Abstract

Tujuan penelitian ini adalah untuk mengetahui perkembangan doktrin penyalahgunaan keadaan sebagai dasar pembatalan perjanjian dalam sistem hukum civil law maupun common law, serta untuk mengetahui prospek pengaturannya dalam sistem hukum perjanjian di Indonesia. Penelitian ini menggunakan pendekatan yuridis normatif, yakni suatu pendekatan dengan cara menelaah permasalahan dengan berpedomanan pada data sekunder, dengan spesifikasi penelitian ini adalah deskriptif analitis-komparatif. Hasil penelitian menunjukkan bahwa doktrin penyalahgunaan keadaan sebagai dasar pembatalan perjanjian dalam sistem hukum civil law (Belanda) diatur dalam suatu undang-undang, sedangkan dalam sistem hukum common law lebih banyak berkembang dalam putusan-putusan pengadilan. Perbedaan ini dipengaruhi oleh karakter masing-masing sistem hukum yang dipakai. Di masa mendatang, doktrin penyalahgunaan keadaan sebagai dasar pembatalan perjanjian perlu diatur dalam hukum perjanjian Indonesia. Hal ini didasarkan pada pertimbangan bahwa Indonesia yang menganut sistem hukum civil law yang sumber hukum utamanya adalah undang-undang, serta karena pada dasarnya sistem hukum civil law tidak mengenal asas stare decisis et quita non movera walaupun dalam praktek pengadilan di Indonesia doktrin penyalahgunaan keadaan ini telah diakui dalam beberapa putusannya.

Abstract

The Indonesian Constitutional Court has played an important role and function to protect and fulfill human rights in the Indonesian legal system including economic, social and cultural rights through judicial review powers. This confirms that social and economic rights are rights that can be legally justified and are part of the constitutional mandate. This means that judicial review decisions require the State to behave in accordance with the legal thresholds decided by the Court. Undoubtedly, compliance with the decision will reveal facts that are indisputable for the fulfillment of state behavior. However, it seems that there are still many considerations, emphasis, and reasons to reduce or ignore the threshold for the application of the Court's decision. The complexity of specific actors, institutions, authorities, levels of implementation, and orientation of policies, programs, measures, and funds reduces the threshold.

Abstract

In Indonesia, PTUN is part of the judiciary which is organizationally under the Supreme Court and does not stand alone as in countries which base their legal system on codified civil law in general, because it is under the Supreme Court, hence judicial technical development. The State Administrative Court is an institution that has an important role in protecting the rights of people who are harmed by the enactment of a State Administrative Decree (KTUN) made by government officials. In addition, the PTUN's authority in assessing the actions of government officials can be used as a control or supervision of government officials. Law No. 5 of 1986 concerning State Administrative Radiation in Article 47 it is emphasized that the State Administrative Court has the duty and authority to examine, decide and resolve State Administrative disputes (PTUN).

Abstract

Psikolog merupakan salah satu profesi di bidang kesehatan yang lekat dengan hubungan interpersonal dengan klien atau pasien. Salah satu kewenangan psikolog adalah memberikan diagnosis terkait kesehatan mental individu dengan memerhatikan kebutuhan dan hak klien. Unsur penting dari hak klien adalah terkait dengan rekam psikologis yang memuat kondisi psikologis klien pada saat dan sesudah melakukan konseling. Kerahasiaan rekam psikologis klien diatur dalam Kode Etik Psikologi Bab 5 Pasal 23-27 yang berisikan panduan psikolog dalam bertanggungjawab atas rekam psikologi yang ia buat. Pada perkara Nomor 463/Pdt.G/2013/PN.JKT.SEL ditemukan adanya pelanggaran hak berupa pembukaan rekam psikologis klien anak ke publik yang menyebabkan adanya pelanggaran hukum yang terjadi. Dampak dari perkara ini menyebabkan para tergugat dinyatakan bersalah dan dikenakan hukuman administrasi berupa penggantian ganti kerugian materil maupun imateril. Pada penelitian ini, peneliti menggunakan pendekatan yuridis normatif untuk mengkaji dasar hukum yang menyebabkan hakim menjatuhkan hukuman tersebut. Disimpulkan bahwa terdapat asas hukum yang hakim gunakan sebagai dasar putusannya, diharapkan dengan adanya hasil tinjauan ini dapat memberikan pengetahuan ilmiah kepada pembaca terkait sanksi perdata bagi profesi psikologi yang terbukti melanggar kode etik profesi nya.

Abstract

Discussions regarding the halal industry have been very prominent in recent years. Therefore, many issues related to the halal industry are written about and used as research objects. Halal products must have certain specifications so they can play in the halal market. These specifications require certain qualifications that are closely related to halal standards. This research aims to explain the urgency of implementing halal certification in Indonesia in international trade (case study of chicken meat imports from Brazil). The first research result is that as a global food organization, the Food and Agriculture Organization (FAO) has the idea of halal products. Nevertheless, FAO's main focus is currently limited to food products. FAO has not fully protected regulations relating to the guarantee of halal products for countries around the world. FAO provides ratification to each country regarding halal product regulatory policies. The only FAO requirement is that the exporting country must receive halal certification to demonstrate that the product is halal, although this can still be requested by the importing country. The second is that Indonesia has stipulated that although not all products in circulation must have halal certification, some must. Article 135 PP No. 39 of 2021 and Article 125 PP No. 39 of 2021.

Abstract

The Foundation is a legal entity to which the rights and obligations provided for by the Legislation are attached. Law Number 28 of 2004 concerning Foundations regulates the establishment of the Foundation's legal entity until the dissolution of the Foundation. One of the reasons for the dissolution of the Foundation was bankruptcy, and after the Foundation was declared bankrupt by the court, the Foundation's assets had to be liquidated by liquidators or curators. In this paper, a problem formulation is put forward, namely how to reserve the assets of a Foundation that was dissolved due to bankruptcy? The result of this research is that if a Foundation disbands, its assets will be liquidated and the remaining assets resulting from liquidation will be handed over to other Foundations that have similar activities to the disbanded Foundation. In the event that the remaining proceeds of liquidation are not handed over to another Foundation which has similar activities, the remaining assets may be handed over to another legal entity which has similarities in activities to the dissolved Foundation, and if this is regulated in the Law concerning that legal entity. And if the two options above are not exercised, the wealth will be handed over to the State and its use will be carried out in accordance with the activities of the disbanded Foundation.

Abstract

Bankrupt BUMN is not as simple as bankruptcy of a person or other legal entity, because this BUMN has state assets whose management must involve state intervention. Government intervention is proven by the presence of the Minister of Finance as CFO and majority owner of BUMN and the Minister of BUMN as director and supervisor of BUMN activities, apart from that there are supporting regulations, namely the KN Law, PN Law and Constitutional Court Decision No. 62/PUU-XI/2013 which notes that wealth separated from BUMN remains state wealth. If a state company is bankrupted by its own debtor, the finance minister has the largest say in the state-owned bankruptcy application than the GMS, in Peru the finance minister has the highest power and is the only party. who can file bankruptcy. The legal consequence of BUMN bankruptcy is that a public confiscation is carried out, but first the BUMN must go through a process of paying state assets in accordance with Minister of Finance Regulation No. 50/PMK.06/2014 because BUMN goods are still considered state-owned goods.

Abstract

External supervision of judges' performance is done by the Judicial Commission (JC), namely by providing input regarding the mechanism for providing sanctions for violations of the code of ethics committed by judges. The task of the Judicial Commission regarding recommendations for sanctions for violations committed by judges involves collaborating with the Supreme Court because the judicial commission does not have the right to impose sanctions directly on judges. Therefore, efforts are urgently needed to improve the integrity of judges as law enforcers from the Judicial Commission institution that has the authority to act as an external monitor of the behavior of judges. The Judicial Commission also guarantees that they can maintain and increase the independence and integrity of judges. Regarding the supervision of the Judicial Commission as a strengthening of the Judiciary institution in maintaining the independence and integrity of judges, this research is conducted using normative methods. The data collection techniques are done by searching documents and scientific books to determine the theoretical basis in the form of positive legal material appropriate to the research object.

Abstract

This research aims to answer problems related to the regulation of the concept of punishment in environmental aspects in the Indonesian criminal justice system. Secondly, this research aims to answer the juridical implementation of the concept of Straight Liability and Liability Based On Fault in environmentally sound economic development in Indonesia. This research uses normative legal research that focuses on primary, secondary, and tertiary legal materials. This research obtained several important points including legal arrangements related to the concept of environmental crime regulated in Law Number 32 of 2009 concerning Protection and Management of the Indonesian Environment. Second, the implementation of the concept of Straight Liability and Liability Based On Fault in environmentally sound economic development in Indonesia so far has not been maximised. This is due to the lack of mentality and consistency of law enforcement officials to enforce environmental law in a complex manner. So that this research proposes to strengthen the essence and existence of law enforcement officials in enforcing environmental law in order to preserve Indonesia's environmental ecosystem.

Abstract

European Union has requested a panel regarding Indonesia's restriction of exports and downstreaming of raw materials. According to the European Union, Indonesia's export and downstream policies violate World Trade Organization (WTO) provisions, namely Article XI:1 of the General Agreement on Tariffs and Trade (GATT) 1994. In the panel report, the World Trade Organization Dispute Settlement Body (WTO DSB) decided that Indonesia had been proven to have violated these WTO provisions. This thesis examines whether the WTO's ruling on Indonesia's restrictions on raw materials is justified and explores Indonesia's arguments in Appellate Body with the European Union regarding restrictions on nickel ore exports and downstreaming. The research methodology involves normative legal research, analyzing primary legal sources like legislation and secondary sources such as textbooks and case studies. The study delves into Indonesia's challenges in defending its policies at the WTO's Appellate Body. The primary research object is Indonesia's Measures relating to Raw Materials, particularly nickel ore, and relevant agreements like GATT 1994. Legal materials include Indonesian regulations on exports and GATT 1994, while secondary sources encompass statutory regulations, scientific journals, and related literature. The data collection method relies on library research. Using a qualitative approach, the thesis seeks a deep understanding of the core issues. Analytical methods include statutory interpretation, case studies, and grounded theory. The research finds Indonesia's measures non-compliant with GATT 1994 but suggests leveraging Article XXI, the Security Exception, as a strategic defense in the Appellate Body.
