Jurnal Hukum dan Peradilan (JHP) is published by the Research Center for Law and Judiciary of the Supreme Court of the Republic of Indonesia. JHP aimed to be a peer-reviewed platform and an authoritative source of information on legal and judiciary studies. The scope of JHP is analytical, objective, empirical, and contributive literature on the dynamics and development of legal studies, specifically in Indonesia. JHP welcomes scientific papers on a range of topics from research studies, judicial decisions, theoretical studies, literature reviews, philosophical and critical consultations that are analytical, objective, and systematic. However, from a wide range of topics that researchers can choose from, JHP puts more attention to the papers focusing on the sociology of law, living law, legal philosophy, history of national law, customary law, literature studies, international law, interdisciplinary, and empirical studies. Jurnal Hukum dan Peradilan (JHP) is a media dedicated to judicial personnel, academician, practitioners, and law expertise in actualizing the idea of research, development, and analysis of law and judiciary. Abstract

The existence of Judicial Commission, a state institution function as an external control for ethic code and judges code of conduct, often collide with an internal control function which carried out by Supreme Court. Both institutions were overlapping so that many energy been wasted for handling the problem raised. Both parties have to realize each position and area. They have to coordinate to do controlling function harmoniously in judicial technical context for honor, dignity and judges behavior.Keywords : Supreme Court, Judicial Commission, control function

Abstract

Constitutional Court Decision No. 34 / PUU-XI / 2013 has opened the space PK is not just one time as provided for by the Article 268 paragraph (3) Criminal Procedure Code so that PK can be done many times during found and submission of PK Novum although it has done previously. Perspective is the basis of this decision is justice. Responding to the verdict of the Constitutional Court, the Supreme Court publishes SEMA No. 7 Year 2014 on Reconsideration Request Submission In Criminal Case. Through the SEMA Supreme Court warned that provisions PK only once outside the Article 268 Criminal Procedure Code which was canceled by the Constitutional Court, therefore, PK criminal cases (in a similar case) is more than 1 (one) can not be accepted. Restrictions on the desired PK criminal case the Supreme Court is to provide legal certainty in the process of final settlement of criminal matters. Government through Minister of Law and Human Rights take strategic steps in resolving the legal expediency vision polemic filing legal remedies PK criminal cases, by coordinating state agencies and relevant ministries so as to produce an agreement that filing PK many times can not be executed until the issuance of PP. Therefore still valid set forth in the Judicial Authority Law and the Law on the Supreme Court.Keywords : Legal Aspects, Reconsideration, Criminal Case

Abstract

There are some provisions on the Bill of Religious Judicature Substantial Law on Marriage that need to be formulated in accordance with the present time. In this way, the Islamic Law of Marriage in Indonesia will be progressive and not discriminative against women. Those provisions include the pillar of marriage, the age of marriage, the guardian of marriage, and the status of child. This article tries to contextualize those provisions in accordance with the present time using hermeneutical approach. As the result, the registration of marriage should be one of the pillars of marriage, the age of marriage should be formulated by considering women’s reproduction health, the guardian of marriage for the bride is not pillar of marriage, and the child of pregnant woman marriage is counted as legal child whose lineage to both parents. Abstract

The existence of the Administrative Court in the judicial system in Indonesia as a manifestation of the commitment of the state to provide legal protection of individual rights and the rights of the general public so as to achieve harmony, harmony, balance, and dynamic and harmonizing the relationship between citizens and the State. But the execution of the decision of the Administrative Court which have permanent legal force by the State Administration officials are not fully effective, although the mechanisms and the stages of execution has been carried out. Factors causing poor execution of the decision of the Administrative Court, among others; absence of rule of law that forced the officials to implement the State Administrative Court's decision: the commandment of the judge's decision that dare not include the forced payment of a sum of money when the state administration officials concerned did not implement the decision of the Court; factor and compliance officials in carrying out the State Administrative Court decision. Abstract

Lesbian, Gay, Biseksual, dan Transgender sudah menjadi sebuah gerakan berbahaya, akan tetapi belum ada norma hukum yang mengatur tentang perilaku asusila tersebut, Pentingnya sanksi terhadap pelaku zina dan LGBT merupakan bentuk ketegasan negara dalam melindungi moral dan ideologi Nusantara dari faham berbahaya, akan tetapi Mahkamah Konstitusi menolak Permohonan tersebut karena pemidanaan pelaku zina, baik strafsoort maupun strafmaat, dan perilaku asusila lesbian, gay, biseksual, dan transgender memerlukan pembentukan norma baru, sehinggga menjadi Kebijakan hukum pidana (Penal policy). Kewenangan tersebut bukan merupakan kewenangan Mahkamah Konstitusi, akan tetapi menjadi hak Pembentuk Undang-Undang yaitu DPR bersama Presiden. Tulisan ini merupakan Anotasi atas Putusan Mahkamah Konstitusi Nomor 26/PUUXIV/2016 yang memberikan penjelasan kepada masyarakat adanya Quo Vadis Kebijakan hukum pidana (Penal policy) dalam putusan Mahkamah Konstitusi tersebut.Lesbian, Gay, Bisexual, and Transgender are becoming a dangerous movement, yet there is no legal norm governing this immoral behavior. The sanctions importance towards adultery and LGBT perpetrators is a form of state assertiveness in the conservation of the moral and ideology from dangerous movement. Meanwhile, the Constitutional Court rejected the request by the argumentation which is that punishment of adultery, both strafsoort and strafmaat, and Lesbian, Gay, Bisexual, and Transgender needs a new norm to a penal policy. The authority is not the authority of the Constitutional Court, but it is the right of the Acting Legislator, namely the House of Representatives together with the President. This paper is an Annotation of Open Law Policy of Constitutional Court Decision 26 / PUUXIV / 2016 that provides an explanation to the public about Quo Vadis of Open law policy in the Constitutional Court decision.

Abstract

The purpose of this article is to formulate the concept of restorative justice which balanced to protect between child offenders and the victims through the diversion (Victim-offender oriented). This goal will be realized through normative research (legal research) based on Restorative Justice concept.  In Law Number 11 of 2012 concerning the Child Criminal Justice System the process (SPPA Law), its prioritizes the Diversion Process (Settlement outside the court) carried out through a Restorative Justice approach. Article 5 paragraph (2) of the SPPA Law states Restorative Justice is the settlement of criminal cases by involving perpetrators, victims, families of perpetrators /victims, and other related parties to jointly to find a fair solution by emphasizing recovery and not based on revenge. Empirical conditions show that balanced legal protection between criminal offenders and victims has not implemented. Evaluation of Law Number 11 of 2012 is needed to formulating the Integrated Child Criminal Court.

Abstract

The imposition of ultra petita decisions in the practice of criminal law enforcement in Indonesia continues to be going on today. This paper tries to examine the ultra petita decisions with the provisions in the Criminal Procedure Code, and the principle of freedom and the active role of judges. In answering the problem, the writer makes use of a type of normative legal research that’s done by researching positive law. The results of the discussion display that the Criminal Procedure Code doesn’t prohibit judges from imposing ultra petita decisions. In examining criminal cases, the judge can impose decisions that are outside of the requisition or exceed the requisition of the public prosecutor. The Criminal Procedure Code only stipulates that the basis for the judge in imposing a decision is the bill of indictment. Justification for the imposition of decisions is also based on the principle of judge freedomand judges are active. Under these two principles, judges are free to impose decisions without influence from other parties and actively searching for out facts that are revealed in court for the realization of material truth as the aims of criminal procedural law. The writer's recommendations are: 1) Criminal law enforcers (judges, public prosecutors, lawyers/ defendants) need to form a common awareness that ultra petita decisions are permitted; 2) The rule by which the judge gives the ultra petita decisions needs to be made immediately, each for the short and long term.

Abstract

There is a difference between regulatory opinion of the Telecommunications Regulator/Ministry of Communications with the Corruption Court Judge on act did by PT. IM2 in collaboration with PT. Indosat. Title of cooperation between this service providers and network operators are "Internet access via cellular networks Indosat". In view of the regulator, this cooperation is in conformity with the regulations, even obligatory upon network operators to cooperate with the service provider. However, in view of the prosecutor and the judge, this cooperation violates the regulations. A difference of views between regulatory enforcement versus law enforcement is certainly very noteworthy because it will has very big impact to telecommunication development as the backbone of the national economy and the development of national legal systems and culture. Abstract

Practice of whistleblower and justice collaborator law protection especially in the effort to destroy the organized crime in Holland, germany and Australia to institution and the protect orientation is variatif and partial. Protection practice in Holland uses witness agreements, it is the agreement between the public prosecutor and witness to give the testimony with reward especially to organized crime. In Germany, trough Witness Protection Law In Process Criminal Investigation and Protection Against Victims (Zeugenschutzgesetz/ZschG). Essentially, Zeugenschutzgesetz/ZschG rules the dimention for the witnesses, both witnesses and not the victims. Besides, it is also ruled about rights issues witnesses before the trial and during the trial process. On the aspect of witness rights before the trial include the examination of witnesses in the policemen and prosecution, the secret of witness identity and the changes of witness identity. Then, the witness right in the trial are separated examination of the suspect and inspection with a camera recording. Then in Australia trough the National witness Protection Program with a secret identity, no responsibility in criminal and civil, the protection from the defamation, the protection from criminal acts of retaliation and conditionalprotection if their names are published to the media.Keywords: Law Protection, whistleblower, justice collaborator and organized crime

Abstract

Indonesian justice system is not fully functioning because there-rules and regulations that do not run as it should and there is a need to ensure greater freedom sanction judges in performing their duties. Public confidence in the judiciary should be restored. To strengthen the justice system needs to be guaranteed freedom of judges. Human resources need to be increased both its integrity and mastery of knowledge in particular substantive legal or formal. Modernization of the administration of justice would be better facilitate the course of justice will grow back confidence to the judiciary, but now is not optimal functioning to complete the administration of justice as is the accumulation of decisions that have not come to those seeking justice. Justice seeker the right to obtain justice freely and impartially, to be treated the same as fellow seekers of justice, and to obtain a decision within a reasonable, simple and low cost is a basic need for every seeker of justice. There needs to be increased in the direction of the change or shift from "the judge is bound" to the "independent judge", of "justice under the law" toward "justice according to the judge as set out in its decision, of thinking with reference to the system in the direction of thinking with reference to the problem.
