Abstract

Korupsi merupakan kejahatan luar biasa karena berdampak negatif pada semua aspek kehidupan. Kejahatan ini berpotensi membawa kesengsaraan, pemiskinan dan penderitaan bagi banyak orang. Korupsi terjadi karena banyak faktor seperti gaya hedonisme, kepemimpinan yang lemah, kurangnya pendidikan agama dan moral, dan lainnya. Oleh karena itu bagamana islam memandang tindak pidana korupsi serta bagaimana cara pemberantasannya. Tujuannya untuk mengetahui pandangan islam dalam mengatasi masalah tersebut. Dengan metode yang digunakan dalam penelitian ini yaitu metode library research atau kepustakaan dengan mengupulkan berbagai sumber dan membandingkannya dengan sumber lain. Kata korupsi secara harfiah adalah kebusukan, keburukan, ketidakjujuran, dapat disuap, tidak bermoral, penyimpangan dari kesucian. perspektif islam korupsi memiliki pemahaman yakni riswah, sariqah, dan pengkhianat. Banyak sekali factor penyebab korupsi, salah satunya adalah perspektif kekayaan, dan gaya hidup yang matrealistis. Oleh karena itu sanksi bagi pelaku korupsi perspektif islam salah satunya dengan hudud dan takzir. Maka diperlukan juga strategi dalam pemberantasannya salah satunya dengan menerapkan hukum pidana. Korupsi juga merupakan kejahata yang sangat buruk dan dapat menimbulkan kerugian bagi semua umat, terutama bagi kalangan bawah. Oleh karena itu dalam islam ada sanksi berupa hudud dan takzir bagi para pelaku korupsi, selain itu upaya yang dapat kita lakukan dalam memberantasnya melalui peradilan pidana difokuskan pada sifat represif.

Abstract

Pendidikan yang merupakan tiang untuk membentuk karakter bagi generasi muda. Salah satu pendidikan yang dinilai sangat penting bagi mahasiswa/generasi muda adalah pendidikan anti korupsi. Hampir setiap perguruan tinggi sudah memberikan pendidikan anti korupsi sebagai mata kuliah wajib bagi setiap mahasiswanya. Untuk upaya pencegahan anti korupsi ini yaitu dengan membangun budaya anti korupsi di masyarakat merupakan faktor penting dalam upaya pemberantasan korupsi. Dan mahasiswa sebagai salah satu elemen masyarakat yang merupakan agen perubahan dan penggerak untuk anti korupsi di masyarakat. Untuk dapat berperan aktif mahasiswa perlu dibekali dengan pengetahuan yang cukup tentang seluk beluk korupsi dan pemberantasannya. Pendidikan anti korupsi ditujukan agar mahasiswa dapat mengetahui dengan jelas permasalahan korupsi yang sedang terjadi dan usaha untuk mencegahnya.

Abstract

Dikeluarkannya putusan tata usaha negara, Peradilan Tata Usaha Negara mempunyai tanggung jawab dan wewenang untuk memeriksa, memutus, dan menyelesaikan perkara tingkat pertama antara orang perseorangan atau badan hukum perdata dengan badan atau pejabat tata usaha negara, baik di pusat maupun di pusat daerah, termasuk perselisihan ketenagakerjaan berdasarkan peraturan perundang-undangan terkait. Salah satu upaya yang harus dilakukan dalam perbaikan pelayanan publik adalah Sistem Pelayanan Terpadu Satu Pintu (PTSP). Dalam hal perwujudan pemerintahan yang bersih dan bebas KKN, masih banyak hal yang harus diselesaikan dalam kaitan pemberantasan korupsi. Hal ini antara lain ditunjukkan dari data Transparency International pada tahun 2009, Indeks Persepsi Korupsi (IPK) Indonesia masih rendah (2,8 dari 10). Kondisi ini mencerminkan masih adanya permasalahan dalam penyelenggaraan pemerintahan, seperti kualitas birokrasi, pelayanan publik, dan kompetensi aparat pemerintah. Birokrasi pemerintah harus dikelola berdasarkan prinsip-prinsip tata pemerintahan yang baik dan profesional. Birokrasi harus sepenuhnya mengabdi pada kepentingan rakyat dan bekerja untuk memberikan pelayanan prima, transparan, akuntabel, dan bebas dari praktek korupsi, kolusi dan nepotisme (KKN).

Abstract

The State Administrative Court is established to anticipate the abuse of authority by the ruler and face conflicts of interest, disputes or disputes that may occur at any time between the community and state administrative agencies or officials. Therefore, this research is conducted to describe the authority, subject and object of dispute in the State Administrative Court using a library research or literature approach. Meanwhile, the approach method used is the normative juridical approach method or doctrinal legal research, which is a legal research whose data source comes from secondary data in the form of laws and regulations, books, and journals related to the focus of the problem. After discussing the existing problems, it can be concluded that  the competence of the State Administrative  Court includes absolute competence, namely the authority to adjudicate based on the object, material or subject matter of the dispute  and the relative competence, namely the authority to adjudicate based on the region or jurisdiction. The object   of disputes in the TUN Court is the TUN Decision except for TUN disputes within the TNI and other TUN disputes which according to the TUN Judicial Law are not the authority of the TUN Court where the exceptions are divided into 3 kinds of restrictions. i.e. direct, indirect and direct restrictions are temporary. Meanwhile, the ubjek of disputes in the TUN Court is a person or civil legal entity and a body or official  of TUN.

Abstract

This study aims to describe one of the powers possessed by the Constitutional Court, namely resolving disputes over authority between state institutions. The type of research  used is a type  of library  research (literature), with  a normative juridical approach method  or doctrinal legal research, namely legal research whose data sources come from secondary data in the form of laws and regulations, books, and journals related to the focus of the problem.  Law No. 24 of 2003 on the Constitutional Court does not explain the details of the authority of  the Constitutional Court . Therefore, the Court  of Justice is empowered to form a regulation to support the smooth performance of its duties and authorities relating to the authority to decide disputes between state institutions. Based on this, PMK No.  08/PMK/2006 on Guidelines for Beracara in Disputes over the Constitutional Authority of State Institutions. When viewed in the formulation of  the 1945 Constitution, the institutions that can be both petitioners and respondents in constitutional disputes  of state institutions are state institutions whose authority is granted by the 1945 Constitution. The formulation of state institutions whose authority is granted by the 1945 Constitution gives rise to multiple interpretations, thus causing differences in the determination of which state institutions can be parties to the dispute. Regardless, however, determining which state institutions can be parties to constitutional disputes between state institutions remains with the Constitutional Court.

Abstract

Indonesia is a constitutional state, which means that almost every action taken in it is regulated in accordance with applicable legal provisions. The State Administrative Court is one form of implementing the rule of law. This state administrative court is regulated in Law no. 5 of 1986 concerning the State Administrative Court which is the realization of the provisions of Article 24 of the 1945 Constitution and Article of Law No. 14 of 1970 which was amended by Law no. 35 of 1999 concerning Main Provisions of Judicial Power, whose authority is to inspect to protect and develop and maintain state administration that is right according to law or according to law or right effectively or functions efficiently. Today if we analyze the existing laws in Indonesia socially, there are still many people who are less concerned about the concepts and objectives of the laws issued by the government. Therefore, from this journal, the author intends to provide legal education related to the position of state administrative justice in Indonesia

Abstract

The State Administrative Court is a judicial body that has absolute authority to examine and resolve disputes in the field of state administration. The development of the jurisprudence of the State Administrative Court (Peratun) is indispensable for the development of state administrative law. The issues studied are the role of jurisprudence in the field of state administrative law and the role of the State Administrative Court in providing access to justice. The method used in this study is library research, namely research whose object of study uses library data in the form of books as a data source. The Supreme Court has made efforts to strengthen jurisprudence so that it can support the development of administrative law. The judge's decision is needed as a source of law. This is because it stems from dynamic legal dispute resolution. Then, jurisprudence can bring social change to society. The judge's decision-making process is also faster than the law-making process. The absolute competence of the wider State Administrative Court can provide easy access to justice where the public can submit complaints about factual actions of the Government in the field of public law. Jurisprudence as a source of law is needed to develop state administrative law by taking into account the development of society, social conditions, legal and political conditions. Jurisprudence produces general principles of good governance so that they can be used to administer government wisely

Abstract

In a principle of state administrative justice in Indonesia, there are two differences where this justice system lives in a rule of law state, the first is unity of jurisdiction, which means a unit of jurisdiction which will certainly be embraced by a rule of law country, where only one unit recognizes the entire set of courts, namely there is in ordinary courts such as (general courts) and quite unfamiliar with PTUN. Furthermore, the second in the duality of jurisdiction adopted by countries where laws are adhered to is the general court and Administrative Court. Now, where the general court is at the supreme court, while PTUN blends in with the state. Now, in these two cases, it is not only the organizational structure of the court that differs, but the legal subjects or procedural law are actually different. Now, in Indonesia, this is quite unique because there is a research result that we know very well, which is closer to a unified system of jurisdiction, but when viewed from the principles of justice or procedures for resolving disputes, it is closer to the system of dual jurisdiction, so that in writing want to conclude that the justice system in Indonesia follows a mixed system.

Abstract

Constitution through decision number 005/PUU-lV/2006 dated 23 August 2006 which raises problems in a statement that is in the articles of supervision of the judicial commission. Where the supervision of judges regarding the constitution is contrary to the 1945 Constitution of the Republic of Indonesia and does not have a binding legal power. In an oversight of constitutional judges associated with a principle of independence in which the judicial power to know the supervisory system of constitutional judges in preventing the power of judges to realize an ideal and clear oversight. The article I made aims to find out the knowledge of constitutional court oversight to prevent abuse of judicial power and constitutional court judges must also know how the existence of the constitutional court judge supervisory body in supervising constitutional court judges. This study uses the library research method or the results of research that has been carried out, as for the data used here, among others, which have references or primary legal language from legislation and decisions, secondary legal materials from books, journals, thesis, and tertiary legal material from a dictionary, encyclopedia. Where based on the analysis of the data carried out, it was obtained from a conclusion regarding the regulation of supervision of constitutional judges regarding article 21 paragraph 1 letter a where the sound is PMK constitutional court regulations number 2 of 2014 concerning the honorary assembly of the constitutional court. Where, according to the author, the internal supervision of constitutional judges has not been effective or is said to be due to several factors which have resulted in weak internal supervision, the first being the spirit of defending the conference and the absence of a genuine will from the judiciary leadership to follow up on the results of the internal supervision of judges which thus opens up opportunities for judges who are proven to have violated the code of ethics against the constitutional court. So in order for the supervision of constitutional judges to be good and ideal, the supervision must be carried out by an external supervisory institution. Yes, the judicial commission can provide more effective oversight and maintain the dignity and dignity of constitutional judges within the scope of the constitutional court.

Abstract

The Constitutional Court is one of the institutions of judicial power that has the authority to adjudicate cases and also resolve cases from the first level to the last level. the decision has been issued by the constitutional court, the decision has no further legal continuation, that's why the law gives the constitutional court four powers to become one of the institutions that can enforce law and justice in Indonesia and the four powers are: 1) examine UUD 1945 2) decide on an authority dispute between state institutions whose authority has been granted by the state based on the 1945 Constitution 3) decide on the dissolution of political parties 4) decide on disputes over election results, a decision if it has been issued by the constitutional court, the decision is final and also binding so that in this case it causes a positive impact and also a negative impact in the decision, this study has the aim of knowing the meaning and significance of the final decision and what the impact of the decision of the constitutional court which is final and binding, this type of research is juridical normative legal research, namely research with data collection techniques from books, journals or articles and also theses and is equipped with primers from the results of the 1945 Constitution analysis.
