Jurnal Hukum dan Peradilan (JHP) is published by the Research Center for Law and Judiciary of the Supreme Court of the Republic of Indonesia. JHP aimed to be a peer-reviewed platform and an authoritative source of information on legal and judiciary studies. The scope of JHP is analytical, objective, empirical, and contributive literature on the dynamics and development of legal studies, specifically in Indonesia. JHP welcomes scientific papers on a range of topics from research studies, judicial decisions, theoretical studies, literature reviews, philosophical and critical consultations that are analytical, objective, and systematic. However, from a wide range of topics that researchers can choose from, JHP puts more attention to the papers focusing on the sociology of law, living law, legal philosophy, history of national law, customary law, literature studies, international law, interdisciplinary, and empirical studies. Abstract

Revolusi Industri 4.0 telah memberikan pengaruh terhadap pemutusan hubungan kerja dengan alasan efisiensi. Alasan efisiensi Pasal 164 ayat (3) Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan menimbulkan polemik yang berdampak kepada besarnya jumlah pengangguran. Penelitian dilakukan secara normatif yang bertujuan untuk menelaah undang-undang ketenagakerjaan yang belum mampu melindungi hak berkerja di era revolusi industri 4.0. Efisiensi di revolusi industri 4.0 akan mengancam kehidupan pekerja dimasa yang akan datang, dengan tergantikannya tenaga manusia dengan tenaga robot. Hak berkerja yang telah diamanatkan oleh UUD 1945 di dalam Pasal 28A- 28J terancam hilang dengan berkembangnya zaman. Kewajiban konstitusi dari pemerintah untuk menyediakan lapangan pekerjaan bagi pekerja di era revolusi industri 4.0, karena berkerja merupakan hak asasi manusia untuk mempertahankan kehidupannya.

Abstract

The functional position generally managed and fostered in a nationally integrated one employment system by the fostering institution of the functional position. Unfortunately, the differentiate management and employment building occurs in the functional position of registrar, along with its judicial institution namely Supreme Court, Constitutional Court and judiciary body below Supreme Court. The different status and functional position requirement from those three judicial institutions become one of the obstacles the registrar fostering system cannot be united. For example, Constitutional Court and judiciary body under Supreme Court require civil servant as a registrar meanwhile Supreme Court Registrar is a judge. The issue of less linear and synchronization employment system led to disproportional of the fostering of registrar functional position. The career development horizontally through the application of credit points is indeed needed to construct as an expertise functional position consequences. Hence the position and career pattern does not only lead vertically to chief and deputy chief of registrar. The reconstruction of the expertise functional position of registrar should also apply the same requirement and fostering system nationally, this will lead performance and professionalism upgrading. Abstract

Regulations governing the environment in Indonesia are many and scattered in various regulations. But it seems that these regulations stand alone, no activity and effectiveness. How to environmental management are not planned and are not integrated in a harmonious and integral cause destruction and environmental pollution. Islamic law has principles that must form the basis and starting point of the activity of the social forces in order to ensure an orderly life, balance, and harmony so there is no pollution and environmental destruction that causes loss of balance and harmony of life in this world. Among these principles, namely equality, balance, benefit, mutual cooperation and justice. There is a different registrar promotion pattern and mutation on general to religious court. Accordingly, important to get promotion pattern harmony and mutation to taking on this differences among of court (in particular general to religious court) under the supreme of court. Some efforts to consider are: (1). The equality of regulation or types of regulation on registrar promotion pattern and mutation (which is synchonized on the head desicion supreme of court. (2). Abstract

Restitution is a form of legal protection form for victims of victim recovery oriented. Normatively, on the positive law, restitution has not been cooperated well yet. Consequenly, the application of the restitution had a problem, specifically unsynchronized legal structure. Under the integrated criminal justice system perspective, legal structure and legal substance disharmony need to be reorganized (regulated). A fundamental arrangement will be done by rephylosophy some punishment, than make restitution become a prinsipal (main)criminal and giving a new position for the victim to the later integrated criminal justice system based on the phylosophy of restoratifjustice. Abstract

Pada masa sebelum diundangkannya Undang-Undang Nomor 1 Tahun 2015 juncto Undang-Undang Nomor 8 Tahun 2015, sikap PTUN terhadap sengketa Pilkada sangat beragam mulai dari tidak lolos dismisal, lolos dismissal tetapi ditolak atau dinyatakan tidak diterima (N.O.) oleh Majelis Hakim, bahkan ada yang gugatan dikabulkan. Setelah diundangkannya Undang-Undang Nomor 1 Tahun 2015 junctis Undang-Undang Nomor 8 Tahun 2015 dan Undang-Undang Nomor 10 Tahun 2016, sikap PTUN hanya 1 (satu) dan sangat tegas yaitu menyatakan Pengadilan Tata Usaha Negara secara absolut tidak berwenang memeriksa, memutus dan menyelesaikan sengketa Pilkada. Dinamika dan perubahan sikap PTUN tersebut dikarenakan adanya perubahan keadaan hukum dan maksud-maksud lain, yaitu PTUN ingin memaksimalkan lembaga-lembaga yang nyata-nyata diberi wewenang untuk menyelesaikan sengketa pada setiap tahap mulai dari sengketa administrasi sampai dengan sengketa hasil, menghindari disparitas putusan PTUN dengan putusan MK, membangun budaya hukum masyarakat yang siap menang dan siap kalah, serta menghindari sengketa yang berkepanjangan yang menghabiskan banyak tenaga, waktu, dan biaya.In the days before the Law number 1 of 2015 in conjunction with Law number 8 of 2015 issued, the position of Administrative Court against dispute of regional election is varied, among other things: failed dismissal process, not accepted, rejected and even granted. So, after Law number 1 of 2015 in conjunction with Law number 8 of 2015 and Law number 10 of 2016 issued, there is only one administrative court position which is very firm stated that administrative court is absolutely not authorized judging the dispute of regional election. A change of administrative court position was due to the changes in legal circumstances and other aims among other things: administrative court want to maximize the institutions that given authority to resolve dispute of regional election, avoid disparity of decisions between administrative court decisions and constitutional court decisions, build culture the laws of society that ready to win and ready to lost also avoid prolonged dispute that consumes a lot of energy, time and costs.

Abstract

Normatively, based on the decision of the Constitutional Court No. 93/PUU/X/2012 the settlement of Islamic economic disputes becomes the absolute competence of the Religious Courts. However, at the empirical level, there are still sharia economic disputes which are still decided by the Commercial Court (general), namely bankruptcy cases and PKPU on the sharia bank. This paper focuses on three things, first, what causes these cases to remain under the authority of the Commercial Court, secondly, what are the legal consequences if the case is resolved through the Commercial Court and how the legal arguments about the competence of the Religious Courts in bankruptcy cases and PKPU on sharia bank. This research method is normative law by examining a set of legal materials related to bankruptcy and PKPU. The analysis used is synchronization of the norms of Law No. 37 of 2008 and PERMA No. 2 of 2008. The results of the study found that the cause of the case is still handled by the Commercial Court because of a conflict of norms between the Bankruptcy Act and PERMA regarding KHES which still has not been finalized, the conditions legal vacuum regarding bankruptcy based on the sharia contract and the existence of the KMA letter regarding the instruction for the implementation of book II. Legal consequences if the case is dealt with by the Pengadian Niaga there will be coercion on the substance of sharia economic law into conventional economic law, not in sync between the settlement of the dispute with the contract and the concept of solving the case prioritizing business principles and business competition rather than substantive justice. Based on the theory of authority and the principle of the lex specialist, it was found the conclusion that bankruptcy cases and PKPU based on the absolute sharia contract became the absolute competence of the Religious Courts.

Law in general is understood as regulations formed by authority to regulate community and its activities for the purpose of creating public order and justice. The law is enforced by legal apparatus by applying compliance and coercive measures. Abstract

Parliament proposed initiative to change back the bill MA for three (3) foundation: first, the desire of the House to form a Supreme Court that can carry kekusaan judiciary to realize the state of law and achieve the objectives of the state, second, the Law on the current MA , seen there are still weaknesses. Third, awareness of the need for harmonization and synchronization with the MA bill to be prepared with due regard to the interests of law enforcement and justice must be directly in line with the interests of law and public justice. According to the analysis, the substance of the bill by parliament yet the Supreme Court in accordance with the principles of independent judicial power, especially concerning: First, the House Oversight Against MA; Second, the Supreme Court decision setting tengang substance (Article 97), which not only violates the independency of the judiciary, but also waives the rule of law; Third, criminalization judge if the judge violated or ignored the Article 94 jo. Article 96; Fourth, the organizational structure of the secretariat of the Supreme Court (Article 35) causes a buildup of duties, functions and authority of the Secretariat tremendous MA; Fifth, the Material Test Procedure Law Rights (Article 90 paragraph (8)) are not further described; Sixth, Room Sharing Case that cause fattening of human resources in the rate and with the same duties and functions by the Clerk of the Supreme Court; and Seventh, Minimum Age Limits for Supreme Court Justices. Abstract

The idea of daman towards both criminal and justice victims, from early time, has been mentioned in the nash of both Al-Quran and Al-Hadith. From the nash, Ulemas have formulated various fiqh forms concerning daman (compensation). In fact, from early time the Islamic Jurists have not applied the terms masuliyah madaniyah for justice responsibility, and masuliyah al ina'iyah for criminal one. However, several thinkers of classical Islamic law mainly al-Qurafi and al- `Iz Ibn Abdi Salam have introduced the term al-jawabir for justice conpensation (read: daman) and al-zawajir for criminal compensation (read: 'uqubah diyat, arus, etc.). Although in its development, up to recent time, Islamic Jurists often use the term masuliyah that is because of the Western work influences. Daman could occur because of deviation on akad (agreement) namely daman al-aqdi, and could happen because of violation namely daman `udwan. In determining the compensation, the esential elements are darar or lost on the victims. Darar could occur on physical, material or things and service aspects; and it could also be on moral and emotional destruction or called darar adabi including name-reputation damage. The standard for the compensation either on quality or quantity must be similar to darar suffered by the victims.
