Abstract

This paper attempts to explore to what extent the current regime has changed the business and investment climate in Indonesia. Tsunami and earthquake in various regions overshadowed and sank the hope of fundamental changes by what is called as one hundred day of SBY-JK. Our findings illuminate that the SBY-JK regime has not addressed some critical problems encountered by industries and companies thoroughly. Therefore, we argue some suggested corrective actions based the surveys are badly needed for the new cabinet and local governments in Indonesia. The major reforms may include: (1) changing source of economic growth, from consumption driven to investment/ export-led growth; (2) some corrective actions to eliminate, at least reduce, the barriers along roads, seaports, and customs to increase export and eliminate corruption; (3) a well designed and comprehensive medium term planning to highlight the pathways that both central and local government will pursue.

Abstract

Susilo Bambang Yudoyono constitutes the first President of Indonesia who has been elected directly by Indonesian people. The election of president directly declares that although democracy in Indonesia still limited, there is significant changing in Indonesian political life in particular if this situation compares to before beginning reformation in Indonesia. This article tries to explain the relation management between President and Legislators, this part is so important because for the first time a president becomes the leader of state without strong party supporting. Secondly, the writer describes the crucial problem of the state regarding law enforcement because it is central part of government public relations. The third states welfare of people, the successful orthe failure of welfare politic denotes a heavy task for president in new democracy nations.

Abstract

During New Order period, government was the most powerful institution with 'unlimited' authorities and having less control from other state institutions. Consequently, it tended to promulgate many policies overwhelming its power. Only after the 2004 Election, the new regime has declared its pledge to reform the bureaucracy. Bureaucratic reform alone Is Inadequate, however. It has to be accompanied by law reform, particularly In the field of constitutional / public administration law (hukum administrasi negara). In that sense, this paper tries to elaborate two basic dimensions of constitutional law. I.e. government dimension and authority dimension. Those two dimensions consist certain facets that contribute to violation of law as practiced in the past. Hence, to prevent the appearance of similar case in the future, all facets of government (bureaucracy) and authority should be carefully scrutinized and simultaneously recovered.

Abstract

The law is never process and Its existence free from vacuum space but it becomes and Involves with other factors, for instances social, political, economical and cultural factors. Especially in the context of law enforcement regarding the corruption. Besides, the law enforcement also concerning to jurimetrics or the scientific investigation of legal problem. In term of this, the process of law enforcement needs skill and knowledge. According to the author that the corruption in Indonesia constitutes a systemic destructed in political system mechanism, so it is an extra ordinary crimes, it needs to be deconstructed law system and law enforcement system in Indonesia, and the law enforcement in the cases of political corruption in Indonesia needs an integrated institution of law and law enforcement.

Abstract

The problem of state responsibility toward gross violation of human rights that con ducted by past regime denotes and becomes a crucial and complex problem Including the gross violation of human rights that happening in Indonesia. In term of this, for instances the cases of Tanjung Priok, Komando Jihad, Aceh, Talang Sari Lampung and so on. Because of the fall of New Order Regime, pro democracy powers as like South Africa, East Europe, The Latin America and Asia countries force to settle tha cases of human rights as prerequisite of democracy consolidation. According to author of the article that the responsibility of gross violation of human rights by past regime denotes an agenda for each transitional government because there are rights to know the truth, rights of justice, and rights to human dignity. The task of the regime is preparing the mechanism how to responsible for old regime.

Abstract

The empowering of civil society denotes close and old horizon around the activists of Non-Governmental Organization. This discourse offers to create powered and independent people based on the root of supporting of human rights. The notion of civil society empowerment after the fall of New Order era always emerges. But, the problem is most of statements that stated never to explore the root of social problems. As result, the statements only become empty jargon. The impact of this, the concept of civil society empowerment has been never to be reconstructed and contextualized in accordant with the changing of social and political situation, especially at Megawati era. As a gradual process, civil society empowerment needs objective situation, for instance open-government and society. The following article focusing on civil society empowerment by protecting the freedom to accese information in 100 day agenda of SBYandJK.

Abstract

When Soeharto's rule begin, in public administration sphere, Indonesia have been emphasizing too much in accommodate the interest of power elite rather than a public interest, it made a public administrator acted like an elite interest want. This image caused a lot of perspectives that public administration in Indonesia do not exist properly. Cause they acted and worked as an "Abdi Negara" rather than "Abdi Masyarakat”. The ongoing of political constelation in1998 was giving a way to introduce a new paradigm of administration-mainstream from the state-oriented-administration to the public-oriented-administration. For that reason, public participation in public administration reform is a realistic idea to be implemented.

Abstract

The religious education paradigm declares that tends to ritual formal textualist. The basic assumption of the paradigm states that holy scripture can overcome most of problem that human facing wherever and whenever. Besides, it is so difficult to change society and the process of education itself. To solve problems above mentioned, the religious education needs a new and dynamic perspective, till it can change in accordance with expectation. According to the writer of this article, it is clear that paradigm of religious education that can overcome most of problem of education nowadays is substantivistic, inclusivistic, and that of pluralistic.
