Asas wa Tandhim: Jurnal Hukum, Pendidikan, dan Sosial Keagamaan (AwTJHPSA) is a peer-reviewed, open access scholarly journal published by Fakultas Agama Islam Universitas Cokroaminoto Yogyakarta. Focus AwTJHPSA is publishing high-quality manuscripts in forms of original research articles, and discussions to answer important and interesting questions, develop or test theory, replicate prior studies, explore interesting phenomena, review and synthesize existing research and provide new perspectives aimed at stimulating future theory development and empirical research on all aspects of social science and humanity, especially that relate to human religion, for promoting the integration of social science and humanity. <![CDATA[Business dispute resolution is crucial for maintaining continuity and stability amid the complex and evolving business environment. This study examines dispute resolution mechanisms, focusing on counseling as a facilitative process that helps parties manage conflicts constructively and cooperatively. Using a qualitative approach with literature review and case analysis, the study explores counseling’s role in Indonesian business law. Findings show counseling accelerates dispute resolution with lower costs and time, preserves business relationships, and supports sustainability. Information technology, especially Online Dispute Resolution (ODR), enhances access to online counseling. The study recommends improving regulations, professional counselor training, and business community outreach to optimize counseling as an innovative solution for modern business dispute resolution.]]>

<![CDATA[This study is driven by the increasing number of traffic violations in Indonesia highlighting the need for more effective and transparent law enforcement mechanisms. This research aims to examine the implementation of Integrated Node Capture Attitude Record (INCAR) by the Trenggalek Police Department, identify the challenges encountered, and evaluate the strategies adopted in response. A descriptive-analytical method with an empirical juridical approach was employed, utilizing primary data from interviews and secondary data from books and academic journal articles. The findings indicate that INCAR operates under two patrol models: targeted patrols in high-violation areas and random patrols. Offenders are provided with two options: pay fines via a BRIVA payment code or appear in court. Major challenges include a limited number of operational units, low public legal awareness, and the absence of certain expected features. In response, the police have adopted a hybrid enforcement strategy by combining manual ticketing with INCAR, alongside public education initiatives.]]>

<![CDATA[Drugs are a serious threat to diversity and social stability, so structured da'wah implementation and evaluation are needed to overcome it. This study aims to determine how the implementation and evaluation of the da'wah of the Regional Leadership of Al Jam'iyatul Al Washliyah in overcoming drug abuse in Datuk Bandar District, Tanjung Balai City. The approach used is qualitative with field methods through observation, interviews, and document analysis. The results showed that the implementation of da'wah was carried out through various activities such as futsal tournaments, canoe rowing competitions, da'wah syiar, silat training, and cooperation with BNN for urine tests. Evaluation is carried out by assessing participation, behavior change, and program effectiveness. This activity is proven to contribute in providing education and increasing public awareness of the dangers of drugs.]]>

<![CDATA[This study analyzes the branding strategy of the UCY Islamic Religious Education Study Program through creative content on social media. With a descriptive qualitative approach through observation, interviews, and documentation, the results show that the use of attractive visuals, inspiring narratives, and consistent posting on Instagram and TikTok has succeeded in increasing interaction, emotional closeness, and institutional identity. The conclusion of the study proves the effectiveness of creative content in expanding the reach, audience engagement, and digital existence of UCY.]]>

<![CDATA[Social media has significantly influenced the evolution of modern crimes, including cyber sexual harassment against women. This study aims to analyze the crime of cyber sexual harassment from the perspective of Indonesian positive criminal law and Islamic criminal law. The research employs a normative juridical method with a statutory and conceptual approach, including the analysis of maqāṣid al-syarī‘ah principles in Islam. The findings indicate that under Indonesian positive law, such acts can be prosecuted through the Criminal Code (KUHP), the Electronic Information and Transactions Law (ITE Law), and Law No. 12 of 2022 concerning Sexual Violence Crimes (TPKS Law). In Islamic criminal law, this behavior is categorized as fahisyah and falls under jarimah subject to ta'zir sanctions. Both legal frameworks emphasize the protection of women's dignity and support both punitive and preventive approaches. The integration of both perspectives offers a comprehensive legal response to combat sexual violence against women in digital spaces.]]>

<![CDATA[This qualitative study aims to determine the management of da'wah applied by the Contact Board of Majelis Ta'lim (BKMT) in an effort to prevent promiscuity among teenagers. data collecting through interviews, observation, and documentation. The results showed that BKMT's da'wah management includes four stages: planning, organizing, implementing, and supervising. Planning is arranged according to community needs with relevant materials and methods. Organizing involves various elements of society to strengthen the synergy of da'wah. Implementation is done through routine studies, seminars, and personal approaches to vulnerable youth. Supervision is carried out through program monitoring and evaluation. Support from religious leaders, communities and social media are supporting factors, while obstacles include lack of youth participation, environmental influences and limited resources. In terms of effectiveness, BKMT's proselytizing is still limited, with positive changes only occurring in a small proportion of religiously active adolescents.]]>

<![CDATA[The purpose of this descriptive qualitative research is to analyze the da'wah strategy implemented by the Indonesian Ulema Council (MUI) of Medan City in dealing with deviant sects that have the potential to disrupt the faith and harmony of the lives of Muslims. Through in-depth interviews with MUI administrators, religious figures, and analysis of documentation related to da'wah policies including field observations, the collected data were analyzed thematically. The results of the study indicate that the MUI of Medan City adopts a da'wah strategy that includes routine monitoring, intensive dialogue with ulama and community leaders, and cooperation with educational institutions and the media to disseminate clarification of deviant teachings. A persuasive and educational approach is the main key to straightening out public understanding peacefully. Despite facing challenges such as limited resources and the massive spread of deviant teachings on social media. With an adaptive and collaborative strategy, the MUI is advised to be optimal in maintaining the integrity of the faith and unity of Muslims in Medan City.]]>

<![CDATA[Blackmarket trade is an illegal activity that bypasses official customs systems and harms the state economically, legally, and socially. This study aims to examine blackmarket crimes based on Law No. 17 of 2006 concerning Customs and from the perspective of Islamic criminal law. The method used is library research with a normative juridical approach, analyzing relevant regulations, concepts, and legal principles. Findings indicate that blackmarket actors face penalties including imprisonment and fines under Articles 102-104 of the Customs Law. From the Islamic criminal law perspective, blackmarket trade is categorized as jarimah ta’zir because it harms society and contradicts principles of justice and economic honesty. Thus, this practice violates both positive law and Islamic law, requiring firm law enforcement and moral education to prevent it.]]>

<![CDATA[Presidential Regulation is one form of legislation that has legal force in Indonesia. However, there is still ambiguity regarding the position of the Presidential Regulation in the hierarchy of legislation as stated in Article 7 paragraph (1) of Law No. 12 of 2011 in conjunction with Law No. 13 of 2022 concerning the Formation of Legislation. This study aims to legally analyze the position of the Presidential Regulation in the hierarchical structure of Indonesian legislation. The method used in this study is the normative legal method. The results of the study indicate that the Presidential Regulation is below the Law and Government Regulation, but has a strategic function in implementing higher regulatory provisions. The conclusion of this study emphasizes the importance of rearranging the hierarchy of regulations to avoid normative conflicts and ensure legal certainty.]]>

<![CDATA[10-60% of married women in various parts of the world have experienced domestic violence, including Indonesia, which is a taboo for society and the government. Therefore, this study will explain the role of family law in dealing with KDRT. The research method used is Qualitative with a Library Study approach by collecting data from various sources, such as laws, journals, articles, and books. Data is analyzed by identifying existing patterns and trends, and presenting findings that are relevant to the topic discussed. The results of this study explain that the role of Islamic family law in preventing domestic violence can be in the form of clarity of the rights and obligations of husband and wife, the age limit for marriage and the existence of a marriage agreement to emphasize the rules that apply in a marriage.]]>
