Abstract

The Special Region of Yogyakarta, known as a hub of culture and education, faces pressing challenges in addressing climate change driven by intensive economic activities and natural resource exploitation. The impacts of climate change are intrinsically linked to environmental concerns and social justice, disproportionately affecting vulnerable groups such as farmers, urban poor communities and riverbank residents. Adopting a legal and human rights-based framework is crucial to ensuring inclusive and equitable protection for all. This study examines the legal and human rights challenges in mitigating climate change and evaluates the relevance of John Rawls’ theory. Employing a normative juridical method with statute and conceptual approaches, the research combines regulatory analysis with the principles of substantive justice. The findings highlight weak enforcement of environmental laws as a major legal barrier, alongside inadequate protections for vulnerable groups and limited community participation, which hinder progress in achieving human rights objectives. The study underscores the need for enhanced inter-agency coordination, integration of human rights perspectives, and active multi-stakeholder engagement. Prioritizing the protection of vulnerable groups is emphasized as a fundamental aspect of substantive justice. Key recommendations include strengthening legal enforcement, fostering community involvement in policy-making, and advancing research on technological innovation and community-driven solutions.

Abstract

Abstract The development of information and communication technology has increased the urgency of protecting personal data in Indonesia, especially with the rise in data breach incidents that affect citizens’ privacy rights. This study aims to identify human rights violations that occurred in the National Data Center data breach in 2024 and describe the impacts experienced by the Indonesian public as a result of the incident. Using a qualitative approach, this study collects data through literature review related to data breach cases and human rights in Indonesia. The study results show that: 1) The identification of human rights violations in the 2024 national data breach is a violation of citizens’ privacy rights and a violation of human rights concerning personal data protection. 2) The data breach has a direct impact on privacy rights and increases the risk of fraud and identity theft. Additionally, the data breach also disrupts essential public services, such as the tax system, immigration services, and education. This study recommends improvements to legal policies and increasing public awareness of the importance of data privacy. The findings are expected to contribute to strengthening data protection regulations in Indonesia, as well as promoting improved cybersecurity and government accountability in safeguarding citizens’ personal data.

Abstract

Jurnal ini membahas peran sosiologi hukum dalam kebijakan dan penegakan hukum di Indonesia. Sosiologi hukum sangat penting untuk memahami interaksi antara hukum dan masyarakat, serta dinamika pembentukan, implementasi, dan penegakan hukum. Dalam pembentukan kebijakan, sosiologi hukum membantu mengidentifikasi faktor sosial, politik, dan ekonomi untuk merumuskan kebijakan yang responsif. Implementasi hukum menghadapi tantangan seperti ketidakadilan sumber daya dan penegakan yang kurang efektif, dipengaruhi oleh budaya hukum, struktur sosial, dan kapasitas institusional. Dalam penegakan hukum, sosiologi situasi yang terjadi saat ini yaitu ketidakadilan “tumpul ke atas dan tajam ke bawah” serta pentingnya transparansi dan peran media sosial. Efektivitas penegakan hukum dipengaruhi akses keadilan, kesadaran hukum, integritas penegak hukum, dan ketaatan masyarakat. Jurnal ini juga menganalisis hubungan timbal balik hukum dan masyarakat dalam konteks sosial, politik, dan ekonomi, serta implikasi kebijakan seperti Tapera dan restorative justice.

Abstract

This paper examines how abortion data within Indonesia’s national health information system fails to reflect social realities and contributes to hidden criminalization and the statistical invisibility of women—further reinforcing structural injustice within the public health system. This study employs a normative legal research method with a qualitative descriptive approach, drawing on literature review and feminist analysis of secondary data and prevailing legal frameworks. The findings reveal that the absence of comprehensive and accurate abortion data in health statistics results in the institutional neglect of women’s experiences, particularly among poor and marginalized groups. Criminalization and stigma are key drivers of data suppression within health facilities, while national survey systems such as the Demographic and Health Survey (SDKI) omit critical variables such as age, reasons for abortion, marital status, and types of service providers. Consequently, the state fails to develop inclusive and evidence-based reproductive health policies. In response, this paper proposes three key recommendations: (a) reformulating abortion data regulations through derivative policies and technical guidelines for service documentation; (b) developing a national survey system and instruments that comprehensively include abortion-related data; and (c) revitalizing legal and ethical education for medical professionals on reproductive rights, legal boundaries, and responsible medical documentation. The concept of abortion data justice is offered as a framework to build an ethical, participatory, and equitable data system for women.

Abstract

Indonesia is a country strategically positioned at the crossroads of the world, a fact that has significant implications for global human movement with diverse visions and missions. The dynamics of such global mobility inevitably influence the geopolitical and geostrategic policies of the Government of the Republic of Indonesia, especially given its unique geographical conditions and location at a global intersection. This reality underlies the role of the Ministry of Law and Human Rights of the Republic of Indonesia, particularly the Directorate General of Immigration, which serves as the gatekeeper of national sovereignty. This role is encapsulated in the motto Bhumi Pura Wira Wibawa, meaning the Authoritative Gatekeeper of the State. With this guiding principle, the Directorate General of Immigration bears responsibility not only for delivering quality immigration services but also for enforcing the law, safeguarding state security, and supporting the development of community welfare. One of the key manifestations of this responsibility lies in carrying out measurable and systematic Immigration Administrative Actions. These actions require strong coordination across institutions and active involvement of various elements of society, ensuring that immigration management is both comprehensive and sustainable.
