Jurnal Hukum dan Peradilan (JHP) is published by the Research Center for Law and Judiciary of the Supreme Court of the Republic of Indonesia. JHP aimed to be a peer-reviewed platform and an authoritative source of information on legal and judiciary studies. The scope of JHP is analytical, objective, empirical, and contributive literature on the dynamics and development of legal studies, specifically in Indonesia. JHP welcomes scientific papers on a range of topics from research studies, judicial decisions, theoretical studies, literature reviews, philosophical and critical consultations that are analytical, objective, and systematic. However, from a wide range of topics that researchers can choose from, JHP puts more attention to the papers focusing on the sociology of law, living law, legal philosophy, history of national law, customary law, literature studies, international law, interdisciplinary, and empirical studies. Jurnal Hukum dan Peradilan (JHP) is a media dedicated to judicial personnel, academician, practitioners, and law expertise in actualizing the idea of research, development, and analysis of law and judiciary. Abstract

Penyimpangan dalam proses peradilan pidana sebenarnya bukan hanya dapat terjadi pada tahap penyelidikan, penyidikan (pra-adjudikasi), penuntutan dan pemeriksaan di sidang pengadilan (adjudikasi), tetapi juga dapat terjadi pada tahap pelaksanaan putusan pengadilan (pasca adjudikasi). Penelitian ini membahas masalah peranan Hakim Pengawas dan Pengamat dalam mencegah terjadinya penyimpangan pada tahap pelaksanaan putusan pengadilan, kendala apa saja yang dihadapi, dan bagaimana upaya mengatasinya. Penelitian ini merupakan penelitian normatif yang sebagian besar datanya diperoleh dari studi kepustakaan didukung oleh penelitian observatoris selama peneliti melaksanakan tugas sebagai jaksa. Hasil penelitian menunjukkan bahwa selama ini peranan Hakim Pengamat dan Pengawas belum dijalankan secara maksimal sehingga belum cukup efektif dalam mencegah terjadinya penyimpangan pada tahap pelaksanaan putusan pengadilan. Adapun kendala penyebab Hakim Pengamat dan Pengawas kurang berperan secara efektif, pada umumnya terkait dengan kesibukan Hakim Pengawas dan Pengamat itu sendiri, karena selain dibebani tugas sebagai pengamat dan pengawas yang bersangkutan juga masih dibebani tugas-tugas penanganan perkara. Bahkan tugas sebagai Hakim Pengawas dan Pengamat jutsru dianggap sebagai tugas sampingan. Kendala lain yang dihadapi ialah belum tersedianya sarana dan prasarana, serta tidak adanya biaya operasional. Oleh karena itu ke depan perlu ada reformulasi terhadap keberadaan lembaga Hakim Pengawas dan Pengamat agar dapat berfungsi secara efektif.Discretion in the criminal justice process not only occur in the investigation (pre-adjudication) and the prosecution on trial stage (adjudication) phase, but also occur during the execution of the court decision (post-adjudication). This study discusses the role of supervisory judges in preventing the occurrence of discretion in the execution of court decisions, the problems arise, and the solution. This research is a normative research that most of the data obtained from literature study, supported by observatory research during researcher perform duty as a prosecutor. The results showed that the role of supervisory judge not maximal so that not yet effective enough in preventing occurrence of discretion at stage of execution of court decision. The supervisory judge is busy with the duties of handling cases. Most of the time the duties as a supervisory judges are considered as a side task. Other obstacles encountered are the lack of facilities and infrastructure, and the absence of operational costs. Therefore, in the future there needs to be a reformulation of the existence of the Supervisory Judge institutions in order to be effective.

Abstract

This research is to explore criminal mediation based on local wisdom in dealing with carok violent conflicts in Madurese society. There are two important problems in this study, which is the reason why the criminal justice system is less than optimal in dealing with carok in Madurese society and how criminal mediation can be a model in dealing with conflict based on local wisdom. The research method used in this study is the doctrinal and non-doctrinal methods. By using Freidman's theory and Sociological Jurisprudence related to comparative law, it was found that the criminal justice system is not fully optimal in dealing with carok violent conflicts in Madurese society because of differences in interpreting the concept of justice in the perspective of local communities, the dominance of legalistic perspectives on law enforcement officers and the strong practicality of maintaining self-esteem and religion. The criminal mediation model used by law enforcement officers on Madurese people is based on local wisdom which is a model of family criminal mediation (victim-perpetrators, families, reparations) that is connected to the criminal court system ranging from investigations, closing speeches, examination of cases involving parties warring parties, with mediators, scholars, and law enforcement officials, and the results are written as an act of peace that can be used by the perpetrators to change the sentence. The study recommends that it is very important for law enforcement officials and social leaders, religious scholars and district governments to act as neutral mediators by empowering customary peace institutions that are connected to the criminal justice system.

Abstract

The banking sector as one of the drivers of the national economy plays an important role in funding a business through bank credit distributing activities. In practice, this banking service raises legal problems, not only banking crimes but also corruption. Supreme Court Decision No. 1812 K / PID.SUS / 2014 on behalf of the Defendant Dian Siswanto, S.E. MM., in the case of a corruption shows this. This paper examines the element of unlawful and abuse of authority in cases of corruption in the banking sector. The research method used is normative law which is prescriptive with a statute approach, a conceptual approach, and a case approach. The results show 2 (two) things, first, that the defendant's actions met the unlawful element in the act of corruption as charged in the primary indictment. Second, the judge had wrongly in the application of law based on the subsidiary indictment concerning abuse of authority which was not fulfilled. The judge in this case, was not punctilious in digging up legal facts and was not correct in applying the law. Therefore, in the case of deciding a case, if the charges are of subsidiarity, the judge should prove the primary indictment carefully before deciding based on the subsidiary indictment to create justice, benefit and legal certainty in law enforcement in general, and especially for the accused.

Abstract

Disputes over child custody often occur after a divorce. Although the regulation on child custody has been regulated in the Marriage Law and Compilation of Islamic Law (KHI), it is allegedly not responsive enough to gender justice that gives child custody to one party based on the particular type genitals. So this triggers gender inequality and injustice. This article analyses the problem of establishing child custody descriptively analytically with a gender approach as a tool of analysis. This article concludes that the laws and regulations in Indonesia regarding the determination of child custody are still classified as gender-biased and have not been responsive enough to the issue of gender justice. Reciprocal interpretation model (qira'ah mubadalah), as a new approach in understanding the text, if applied in following the rules can be interpreted with the perspective of distinction between men and women who place women and men as human subjects that are whole and equal. Thus, both mothers and fathers alike have the same opportunities in child custody as long as they have qualified abilities in terms of childcare.

Abstract

This in-depth research explores the emerging relationship between artificial intelligence (AI) and legal systems by addressing key questions and understanding the evolution of global justice systems. This study focuses on the role of AI in strengthening the efficiency and objectivity of the judiciary, especially through the application of AI as judges in countries such as China and Estonia. This research aims to systematically analyse these developments, examining how AI is being integrated into justice systems in different parts of the world with challenges related to ethics, accountability, and human rights. The study results show that the integration of AI in the legal system brings increased efficiency and potential for transparency but also raises serious concerns about bias in AI algorithms, limitations in interpreting complex laws, and the impact on human rights principles. The main findings of this research show that the integration of AI in the legal system contains great potential for transformation but also requires a careful approach. While AI can improve the efficiency and quality of decision-making, it is important that AI is developed and implemented within a solid legal and ethical framework that respects human rights and maintains the justice system's integrity. This research emphasizes the need to consider each country's unique legal, cultural, and social context when adopting AI into their legal systems.

Abstract

In commercial contracts, the debates about 'fairness and balance' that led to the 'injustice and imbalance' position of the parties basically irrelevant to be disclosed. It is based on the consideration that the positions of the parties in commercial contracts is similar on the stage of the negotiation process (pre-contractual phase), the formation of the contract (contractual phase) and the execution of the contract (post-contractual phase). Meanwhile, the results of the exchange of the interests of the parties considered fair if it lasts proportionally. The proportionality of exchange of rights and obligations under commercial contracts do not demand results that are always balanced and same (equilibrium-mathematically), therefore the differences in the results are considered fair and reasonably acceptable if the exchange process of the rights and obligations stay proportional. Application of the principle of proportionality in the whole chain of contractual process is basically a manifestation of the doctrine of "fairness of contract" adopted and developed today.Keywords : the exchange of rights and obligations, the principle of proportionality,fairness doctrine in a contract

Abstract

Normatively, judicial registrar status is set differently. While explicity defined as a functional, but without the credit and judicial office. Functional qualification held judicial registrar existence is synchronizedwith the structural position of the promotion system and regular. A clerk on the supreme of court must be a judges. So that the clerk have a career at the highest level only appellate court registry. The supreme of court regulation drafting that gaves the registrar portion to career clerk, then enactment of civilian state apparatus regulation get the civil servants functional oriented. Abstract

Appeals is a remedy that can be used by the taxpayers during the tax dispute with the tax authorities, having previously filed Objection. Philosophy of remedies is a means of seeking justice to fight for their rights as equal before the law, it should be an option that gives freedom for the taxpayer to use or not use. Anomaly occurs, where the Act Number 28 of 2007 on General Provisions and Tax Procedures seeking justice requires to pay the administrative sanction a fine of 100% of Appeals were denied or granted in part. In the middle of the threat of sanctions, taxpayers are dealing with a lower ability of court to produce a fair Judgment for the parties. Abstract

Despite legal safeguards for freedom of expression and the right to be heard, consumers frequently encounter legal obstacles, particularly in cases where businesses initiate defamation claims. This issue is exemplified by the cases of Deedi Tjhandra, Muhadkly AT, and Desvalia, wherein consumers, after receiving no response to their complaints from developers, took to social media to post reviews of the apartment they had purchased. In these cases, it was found that the developers had breached contractual obligations, as the apartments and their associated amenities did not conform to the standards advertised in promotional materials. This study aims to analyze the rights of consumers to post video reviews of goods and/or services on social media, especially when such reviews result in defamation lawsuits and subsequent convictions. The court's ruling, in this case, found Deedi Tjhandra guilty of defamation despite the defamation statute in question having been repealed and replaced by more recent legislation. The updated legislation specifies that legal entities are barred from pursuing defamation claims. Additionally, the court did not consider the regulations established by the Joint Decree and CC rulings. The research employs a normative juridical methodology incorporating legislative and conceptual analyses. The novelty of this study lies in its exploration of the public interest concept within criminal and civil law as it pertains to defamation statutes being met through social media, particularly when these reviews serve the public interest. Additionally, the study assesses the adherence of law enforcement agencies to established regulations concerning defamation.
