Abstract

This study aims to examine the overlapping authority between the Ministry of Home Affairs and the Ministry of Village and Development of Disadvantaged Regions, Transmigration and Ministerial Regulations issued can disrupt the constitutional system of the Republic of Indonesia, especially related to the system and hierarchy of applicable laws and regulations. At the local level, such conditions create difficulties for village governments as technical implementers of policies issued by several ministries at once. The conflict between Ministerial Regulation norms and PDTT Amendments makes village governments as stakeholders feel confused about which laws and regulations will be used as guidelines. The type of research used is normative juridical research with a conceptual approach. The results obtained are based on the perspective of legal politics and legal harmonization analyses of two things. First, overlapping authorities and ministerial regulations occur because the Ministry of Home Affairs and the Ministry of Village Affairs have different perceptions about who has more authority to manage village affairs. Second, harmonization of the law of the Ministerial regulation that regulates villages can be realized through the political law of amending Law Number 6 of 2014 concerning Villages and the issuance of a new Presidential Regulation that specifies that there is only one ministry that handles villages. In this context, the author considers that village affairs should be more appropriately under the authority of the Ministry of Villages and Development of Disadvantaged Regions, Transmigration.

Abstract

This article explores the dynamics of Indonesian diplomacy in the Israeli-Palestinian conflict. Despite ongoing tensions and armed confrontations between Palestinian fighters and the Israeli military, Indonesia has consistently advocated for Palestinian independence through a two-state solution. The historical ties between Indonesia and Palestine, coupled with the academic connections between Palestinian scholars and Indonesian students studying in Egypt, have strengthened the diplomatic relationship between the two nations. Indonesia's active role in supporting Palestinian recognition of Indonesian independence, alongside Egypt, remains relevant today. Using conflict resolution theory as a framework, this article delves into Indonesia's diplomatic efforts to address the Israeli-Palestinian conflict. Notably, Indonesia has actively participated as a non-permanent member of the UN Security Council, opposing policies such as US President Donald Trump's decision to recognize Jerusalem as the capital of Israel and relocate the embassy there. The findings illustrate Indonesia's multifaceted role in conflict resolution, encompassing positions as a co-sponsor, facilitator, mediator, participant, initiator, actor, motivator, and justifier in its endeavors to help resolve the Israeli-Palestinian conflict. By presenting these insights, the article aims to contribute to the understanding of Indonesia's unique diplomatic contributions to the ongoing conflict while avoiding plagiarism.

Abstract

Berdasarkan UU Nomor 23 Tahun 2014 tentang Pemerintahan Daerah, pemerintahan di daerah harus dapat membuat peraturan daerah yang sesuai dengan kebutuhan dan kondisi mereka. Dengan demikian, untuk meningkatkan kualitas produk hukum daerah, program pembentukan peraturan perundang-undangan daerah harus disusun melalui mekanisme Analisis Kebutuhan Perda (AKP). Tujuan artikel ini adalah untuk mengetahui urgensi Pembentukan Tim Analisis Kebutuhan Perda dalam tahapan Penyusunan Program Pembentukan Perda di DPRD Kota Parepare. Dengan menggunakan metode pendekatan normatif-empiris, hasil penelitian menunjukkan bahwa dalam Pembentukan Tim Analisis Kebutuhan Perda (AKP) yang disahkan dengan Keputusan Kepala Daerah menjadi suatu urgensi dalam penyusunan Program Pembentukan Peraturan Daerah. DPRD Kota Parepare telah cukup efektif melaksanakan metode Analisis Kebutuhan Perda (AKP) tersebut dengan membentuk tim khusus (Tim AKP), upaya penyusunan Program Pembentukan Perda melalui metode Analisis Kebutuhan Perda (AKP) di DPRD Kota Parepare adalah suatu pedoman agar melahirkan peraturan daerah yang solutif sesuai dengan kebutuhan masyarakat.

Abstract

This study aims to analyze the implementation of governance for refugees who come to Indonesia, in this case, Rohingya refugees. The arrival of Rohingya refugees in Indonesia has introduced complexity to the regional response, posing challenges for the Indonesian government in upholding humanitarian standards, ensuring proper living conditions, and managing public sentiments. This research employs a juridical-normative approach to analyze the legal norms governing the Indonesian government's policies on Rohingya refugees, focusing on instruments like Presidential Regulation 125/2016. By examining legal regulations and sources, this study identifies and evaluates the legal implications of implemented policies, assessing their alignment with prevailing legal principles. The international legal framework, including the 1951 UN Refugee Convention and the 1967 Protocol, alongside Indonesia's comprehensive immigration legal framework (Law Number 6 of 2011), is crucial. Despite these legal foundations, challenges persist in handling Rohingya refugees in Aceh, highlighting a disconnect between the legal framework and on-the-ground realities, notably in the face of local community rejection.

Abstract

This study aims to better know and understand how the procedure of owning non-organic firearms for civilians to create legal policies that apply in Indonesia. Some things the author has said about the rules applied and how they relate to Islamic law related to the theory of Sadd Al-Dzari'ah which is still new enough to be associated with the title the author conveys. The approach taken in this study is normative juridical using literature or document studies, which are managed through secondary data sources in the form of primary legal materials, secondary legal materials, and tertiary legal materials whose type of research is normative law. The results of the study concluded that the legal aspects of firearm ownership based on the investigation of firearms, munitions, and explosives as stated in Police Regulation Number 1 of 2022 regarding the classification of weapons and how the permit procedures must be met for prospective owners of non-organic firearms for special police, PPPNS, Civil Service Police Units, Security Forces or interests for self-defense. Referring to the theory of Sadd Al-Dzariah, Dzari'ah is one of the postulates in establishing the law despite disputed use. There are benefits from the ownership and use of firearms but if the use does not follow the requirements and can cause stability for the owner, then the ideal form of ownership of firearms, based on the theory of the purpose of law provides certainty, justice and benefit for human problems explains the ideal legal framework and law enforcement policy.

Abstract

The decision-making process in public administration requires a balance between discretion and legality. Discretion provides officials the freedom to make decisions based on their personal judgment. However, discretion also has the potential to be misused. This research was conducted to identify and analyze the balance between the freedom to act and legal compliance in the decision-making process of the Indonesian government. This study employs a descriptive qualitative approach. The results of the study indicate that discretion has the potential to increase flexibility and effectiveness in decision-making, but it also has the potential for misuse. Therefore, a proper balance between the use of discretion and the principle of legality is necessary. Recommendations include enhancing the awareness and ability of administrative officials to use discretion appropriately and transparently, and improving the quality of legislation by providing clearer and more detailed guidelines. As a result, the government can function better and achieve better national objectives.
