Abstract

This research examines legal protection for the rights of village communities. The focus of this study is Law no. 6 of 2014 concerning Villages. The type of research method that will be used in this research is in the category of normative legal research. Because normative research mainly uses library materials as a source of research data. or also called (Library research), a method used to collect data from various literature. This research approach is a conceptual approach and conceptual approach. The results of this research state that, firstly, the rights of village communities are an authority or power granted by law. An interest that is protected by law, both private and public, secondly legal protection, the village government has the obligation to fulfill the rights that have been regulated in the Village Law. However, what is not regulated in the Village Law is the regulation of legal protection if these rights are not granted, resulting in legal uncertainty.

Abstract

PERMA Number 1 of 2016 concerning Procedures for Judicial Mediation is one of the factors that influence the effectiveness of mediation in court. The ratification of Regulation of the Supreme Court of the Republic of Indonesia (PERMA) Number 1 of 2016 concerning Procedures for Mediation in the Courts has brought about fundamental changes in judicial practice in Indonesia. Mediation as an effort to reconcile disputing parties is not only important but must be carried out before a case is examined at trial. Peace efforts are not just a formality, but must be carried out seriously and sincerely to find a win-win solution to a problem for both parties so that they can find common ground. Settlement efforts do not only occur at the beginning of the trial, but throughout the discussion of the case and even at the end of the trial before the panel of judges announces its decision. According to PERMA Number 1 of 2016, mediation must be considered as one of the stages of the litigation process in the General Courts and Religious Courts.

Abstract

A dispute must be resolved peacefully and through negotiations between the two parties to the dispute. Settlement of Industrial Relations Disputes can be done through litigation or non-litigation. There are 4 ways to resolve industrial relations disputes that can be used using non-litigation channels, including bipartite, conciliation, arbitration and mediation. The dispute resolution process is not carried out before the court, however there are some who need the assistance of a neutral third person so that an agreement can be quickly reached between the worker/laborer and the entrepreneur and so that it does not harm either of them. The Industrial Relations Court is a dispute resolution model that must be resolved when a dispute is discovered between workers/laborers and employers. The Industrial Relations Court plays an important role in resolving labor disputes in Indonesia. Based on Law Number 2 of 2004 concerning Settlement of Industrial Relations Disputes, PHI has the authority to examine, adjudicate and decide cases related to labor disputes. PHI's role in resolving labor disputes includes resolving disputes regarding rights, resolving interest disputes, resolving employment termination (PHK) disputes and resolving disputes between worker/labor unions within a company. The Industrial Relations Court (PHI) is expected to be able to resolve labor disputes in Indonesia fairly, quickly and cheaply so as to create harmonious industrial relations between workers/laborers and employers

Abstract

Provinsi Nangroe Aceh Darussalam atau yang dikenal dengan Provinsi Aceh merupakan suatu Provinsi yang mendapat perlakuan khusus dari Pemerintah Pusat Republik Indonesia. Sesuai dengan UU Nomor 18 Tahun 2001 Tentang Hak Otonomi Khusus  Bagi  Provinsi Daerah  Istimewa Aceh  Sebagai Provinsi  Nanggroe Aceh Darussalam. Lahirnya UU tersebut tak lepas daripada Sejarah, Nilai-nilai agama yaitu Syari’at Islam yang begitu kental,  dan adat budaya  berlandaskan norma-norma hukum islam yang hidup di dalam masyarakat aceh yang sangat kuat, serta posisi geografis Provinsi Aceh merupakan pertimbangan utama Pemerintah Pusat dalam memberikan hak otonomi khusus bagi Provinsi Aceh. Jenis ini merupakan penelitian hukum normatif, yaitu penelitian yang memiliki objek kajian tentang kaidah atau aturan hukum. Kesimpulannya Menurut pendapat ahli hukum Husni Mubarak, dosen doktoral bidang studi Hukum Syariah dari Universitas Negeri Ar-Raniry Banda Aceh,  korban perkosaan sering mengalami dampak psikologis dan trauma yang mengakibatkan mereka sulit menungkapkan apa yang terjadi pada diri mereka. Selain itu terdapat pasal yang masih dianggap bermasalah yaitu terduga pelaku perkosaan bisa dibebaskan dari jerat hukum hanya dengan melakukan sumpah sebanyak lima kali, seperti yang tertera di Pasal 55 Qanun Aceh No. 6 Tahun 2014 Tentang Hukum Jinayat.

Abstract

This research aims to examine how Law No. 13 of 2003 year applies gender equality in the workplace. The main focus of this research is how the law is applied in terms of gender equality in various industries. The research method used is the Normative research method. Data was collected through articles, scientific journals, theses, Law Number 13 on labor, and Laws relating to Employment. Research shows that although awareness and implementation of gender equality principles have increased, there are still problems to effectively implement them in the workplace. As the government, companies, and society must continue to support gender equality in the workplace.
