Abstract

Parliament proposed initiative to change back the bill MA for three (3) foundation: first, the desire of the House to form a Supreme Court that can carry kekusaan judiciary to realize the state of law and achieve the objectives of the state, second, the Law on the current MA , seen there are still weaknesses. Third, awareness of the need for harmonization and synchronization with the MA bill to be prepared with due regard to the interests of law enforcement and justice must be directly in line with the interests of law and public justice. According to the analysis, the substance of the bill by parliament yet the Supreme Court in accordance with the principles of independent judicial power, especially concerning: First, the House Oversight Against MA; Second, the Supreme Court decision setting tengang substance (Article 97), which not only violates the independency of the judiciary, but also waives the rule of law; Third, criminalization judge if the judge violated or ignored the Article 94 jo. Article 96; Fourth, the organizational structure of the secretariat of the Supreme Court (Article 35) causes a buildup of duties, functions and authority of the Secretariat tremendous MA; Fifth, the Material Test Procedure Law Rights (Article 90 paragraph (8)) are not further described; Sixth, Room Sharing Case that cause fattening of human resources in the rate and with the same duties and functions by the Clerk of the Supreme Court; and Seventh, Minimum Age Limits for Supreme Court Justices. Abstract

A law (written law) was never full, clear and complete set of community life, so it is always lagging behind follows the development of society. To keep abreast of it, the law should always be developed in order to remain update and relevant to the times. Implementation and development of legislation going through the verdict (jurisprudence) in the judicial process. In other words, jurisprudence intended as legal development, to meet the legal needs of justice seeker. Implementation of the functions of law enforcement and justice as well as the function of legal discovery (rechtsvinding) embodied in a verdict (jurisprudence), should refer to Pancasila as the norm of fundamental state (staatsfundamentalnorm) or wisdom / genius of the national (national wisdom / national genius) and 1945 as the basic law of the state, so that the decision reflects the sense of justice of the nation and the people of Indonesia as well. Abstract

Penelitian ini dilakukan untuk mengeksplorasi implementasi pemberian restitusi bagi anak korban tindak pidana kekerasan seksual, dengan fokus pada studi kasus Putusan Pengadilan Negeri Banjarnegara Nomor 112/Pid.Sus/2022/PN.Bnr. Kejahatan seksual terhadap anak berdampak serius terhadap kondisi psikologis dan emosional korban, yang sering kali tidak diimbangi oleh perlindungan hukum yang memadai, termasuk hak restitusi. Penelitian ini menggunakan pendekatan yuridis normatif dengan analisis deskriptif terhadap peraturan perundang-undangan, dokumen hukum terkait, dan wawancara dengan narasumber. Hasil penelitian menunjukkan bahwa meskipun regulasi telah mengatur hak restitusi bagi anak korban, pelaksanaannya masih menghadapi berbagai kendala, seperti minimnya pemahaman aparat hukum dan hambatan teknis lainnya. Kesimpulannya, diperlukan penguatan kerangka hukum dan edukasi kepada aparat penegak hukum untuk memastikan pemenuhan hak restitusi sebagai bagian integral dari perlindungan anak korban kekerasan seksual.

Abstract

Pengusaha sering menggunakan pekerja outsourcing untuk menekan biaya operasional. Sistem PKWT lebih populer karena dianggap efektif dan efisien bagi pengusaha, namun regulasi yang ada tidak memadai dalam melindungi pekerja outsourcing. Perlindungan hukum yang memadai harus mencakup pembatasan penggunaan outsourcing, pengaturan upah dan manfaat minimum, serta jaminan keamanan kerja. Penelitian ini menggunakan metode penelitian hukum normatif untuk menganalisis regulasi terkait dan teori keadilan dan kepastian hukum. Hasilnya menunjukkan bahwa peralihan hak-hak pekerja dari PKWT ke PKWTT sering kali tidak lancar, menyebabkan ketidakpastian status kerja bagi pekerja outsourcing. Perlindungan hukum harus mencakup aturan yang jelas mengenai status kerja, prosedur peralihan status kerja, dan hak-hak pekerja. Negara harus memastikan bahwa pekerja outsourcing memiliki akses yang sama terhadap hak-hak dasar pekerja dan tidak mengalami diskriminasi atau eksploitasi oleh pengusaha.

Abstract

Supreme Court Decision Number 23 P/HUM/2024 which annuls PKPU No. 9 of 2020. Supreme Court Decision Number 23 P/HUM/2024 relates to changes in the minimum age requirements for regional head candidates. In the decision, the Supreme Court granted the lawsuit filed by the General Chairperson of the Garuda Party, Ahmad Ridha Sabana, who challenged Article 4 paragraph (1) letter d of PKPU No. 9 of 2020 concerning the Nomination of the Election of Governor, Deputy Governor, Regent, Deputy Regent, Mayor, and Deputy Mayor. The problem is, what are the legal consequences of the Supreme Court Decision Number 23 P/HUM/2024 which annuls PKPU No. 9 of 2020 concerning the fourth amendment to PKPU Number 3 of 2017 concerning the Nomination of the Election of Governor and Deputy Governor, Regent and Deputy Regent, and/or Mayor and Deputy Mayor? How are the Aspects of Benefit and Legal Certainty in the Supreme Court Decision Number 23 P/HUM/2024 regarding the Age Limit for Regional Head Candidates? Normative legal research method. In conclusion, the legal consequences of the Supreme Court Decision Number 23 P/HUM/2024 which revoked PKPU No. 9 of 2020 concerning the Fourth Amendment to PKPU Number 3 of 2017 concerning the Nomination of the Election of Governor and Deputy Governor, Regent and Deputy Regent, and/or Mayor and Deputy Mayor. This decision has various legal implications that not only change the regulatory framework for regional elections, but also raise two (2) problems from the decision, namely: (a) Impact on the hierarchy of laws and regulations; (b) Impact on the nomination process. The Aspects of Benefit and Legal Certainty in the Supreme Court Decision Number 23 P/HUM/2024 regarding the Age Limit for Regional Head Candidates reflect efforts to realize a balance between the aspects of benefit and legal certainty in the general election system in Indonesia. Overall, from the aspect of utility, this decision does not provide a substantive solution to the community's need for clear and inclusive regulations, especially regarding the participation of the younger generation. From the aspect of legal certainty, this decision actually creates a vacuum of norms, opens up opportunities for new disputes, and creates instability in the implementation of regional elections. Thus, although this decision is legally valid, its impact shows weaknesses in creating utility and legal certainty.

Abstract

Pemuda, yang merupakan warga negara Indonesia berusia antara 16 hingga 30 tahun, memasuki tahap penting dalam proses pertumbuhan dan perkembangannya. Mereka memiliki peran aktif sebagai kekuatan moral, pengawas sosial, dan agen perubahan dalam setiap aspek pembangunan nasional, serta dalam pelaksanaan konstitusi, demokrasi, dan penegakan hukum. Hak konstitusional mengacu pada hak yang dimiliki setiap individu sesuai dengan konstitusi yang berlaku di negara tersebut. Keberadaan hak konstitusional merupakan bagian dari hak asasi manusia yang dijamin perlindungannya oleh konstitusi negara. Penelitian ini bertujuan untuk mengidentifikasi faktor-faktor penyebab pembatasan dan hambatan tersebut dalam mempersiapkan anggota organisasi kepemudaan untuk berpartisipasi dalam pemilu. Regulasi mengenai kepemudaan dan organisasi kepemudaan diatur dalam Undang-Undang Kepemudaan. Metode penelitian yang digunakan adalah pendekatan yuridis normatif. Bahwa organisasi kepemudaan, selain berfungsi sebagai wadah bagi pemuda, juga memiliki peran dalam mempengaruhi platform dan kebijakan politik, serta mengusulkan agenda yang relevan dengan kepentingan pemuda untuk kemajuan dan persatuan bangsa.

Abstract

This study aims to analyze the implementation of the principle of public interest in the implementation of public services by the Population and Civil Registration Office (Disdukcapil) of Bekasi Regency, as well as to evaluate the extent to which the implementation of these principles contributes to efforts to realize people's welfare. The principle of public interest is one of the basic principles in the implementation of public services that emphasizes the fulfillment of basic rights of the community in a fair, fast, equitable, and accountable manner. This research uses a qualitative approach with a case study method, where data is collected through in-depth interviews, direct observations in the field, and documentation studies on various policies and service reports. The results of the study show that the Bekasi Regency Disdukcapil has adopted various innovations in services, such as online services, digital queue systems, the use of information technology-based applications, and increasing the transparency of service information through social media and official websites. These steps are taken to improve accessibility, efficiency, effectiveness, and community satisfaction as service recipients. However, the implementation of the principle of public interest still faces several obstacles, such as limited competent human resources (HR), uneven information technology infrastructure, and low digital literacy among certain communities, especially the elderly and people in suburban areas. This condition results in the suboptimal public service oriented to the public interest to the maximum. Therefore, continuous efforts are needed through increasing the capacity of the apparatus, the development of inclusive and adaptive public service technology, and massive education to the public to increase participation, understanding, and awareness of the available services. Thus, the public services that are carried out can really contribute to realizing the welfare of the people as a whole, equitable, and just.

Abstract

This study aims to analyze the authority structure between the Ministry of Maritime Affairs and Fisheries (KKP) and Regional Governments in managing coastal areas through marine spatial utilization following the enactment of Law Number 6 of 2023 concerning the Stipulation of Government Regulation in Lieu of Law Number 2 of 2022 concerning Job Creation into Law. The main instrument studied is the Confirmation of Conformity of Marine Spatial Utilization Activities (KKPRL), which functions as a licensing instrument and a control mechanism to ensure that marine spatial utilization activities remain directed, integrated, and aligned with the principles of ecological, social, and economic sustainability. The research approach used is a juridical-empirical approach with a qualitative descriptive analysis method. Through this approach, the research not only examines legal norms but also captures the practice of implementing authority in the field. The results show that although the Job Creation Law is oriented towards simplifying business licensing, several problems remain that have implications for the effectiveness of coastal governance. These issues include disharmony between central and regional regulations, overlapping authority between the Ministry of Marine Affairs and Fisheries (KKPRL) and regional governments, and weak synchronization between national policies and regional instruments such as the Coastal and Small Islands Zoning Plan (RZWP3K). In addition to regulatory constraints, this study also highlights institutional and technical aspects. Limited human resource capacity in the regions, a lack of understanding of KKPRL procedures, and minimal inter-agency coordination hamper the effectiveness of coastal management. These conditions result in slow investment realization, conflicts over spatial use, and potential coastal environmental degradation. Therefore, this study recommends a strategy for harmonizing authority through improving vertical-horizontal coordination, strengthening the institutional capacity of regional governments, and developing derivative regulations consistent with the principles of good governance.
