Abstract

Abstract: This study discusses the application of the ta'widh fee on the Hasanah Card product owned by Bank Syariah Indonesia (BSI), which is imposed on customers who are late in paying bills. In practice, this ta'widh fee resembles late fees in conventional banks, which are based on the concept of time value of money. This concept in the Islamic view includes usury, which is strictly prohibited. This research uses a library research method with a focus on the perspective of the Syafi'iyah Mazhab and the National Sharia Council Fatwa No. 43/DSN-MUI/VIII/2004. The results showed that according to the Shafi'i Mazhab, the imposition of late fines in the form of nominal money is haram, because it is a form of taking other people's property illegally. During the time of the Prophet, sanctions for lateness were more social or moral, not financial. This finding shows the difference in approach between contemporary fatwas and classical views in the application of sanctions for late payment.

Abstract

Productive zakat is a form of zakat distribution that is aimed at increasing the independence of mustahik through sustainable business development. In the context of sharia economic law, productive zakat is considered capable of encouraging the achievement of social justice and economic empowerment of the community if managed in accordance with sharia principles and laws and regulations. This article aims to analyze the implementation of productive zakat in Indonesia from the perspective of sharia economic law and to evaluate the suitability of its implementation with applicable regulations. The study uses a normative juridical method with a conceptual approach and a comparison between the theory of zakat fiqh and the practice of zakat institutions. Data were collected through literature reviews, documentation studies, and analysis of DSN-MUI Fatwa No. 190/2023 and Law No. 23 of 2011 concerning Zakat Management. The results of the study show that the implementation of productive zakat still faces challenges, especially in the aspects of accountability, selection of targeted mustahik, and business sustainability after capital provision. From the perspective of sharia economic law, zakat management must uphold the principles of maslahat, justice, and amanah. Therefore, an integrated productive zakat governance model is needed between sharia principles, modern management, and a transparent reporting system. In conclusion, optimizing productive zakat requires synergy between zakat institutions, regulators, academics, and the community in order to realize the function of zakat as an instrument for the development of the people's economy.

Abstract

Sharia fintech as a financial technology innovation based on sharia principles is growing rapidly and becoming a financial inclusion solution that reaches the wider community, especially those who want sharia-compliant financial products. However, the development of sharia fintech requires adaptive regulations so that its implementation does not conflict with the principles of sharia economic law and is able to provide protection for consumers. This study aims to examine the regulations governing sharia fintech in Indonesia and how they are implemented in supporting sharia-compliant financial inclusion. The method used is a qualitative study with analysis of regulatory documents and interviews with sharia fintech industry players and regulators. The results of the study revealed that sharia fintech regulations are currently still in the development stage and require synchronization between financial authorities and sharia supervisory institutions. On the other hand, sharia fintech has been able to expand financial access for people who were previously unreached by conventional banking. However, there are challenges in ensuring that all transactions are in accordance with sharia principles and consumer data protection. This study recommends strengthening the regulatory framework that accommodates the dynamics of technology and sharia principles in a balanced manner and increasing education for the community and fintech business actors. Thus, sharia fintech can be an effective instrument in encouraging inclusive and sustainable economic development in accordance with Islamic values.

Abstract

The development of digital technology has given birth to various new investment instruments, including crypto assets. The emergence of sharia crypto as an alternative halal investment has raised debates from the aspect of sharia economic law, both in terms of fiqh and positive regulations in Indonesia. This article aims to examine the validity and legal protection of sharia crypto investments based on the principles of maqashid sharia and its synchronization with national regulations such as the Bappebti Regulation and the DSN-MUI Fatwa. The method used is juridical-normative with a conceptual and comparative legal approach. This study found that most crypto does not meet the criteria as mal mutaqawwam (valuable assets in sharia), mainly due to the high elements of gharar (uncertainty) and speculation. However, several crypto projects based on real assets and transparent smart contracts are starting to offer potential sharia investment models. On the other hand, Indonesian government regulations through Bappebti have begun to classify crypto as a tradable commodity, but have not touched on the aspect of protection of sharia principles. Therefore, it is important to have a legal umbrella that strictly regulates sharia crypto, both in terms of contracts, investor protection, and transaction mechanisms. With the maqashid sharia approach, protection of assets (hifz al-mal) and justice in muamalah become important bases for the legality of crypto investment that is in line with Islamic principles and national law.

Abstract

Sharia business ethics are moral and legal principles that must be upheld by business actors, especially in micro and small companies that contribute significantly to the national economy. This study aims to examine how the implementation of sharia business ethics in micro and small companies in Indonesia from the perspective of law and real practices in the field. The research method uses a qualitative approach with field studies, in-depth interviews with business actors, and analysis of regulations governing sharia business ethics. The results of the study indicate that although there is awareness of the importance of sharia business ethics, its implementation is still limited by factors of knowledge, access to information, and unequal understanding of the law. In addition, obstacles in terms of financing and business management also affect the consistency of the application of sharia principles. The conclusion of the study emphasizes the need to strengthen education, coaching, and regulations that support micro and small companies to run their businesses according to sharia values ​​optimally. Recommendations are submitted for the government and related institutions to provide more concrete support through training, mentoring, and facilitation of access to sharia financing.

Abstract

The Islamic capital market is one of the rapidly growing investment instruments in Indonesia, offering investment alternatives that are in accordance with sharia principles. However, legal protection for investors in the Islamic capital market still faces various challenges that can affect investor confidence and participation. This study aims to analyze the legal protection mechanisms available to investors in the Islamic capital market and evaluate the effectiveness of the regulations that govern it. The research method uses a normative and empirical legal approach with a study of regulatory documentation and in-depth interviews with regulators, capital market players, and investors. The results of the study indicate that investor protection regulations in the Islamic capital market are formally adequate, but implementation in the field is still constrained by a lack of socialization, investor understanding, and suboptimal supervision. In addition, differences in interpretation of sharia principles in investment instruments are a challenge in themselves. The conclusion of the study emphasizes the need to improve investor education, harmonize regulations, and strengthen supervisory institutions to create a safe and transparent Islamic capital market. Recommendations are submitted for the government and related authorities to continue to improve policies and protection mechanisms in order to strengthen the Islamic investment ecosystem in Indonesia.

Abstract

Transformasi digital menjadi kebutuhan mendesak bagi berbagai sektor, termasuk koperasi pondok pesantren (kopontren) sebagai entitas ekonomi berbasis komunitas pesantren. Penelitian ini bertujuan untuk merumuskan strategi pengembangan kopontren menuju digitalisasi di Pondok Pesantren Baitul Hikmah. Melalui pendekatan kualitatif deskriptif dan teknik pengumpulan data berupa observasi, wawancara mendalam, serta studi dokumentasi, penelitian ini menganalisis kesiapan, tantangan, dan potensi kopontren dalam mengadopsi sistem digital. Hasil penelitian menunjukkan bahwa terdapat beberapa faktor pendukung digitalisasi, seperti SDM muda yang adaptif terhadap teknologi, dukungan pimpinan pesantren, dan kebutuhan efisiensi operasional. Namun, hambatan seperti keterbatasan infrastruktur, rendahnya literasi digital, dan keterbatasan modal masih menjadi tantangan utama. Strategi yang diusulkan meliputi pelatihan digital bagi pengurus kopontren, penguatan kemitraan dengan lembaga teknologi, serta pengembangan sistem informasi koperasi berbasis digital. Diharapkan digitalisasi dapat meningkatkan transparansi, efisiensi layanan, serta memperluas jangkauan usaha kopontren secara berkelanjutan.
