Abstract

The notion of jarimah or criminal offense, a criminal act is an act or behavior that is prohibited by Sharia which is punishable by had and tazir penalties. Without realizing that violating traffic is a crime, people who go against the flow of traffic can be subject to sanctions in accordance with Article 287 Paragraph 1 of Law No. 22 of 2009 concerning road traffic and transportation. Traffic flow regulations for motorists, either motorbikes or cars, are not explained directly in Islamic jurisprudence, but in general, Islam always stays away from things that can bring harm to the surrounding community. The formulation of the problem in this journal is how Islamic criminal law and Law No. 22 of 2009 concerning LLAJ deal with violations that have occurred. The purpose of this study is to find out the views of Islamic criminal law and Law No. 22 of 2009 concerning LLAJ regarding violations that have occurred. The method used is a qualitative normative-empirical approach and the nature of the research is descriptive. Primary data sources are in the form of interviews, observations, and questionnaires. The interviews that the researchers used were in the form of unstructured interviews and distributed questionnaires to OJOL (motorcycle taxis online) and road users. Traffic violations can lead to accidents, which are certainly very detrimental to oneself or many people. In a year the highest accident rate that the authors get is 12 times a year with the vehicle used in the form of a motorbike. The factors that influence violations on the Sendal Jepit Road in the city of Pematang Siantar, namely: speeding up travel routes, avoiding police, and the habit of going against the direction.

Abstract

This research aims to determine the influence of internal control, village apparatus competence, and compliance with accounting rules on preventing fraud in managing village funds in Ende Regency. In this research, data was obtained by distributing questionnaires to 40 respondents to village officials throughout Ndori District, Ende Regency. The data obtained were analyzed using descriptive analysis and multiple regression. The research variables consist of an independent variable (X) and a dependent variable (Y). Independent variables include internal control, village apparatus competency, and compliance with accounting rules. Meanwhile, the dependent variable is fraud prevention. The results of this study indicate that internal control, competence of village apparatus, and observance of accounting rules have an effect on fraud prevention either partially or simultaneously.

Abstract

This research is motivated by the widespread distribution of non-SNI helmets in the city of Medan. Even though a helmet is a driving safety tool it is mandatory to use and pay attention to its quality. The aim and objective are to find out how far the role of BSN is in supervising the circulation of non-SNI helmets and what factors have caused the widespread circulation of non-SNI helmets in the Medan city market. The research method used in this research is qualitative research with an empirical legal approach based on a statutory approach - law and case approach. The data collection carried out in this research was a literature study where researchers used library research as a method of collecting data and information and also used semi-structured interviews so that researchers got specific answers related to problems. The results of the study are that there are still several helmet shops in Medan that sell cheap helmets and do not comply with the Indonesian National Standard due to the lack of knowledge about the regulations for selling SNI helmets. Then the lack of supervision and outreach by BSN and related agencies. The conclusion is that regulations regarding supervision are listed in Article 58 of Law Number 20 of 2014 concerning Standardization and Conformity Assessment. However, the implementation is still lacking. Helmets that do not meet SNI are still being traded in several shops in the city of Medan. Supervision and socialization from BSN or from the Service to helmet shops in Medan City is still minimal. The researchers’ hope for the National Standardization Agency (BSN) and related agencies is to tighten supervision of cheap helmets that do not comply with the Indonesian National Standard (SNI) and also to actively disseminate information to shops and the public. Thus, the rules can be enforced and not detrimental to any party.

Abstract

The purpose of this study was to determine the effect of digital services and systems on customer satisfaction. Basically, currently, there are many digital systems that can harm customers, due to a lack of understanding of digital systems in the banking world. Therefore, researchers conducted research related to services, digital systems, and customer satisfaction. This research is quantitative research, the analytical tool used is SPSS. The tests used in the study include the classic assumption test, normality test, hypothesis test, and Rsquared test. The results obtained that the service variable affects the satisfaction of BSI customers, and the digital system variable affects the satisfaction of BSI customers, with a degree of freedom of 0.05. Simultaneously service variables and digital systems affect customer satisfaction BSI KCP Marelan, amounting to 44.6% and the remaining 55.4%, while other variables outside the study.

Abstract

The purpose of this study was to analyze the relationship between the inflation rate, the BI 7 Day Reverse Repo Rate (BI-7 Day RR), and the money supply on Mudharabah and Musyarakah financing at Panin Dubai Syariah Bank. This type of research is quantitative research using secondary data. The data analysis technique used in this research is descriptive statistics, classical assumption test, and hypothesis testing with the OLS method. Inflation rate, BI 7 Day Reverse Repo Rate (BI-7 Day RR), and money supply act as independent variables while Mudharabah financing and Musyarakah financing act as dependent variables. Based on the test results, the money supply factor has a significant effect on Musyarakah's financing. The implication of this research is that Bank Panin Dubai Syariah should focus on the circulation of the money supply in the community which shows an escalation of people's purchasing power so that they are able to implement policies that make Musyarakah financing more needed by the community.

Abstract

Mixue Ice Cream & Tea is a Chinese franchise that has been around since June 16th, 1997. Mixue has been in Indonesia since 2020, first in the city of Bandung, and now has more than a thousand locations throughout the country, with the majority in the city of Medan. Since Medan City is home to a sizable Muslim population, it offers several possibilities for economic expansion. The purpose of this analysis is to examine the function of the MUI in relation to halal certification based on the JPH Law (No. 33 of 2014). This research relies on qualitative research techniques. Taking a normative legal approach to the pressing problem of research by analyzing the steps used to obtain halal certification of Mixue drinks. The findings of this study led to a request from the Indonesian Ministry of Religion BPJH that Mixue refrain from using the halal symbol on its packaging before the halal certificate is issued. Mixue Ice Cream & Tea has been declared Halal by the MUI. After a hearing regarding halal products was conducted by the Fatwa Commission on 15th February 2023, the MUI issued a Halal Decree. The head of the Halal Inspection Agency, the Food, Drug, and Cosmetic Review Institute, presented an audit report on halal certification to the MUI, and after careful deliberation, the organization issued a Halal Decree. Abstract

This study is supposed to determine the factors that influence MSMEs’ choice to transact in Islamic Financial Institutions and their impact on increasing revenue. This type of research is quantitative research, this study uses an explanatory research approach. The population in this study is UMKM located in the city of Binjai who have never received capital financing from Islamic financial institutions and have a wage of Rp. 2,000,000 per month amounting to 270 people and the sample in this study using the Yamane Formula amounting to 73 respondents. Data analysis techniques in this study use the evaluation of the PLS-PM testing model on the outer test which aims to see the relationship between the indicators with the latent variables. The results of this study show, there are two factors that influence MSMEs in Binjai City to increase revenue by transacting in Islamic banking, the first is the factor of services provided by Islamic banking to customers (MSMEs) so that MSMEs know what products and services are available in Islamic banking then the second factor is financial literacy, currently, the financial literacy of MSMEs in Binjai City is still not optimal but little knowledge of Islamic banking products that are different from conventional banking and are able to help MSMEs in developing MSMEs businesses, with Islamic financial literacy, it is hoped that MSMEs will be able to get funding and the impact will result in an increase in the income of MSMEs themselves.

Abstract

The research aims to understand or obtain information about the review of Islamic law and positive law on the judge’s decision regarding the cancellation of waqf land by the wakif (Analytic Study of Decisions of the Malang Religious Court Number 6551/Pdt.G/2018/PA.Kab.Mlg). In this study, a descriptive qualitative approach was used which described and analyzed the review of Islamic law and positive law on the Cancellation of Waqf in the Malang Religious Court Decision Number 6551/Pdt.G/2018/PA.Kab.Mlg. The results of the study show that the juridical review of the waqf laws and regulations regarding the cancellation of waqf by the waqif in waqf disputes that have been decided by the Malang Religious Court in Decision Number 6551/Pdt.G/2018/PA.Kab.Mlg. that the waqf can be canceled because the waqf made at that time did not fulfill some of the waqf elements and requirements listed in Law Number 41 of 2004 concerning Waqf.

Abstract

Along with the times, the convection business in North Aceh Regency has also experienced rapid development. The demand for convection services, especially in clothing manufacturing, is increasing along with the development of the local fashion industry. However, with the rapid development of business, the problem of default of Istishna’s contract is also increasingly frequent. Efforts to resolve problems applied by convection due to defaults that arise in Istishna’ contracts are important to maintain buyer trust and maintain the reputation of the convection business. In addition, the settlement must be in accordance with religious values and applicable law. Based on this, the settlement of defaults that occur must refer to the fatwa from the National Sharia Council (DSN) of the Indonesian Ulema Council (MUI) NO. 06 / DSN-MUI / IV / 2000 concerning the sale and purchase of Istishna’. This study aims to determine the forms of Default of Istishna contract that occur in convection services in North Aceh Regency and to determine the Default Settlement of Istishna contract applied to Convection Services in North Aceh Regency according to the perspective of fatwa DSN-MUI No.06 / DSN-MUI / IV / 2000. The research method used is a qualitative method with a case study approach and uses descriptive analysis. This study concludes that the chosen default resolution prioritizes deliberation as a way to find appropriate and fair solutions. Negotiated or familial dispute resolution between the buyer and the convection party is also highly recommended in Islam and is in accordance with the fatwa DSN-MUI No.06 / DSN-MUI / IV / 2000 which regulates the sale and purchase of Istishna’.

Abstract

The purpose of writing this scientific journal is to find out the regulations and legal protection for investors who suffer losses due to misleading information, which is one of the practices of market manipulation in stock trading in the capital market, viewed from the aspect of legal protection for investors from the perspective of DSN MUI fatwa No. 80 of 2011. Misleading information is a form of market manipulation that can harm investors and requires legal protection. Investors and the public need to know more clearly about market manipulation practices found in the capital market, especially in the Sharia capital market. In the capital market, there is fraud in the form of market manipulation, one form of which is the act of providing misleading information. The research method used in this writing is a normative juridical approach. The normative juridical approach is an approach carried out by examining theories, concepts, legal principles, and statutory regulations related to this discussion. The research results show that in most cases that occur in the capital market, the object is information that can influence securities prices and investment decisions for investors. The practice of misleading information is an activity used to create a false picture regarding buying and selling activities and prices on the stock exchange. This activity is usually carried out by individuals in the capital market with the aim of influencing securities prices and disseminating incomplete and misleading information. Legal protection that can be carried out is preventive and repressive protection. Preventive legal protection is carried out by providing education to the public and monitoring transactions carried out by the Financial Services Authority (OJK), while repressive legal protection includes litigation, non-litigation, and sanctions. Suggestions for future research are that researchers can find research results that lead to examples of preventive and repressive protection that have been implemented in Indonesia.
