Abstract

Marine and fisheries governance in Indonesia has experienced significant changes in regulations, starting from Law No. 31 Year 2004, Law No. 45 Year 2009, to the Job Creation Law. These regulatory dynamics affect aspects such as licensing, authority, and the impact on fishermen and coastal communities. This research uses a normative juridical approach to analyse and reveal instability in marine and fisheries governance, with a conceptual approach to develop theoretical concepts that explain the complexity of these issues. The results show a regulatory shift to a risk-based licensing approach and centralisation of authority to the central government. Centralisation of licensing can create challenges for local coastal communities, which are geographically closer to the local government. Difficulties in accessing information, participation, and lack of rapid response are the main obstacles. Policy reviews and adjustments need to be made regularly to address instability and inequality. Shifts in licensing and authority must take into account environmental and social aspects in addition to economics. Involvement of stakeholders and coastal communities in the policy change process is key, with transparency and effective communication as key elements of success.

Abstract

Korupsi merupakan permasalahan pelik di Indonesia. Tindakan korupsi yang mereka lakukan itu bukan hanya terjadi di pusat saja tapi juga di daerah. Salah satu kasus korupsi yang menjadi sorotan adalah korupsi massal DPRD Kota Malang. Ditinjau dari kaca mata nomokrasi Islam, korupsi massal tersebut telah menabrak prinsip-prinsip yang ada, seperti: prinsip kedaulatan (otoritas tertinggi), prinsip pengelolaan negara, prinsip relasi negara dan masyarakat dan prinsip tujuan sebuah negara. Perbuatan mereka dapat dikategorikan sebagai sariqah al-kubra (pencurian besar) yang hukumannya adalah hukuman mati. Selain itu, tindakan korupsi yang mereka lakukan tersebut juga telah melanggar norma-norma yang ada, baik secara ideologis, yuridis maupun sosiologis.

Abstract

Abstract: Indigenous People Adherents are a group that currently still exists in Indonesia. Their existence actually existed long before the existence of the Indonesian state itself. This group has spiritual values that they inherited and preserved from their ancestors in ancient times. However, their existence before the Constitutional Court Decision Number 97/PUU-XIV/2016 was often marginalized, and received discriminatory services. Finally, the Constitutional Court decided that the application for a judicial review of the Adminduk Law was contrary to the constitution. This study is a normative research library study. The data used is secondary data which consists of several legal materials including primary legal materials, secondary legal materials, and tertiary legal materials. The approach in this study is the statute approach conceptual approach, and finally historical approach. There are 2 (two) questions that the writer will examine. First, how is the protection of followers of the belief after the Constitutional Court Decision Number 97/PUU-XIV/2016. The second is how to protect Indigenous People's Adherents of the a quo Post Decision Belief in a responsive legal perspective. In this study, the authors found that the current Indonesian government has issued legal products after the quo decision. Existing regulations can at least protect them in Indonesia. Especially in the public service sector which is the main door to obtaining services and other rights. When viewed from a responsive legal perspective, it can be interpreted that the Indonesian government is in line. Even though some regulations still have not optimally regulated the protection of adherents of belief. The Indonesian government has responded well by issuing legal products after the decision of the Constitutional Court was decided.Kewords: Indigenous People Adherents; Constitutional Court; Human Rights: Responsive Law; Legal ProtectionAbstrak: Penghayat kepercayaan kepada Tuhan Yang Maha Esa merupakan kelompok yang saat ini masih eksis di Indonesia. Keberadaan mereka sebenarnya sudah ada jauh sebelum adanya negara Indonesia itu sendiri. Kelompok ini memiliki nilai-nilai spiritual yang mereka warisi dan lestarikan dari nenek moyang atau leluhur pada zaman dahulu. Namun, keberadaan mereka sebelum adanya Putusan Mahkamah Konstitusi Nomor 97/PUU-XIV/2016 kerap kali termarginalkan dan mendapatkan pelayanan diskriminatif. Akhirnya Mahkamah Konstitusi memutuskan bahwa permohonan judicial review UU Adminduk bertentangan dengan konstitusi. Kajian ini merupakan kajian library research normatif. Data yang digunakan adalah data sekunder yang terdiri dari beberapa bahan hukum meliputi bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Pendekatan dalam penelitian ini adalah statute approach, conseptual approach, terakhir historical approach. Terdapat 2 (dua) pertanyaan yang akan penulis teliti. Pertama, bagaimana perlindungan terhadap penghayat kepercayaan pasca Putusan Mahkamah Konstitusi Nomor 97/PUU-XIV/2016. Kedua bagaimana perlindungan terhadap Penghayat Kepercayaan Pasca Putusan a quo dalam kaca mata hukum responsif. Hasil dari kajian ini penulis menemukan bahwa pemerintah Indonesia saat ini sudah mengeluarkan produk-produk hukum pasca adanya putusan a quo. Regulasi yang ada setidaknya dapat menjadi pelindung para penghayat kepercayaan yang ada di Indonesia. Terlebih dalam sector pelayanan public yang menjadi pintu utama untuk memperoleh pelayanan dan hak-hak lainnya. Apabila ditinjau dalam kaca mata hukum responsif dapat diartikan bahwa pemerintah Indonesia telah sejalan. Meskipun memang masih terdapat beberapa peraturan yang belum optimal mengatur mengenai perlindungan terhadap penghayat kepercayaan. Pemerintah Indonesia telah merespon dengan baik dengan mengeluarkan produk-produk hukum pasca diputuskannya putusan Mahkmah Konstitusi.Kata kunci: Pengahayat Kepercayaan; Mahkamah Konstitusi; Hak Asasi Manusia; Hukum Responsif; Perlindungan Hukum

Abstract

Illegal sea sand mining poses significant challenges to environmental justice, particularly in Indonesia’s coastal regions. This research is motivated by the urgency to understand and evaluate legal policies to address the complexities of issues arising from sea sand mining activities. The study explores how environmental legal policies are applied to regulate and mitigate the impacts of illegal sea sand mining. Additionally, it examines the consequences of illegal mining on environmental justice, particularly concerning coastal ecosystem degradation and the livelihoods of local communities. Despite the existence of regulatory instruments such as Government Regulation No. 26 of 2023 on Marine Sedimentation Management and Law No. 32 of 2009 on Environmental Protection and Management, enforcement remains inadequate, allowing persistent violations that exacerbate ecological damage and social inequities. This study employs a normative legal method with a statutory and case study approach, analyzing secondary data from legal documents, academic literature, and media reports. Thematic, policy, and case analyses reveal significant implementation gaps, weak enforcement mechanisms, and insufficient community participation in environmental governance. The findings indicate that while existing legal frameworks provide a foundation for sustainable resource management, systemic weaknesses and fragmented governance hinder their effectiveness in preventing illegal activities. This research recommends strengthening regulatory enforcement, enhancing community empowerment through environmental education, and integrating sustainability principles into policy implementation. Additionally, fostering multi-stakeholder collaboration is crucial for addressing governance challenges and ensuring the equitable distribution of environmental benefits and risks. These strategies aim to promote environmental justice and sustainable coastal management in Indonesia.

Abstract

Environmental destruction as a war tactic poses significant challenges under international law. This study explores the intersection of International Humanitarian Law (IHL) and International Human Rights Law (IHRL) in addressing war-induced ecological harm, emphasizing “environcide” as a human rights violation. Using a normative juridical method, this research examines legal frameworks, including the ENMOD Convention, Geneva Conventions, and Rome Statute, alongside case studies from Vietnam, Ukraine-Russia, and Gaza. Employing a statute approach and Critical Legal Studies (CLS) analysis, the study reveals structural inequalities and power dynamics that hinder legal enforcement. It also identifies opportunities to strengthen accountability, recognize environcide, and promote participatory legal reforms. Aligning IHL and IHRL through these mechanisms can enhance environmental protection during and after conflict, ensuring a more just and sustainable approach to war’s ecological consequences.

Abstract

High rates of unresolved customer complaints and the absence of structured Key Performance Indicators (KPI) and transparent incentives present significant challenges for PT XYZ, a telecommunications company. These issues undermine employee motivation, operational efficiency, and customer satisfaction, ultimately threatening the company’s profitability and competitive positioning. This study analyzes how Organizational Culture influences Knowledge Management, impacting KPI, System Incentives, and Customer Complaints in a telecommunications company. Using the Partial Least Squares Structural Equation Modeling (PLS-SEM) approach, the findings reveal that Organizational Culture significantly enhances Knowledge Management, which serves as a critical mediator in driving organizational effectiveness. The study highlights the strong and significant relationships between Knowledge Management and internal processes, such as KPI and incentive systems, as well as its moderate impact on reducing customer complaints. The results confirm the mediating role of Knowledge Management in linking Organizational Culture to both operational efficiency and customer satisfaction. These findings emphasize the importance of fostering a strong organizational culture to support knowledge-sharing practices, enabling companies to achieve their strategic goals. Future research could expand on these findings by exploring additional mediating variables or applying the model to other industries.

Abstract

Islamic law does not categorically prohibit all forms of interfaith marriage. However, this permissibility requires critical re-examination in light of contemporary socio-legal realities. In the Indonesian context, the increasing occurrence of interfaith marriages, compounded by the issuance of Supreme Court Circular (SEMA) No. 2 of 2023, which explicitly prohibits their recognition, raises urgent questions regarding the relevance and applicability of classical Islamic legal doctrines in modern legal systems. This article explores whether the permissibility of interfaith marriage in Islamic law is both theoretically coherent and practically feasible, or whether it remains a doctrinal ideal with limited applicability in real-world contexts. Utilizing a normative legal methodology that incorporates conceptual, statutory, and historical approaches, and employing a contemporary fiqh-based analysis, the study argues that the marriage of a Muslim man to a Christian or Jewish woman (ahl al-kitāb) remains valid under classical Islamic jurisprudence (fiqh). Nevertheless, such permissibility should not be generalized as a communal norm, especially within Muslim-majority societies. Instead, interfaith marriages should be addressed on a case-by-case basis, particularly in exceptional circumstances, such as in non-Muslim majority societies where access to Muslim partners is severely limited, including certain localities in Indonesia. The findings highlight the significance of contextual legal reasoning (ijtihād) and the discretionary application of Islamic legal norms in accommodating interfaith marriages within Indonesia's pluralistic legal and social framework.

Abstract

Corruption in procurement remains a critical challenge that undermines economic development, distorts market competition, and erodes public trust in governance. While conventional legal frameworks and enforcement mechanisms have played a crucial role in addressing this issue, emerging digital oversight technologies and civil society engagement offer new opportunities to enhance transparency and accountability. This study adopts a normative juridical research methodology, integrating a statutory approach, conceptual approach, and comparative approach to examine the mechanisms for combating corruption in public procurement. The statutory approach assesses the legal framework governing procurement oversight in Indonesia, particularly Presidential Regulation No. 16 of 2018 and regulations issued by the National Public Procurement Agency (LKPP). The conceptual approach explores governance theories, including good governance, public participation, and e-governance, to evaluate institutional oversight, civil society involvement, and digital interventions. Furthermore, the comparative approach examines procurement oversight models from South Korea, identifying best practices for institutional coordination, regulatory enforcement, and technological integration. The findings reveal that digital tools, such as e-procurement systems, public reporting platforms, and real-time monitoring technologies, significantly reduce corruption risks by enhancing transparency and minimizing human discretion. Additionally, civil society organizations play a vital role in ensuring policy effectiveness and fostering public participation in procurement oversight. However, challenges remain, including legal loopholes, resistance from vested interests, and the adaptability of corrupt actors to technological advancements. This study highlights the necessity of an integrated approach that combines legal reform, civic engagement, and digital innovation to create a more accountable and corruption-resistant procurement system. Abstract

Climate change poses significant challenges to vulnerable coastal communities in Indonesia. As a welfare state, the Indonesian government is expected to safeguard these vulnerable groups through policies that promote their welfare and sustainable livelihoods. However, current policies create a paradox. This article explores this paradox: on the one hand, Indonesia adheres to the welfare state principle, which demands that all government actions be grounded in law, ensuring public safety and welfare. On the other hand, the policies focus on exploiting natural resources, exacerbating the vulnerabilities of coastal communities, particularly in the face of climate change. The article employs a normative method by utilizing data from various literature sources, such as legislation and policy documents. The analysis combines statute, socio-legal and conceptual approaches to address the issues at hand. Findings indicate that despite Indonesia's constitutional declaration as a welfare state, this is not reflected in its current policies. The enactment of the Job Creation Law and industrial downstream policies have disregarded local wisdom, worsening the environmental and social vulnerabilities of coastal communities. This contradiction suggests an urgent need for policy reforms that better align with the principles of a welfare state and climate justice. The study recommends more integrative and holistic policy reforms, emphasizing long-term welfare, environmental sustainability, and the active participation of coastal communities.

Abstract

This study examined the transformative role of village governance in advancing rural welfare in Indonesia, particularly following the enactment of the Village Law. This pivotal legislation grants villages autonomy to independently manage their resources and budgets, targeting enhanced rural prosperity through substantial financial allocations. The Village Law aims to empower local communities and strengthen their socio-economic foundations by addressing the persistent gaps in rural development since Indonesia’s independence. The study adopted a normative-juridical method integrated with a qualitative approach to scrutinize the legal norms and frameworks governing village governance and the Village Fund. A historical approach was used to trace the evolution of village governance structures, while a conceptual framework was employed to explore key principles of governance, accountability, and transparency. This multidimensional analysis underscores the necessity of implementing robust checks and balances, such as the Village Consultative Body (BPD) and public information systems, as fundamental pillars for ensuring transparency, accountability, and effective governance. Furthermore, the study highlights critical strategies for strengthening village governance, including capacity-building programs for village officials and fostering active community participation, particularly among marginalized groups. These initiatives aim to prevent the misuse of power, enhance public oversight, and support inclusive rural development. By embedding these mechanisms, villages can achieve sustainable governance that drives economic growth, improves community welfare, and bridges historical inequalities in rural development. The findings contribute to the broader discourse on good governance by emphasizing the interplay between legal frameworks, institutional capacity, and participatory practices in achieving equitable and effective rural governance.
