inovatif untuk menutup kesenjangan pendanaan pembangunan infrastruktur sehingga tidak semua pendanaan ditanggung oleh Anggaran Pendapatan dan Belanja Negara (APBN). Opsi pembiayaan inovatif yang dapat dipilih adalah Land Value Capture. Mekanisme ini dilakukan dengan memonetisasi tanah yang dikembangkan oleh pemerintah untuk meningkatkan nilai tanah dan properti dari investasi infrastruktur, dan hasilnya digunakan untuk pembiayaan publik lainnya. Penelitian ini menggunakan penelitian normatif untuk mencari urgensi pembentukan Land Value Capture.
