Abstract

The current Covid-19 pandemic has resulted in economic problems, but on the other hand, learning must still be carried out using computer or laptop technology that has software in it. The problem discussed in this article was how the law used pirated software during the Covid-19 pandemic. This research used a qualitative approach by interviewing students at the State Islamic University of North Sumatra. According to the results of the author’s research, it showed that this pandemic condition has changed the learning system from offline to online which had a huge impact on all levels of society. Copyright regulation and software requirements were needs that have reached the dharuri level and were included in the maqashid Sharia which aimed to maintain reason and protect human property so that they were not trapped and were not left in ignorance. Therefore, the result of this research was that the use of pirated software during the COVID-19 pandemic was permissible due to the pandemic period that has greatly changed the economic system of human beings, and will return to the original law, which was haram (forbidden) when this pandemic period ended, and the economy was back on its feet.

Abstract

The implementation of Aceh Qanun Number 6 of 2008 Regarding Marriage Registration in Lhoksukon North Aceh, if analyzed based on the theory of legal effectiveness, is considered not maximally effective, even though this qanun has been enforced since 2018 and marriages carried out with wild qadhi . In addition, there are still many couples who submit Isbat Nikah to the Syar'iyah Court cannot prove their marriage at the time of examination in court. Legally, this qanun is very good. From the aspect of law enforcement, it still has weaknesses because the socialization carried out has not had a significant impact on the community, and the infrastructure is considered adequate, but from the aspect of public awareness it is still very low. Qanun Number 6 of 2008 concerning the Implementation of Population Administration relating to the registration of marriages is stated in several articles, namely Article 3, where the purpose of registering marriages is to ensure the legal status of each resident; protection of the rights of the population; ordered population administration; management of population administration information; and guarantee services for the rights of the population. Marriage registration is more firmly and specifically stated in Article 55 and Article 56. Article 55: (1) Every marriage, whether for residents who are Muslim or other religions, must be recorded. (2) Marriage registration for residents who are Muslim as referred to in paragraph (1) is carried out by marriage registrar employees at the District Religious Affairs Office. (3) The registration of marriages for residents of other religions as referred to in paragraph (1) is carried out by officials of the Regency/Municipal Population and Civil Registry Office. (4) The marriage registrar at the District Office of Religious Affairs shall record the marriage on the Marriage Certificate and issue the Marriage Certificate Quotation. (5) The Civil Registration Officer shall record marriages on the Marriage Certificate Registry and issue a Marriage Certificate Quotation. (6) Data on the results of marriage registration must be submitted by the District Office of Religious Affairs to the Regency/Municipal Population and Civil Registry Service within 10 (ten) days after the marriage registration is carried out. Article 56: Marriage registration as referred to in Article 55 also applies to: a) marriages determined by the court/Shari'ah Court; b) marriages of foreign nationals conducted in Aceh at the request of the foreign nationals concerned.

Abstract

The aim of this study to find out the practice of implementing Aiqaah by buying ready stock in Bajenis district. The approach used in this study is a qualitative approach. The result of the study shows that there is no intention of aqiqah at the time of slaughtering animals. Meanwhile, according to the Syafi'i mazhab, when the aqiqah animal is slaughtered, it must be intended for the aqiqah of the child. Communities in Bajenis district does not know anything about the shape of the aqiqah animal, whether the meat of the animal purchased in the market has a defect or not. Meanwhile, according to the Syafi'i mazhab, aqiqah animal must be protected from disgrace or disability. Regarding the problem of the dose of aqiqah animal, the community in Bajenis district , no longer refer to Islamic rules especially according to the Syafi'i school of thought and it is not known whether the meat comes from the same animal or has been mixed with other animal meat which is also sold by the market traders. In addition, it is not known whether the animal is old enough or not. Meanwhile, according to the Shafi'i school, the measure of aqiqah animal is two for boys and one for girls and if the animal is a camel, then it is at least five years old, if the animal is a cow, then at least two years old, if the animal is a goat, then at least one year old.

Abstract

Indonesia sebagai negara hukum dan telah mengatur aturan perceraian dalam UU No. 1 Tahun 1974 dan di dalam KHI (Kompilasi Hukum Islam). Yang seharusnya setiap pasangan yang ingin bercerai mengacu pada aturan yang ada tersebut. Akan tetapi selain dari UU No. 1 Tahun 1975 dan KHI itu ada aturan lain yang diikuti dan ditaati oleh masyarakat Islam yang ingin bercerai, yaitu hukum Islam klasik atau fiqih, yang pada prinsipnya fiqh Islam (fiqh klasik) tidak mengatur perceraian sebagaimana yang ada dalam UU dan KHI. Indonesia as a country of law and has set the rules for divorce in Law No. 1 of 1974 and in KHI (Compilation of Islamic Law). That should any couple seeking divorce refers to the existing rules. But, aside from the Law No. 1 In 1975 and KHI was no other rules are followed and adhered to by the Islamic community who wants a divorce, the classical Islamic law or jurisprudence, which in principle of Islamic jurisprudence (fiqh classic) did not arrange a divorce as it exists in the Act and KHI.   Kata kunci: Hukum,  perceraian, UU, Fiqh.

Abstract

Abstract: Divorce is a legal event, and then it should be an event carried out in accordance with rules of legal and judicial procedures. Otherwise it will result in lack recognized a divorce, this is in line with what is mandated in Law No. 1 of 1974 on article 38 and 39, which reads: "Divorce can only be done in front of the competent court after the relevant court and unsuccessfully tried to reconcile the two parties", it is stated in article 38 of Law No. 1 of 1974. While the Article 39 paragraph (2) to conduct a divorce there must be a sufficient reason that between husband and wife will not be able to live in harmony as husband and wife.Keywords: Impact, Divorce Law, Procedure  Abstrak: Perceraian adalah peristiwa hukum, dan kemudian harus menjadi acara dilakukan sesuai dengan aturan prosedur hukum dan peradilan. Jika tidak, akan mengakibatkan kurangnya diakui secara perceraian, hal ini sejalan dengan apa yang diamanatkan dalam Undang-Undang Nomor 1 Tahun 1974 tentang artikel 38 dan 39, yang berbunyi: "Perceraian hanya dapat dilakukan di depan pengadilan yang berwenang setelah pengadilan yang relevan dan gagal mencoba untuk mendamaikan kedua belah pihak ", dinyatakan dalam pasal 38 Undang-undang Nomor 1 tahun 1974. Sedangkan Pasal 39 ayat (2) untuk melakukan perceraian harus ada cukup alasan bahwa antara suami dan istri tidak akan mampu hidup secara harmonis sebagai suami dan istriami dan istri tidak akan mampu hidup secara harmonis sebagai suami dan istri.Kata Kunci: Dampak, Perceraian, UU, Prosedur.

Abstract

Abstract: Islamic law looked a habit (`adah) is a very important part for the development of Islamic law. Since applying toxicity is an urgent sub of worship in Islam. One thing that is not realized, that the habit can form a significant legal and able to answer the question of life and human life as well as a spectacular rituals and in line with local preferences.Keywords: Habits (`adat), Law, Islam, Worship. Abstrak: Hukum Islam memandang suatu kebiasaan (`adah) merupakan bagian yang amat penting bagi perkembangan hukum Islam. Karena mengaplikasikan kebisaan adalah satu sub dari ibadah yang urgen dalam Islam. Abstract

Penelitian ini bertujuan untuk mengetahui pelaksanaan wakaf uang dalam pengelolaan Halal Mart MUI Sumut Perspektif UU No. 41 Tahun 2004 Tentang Wakaf Uang. Penelitian ini menggunakan metode penelitian kualitatif fenomenologis dengngan menggunakan teknik pengumpulan data observasi, wawancara, dan dokumentasi. Hasil penelitian ini menunjukkan bahwa pengelolaan wakaf uang dari Halalmart MUI Sumut merupakan bentuk dari wakaf melalui uang. Pendiriannya diawali dari dana wakaf yang terhimpun dipakai sebagai modal usaha mini market. Selanjutnya modal usaha tersebut dikelola agar menghasilkan dan lebih produktif. Hasil keuntungan dari pengelolaan wakaf uang sampai saat ini digunakan sebagai modal pengembangan Halalmart MUI Sumut agar lebih bertambah aset wakafnya dan juga digunakan sebagai dana sosial yang diberikan pada yang berhak (mauquf ‘alaih).  Akad-akad yang digunakan dalam pengelolaan wakaf uang di Halalmart MUI Sumut meliputi akad jual beli, akad wakaf, akad hibah hasil manfaat. Akad ini yang memenuhi setiap kegiatan di Halalmart MUI Sumut sehari-harinya. Dalam pandangan fiqh, model pengelolaan seperti yang dilakukan oleh Halalmart MUI Sumut tidak melanggar aturan syariat. Meskipun terdapat multiakad dalam kegiatan jual beli barang di Halalmart MUI Sumut, akan tetapi akad-akad tersebut tidak bertentangan. Akad yang digunakan merupakan hasil modifikasi sistem muamalah yang terus berkembang agar ibadah harta tidak monoton.

Abstract

Inheritance law in Indonesia, at least sociologically, there is still pluralism, in the sense that it is still permissible for interested parties to distribute inheritance/inheritance based on the preferred law (choice of law). Especially in Tanjung Pura Langkat, until now it has been implemented with different systems. there is an inheritance distribution system that is shared equally, some through family agreements, some represent the oldest children to share inheritance, some use Islamic law, if an inheritance dispute occurs, the heirs in resolving disputes through the mediation of the village head, and community leaders, they do not want to settle disputes in court because of the high costs and lengthy process in court. The people of Tanjung Pura are a society whose majority of the population is Muslim and upholds Islamic values, however, many of them share inheritance using customary law.

Abstract

Di Kabupaten Tapanuli Tengah tepatnya di Kecamatan Lumut ada sebuah perdesaan dengan nama desa Sidomulyo terdapat beberapa kelompok yang dikenal sebagai Jamaah Tabligh. Jamaah Tabligh adalah sekelompok aktifis dakwah yang berpergian selama tiga hari, tujuh hari, sepuluh hari, 30 hari hingga 120 hari yang dilakukan oleh para muballigh. Dengan meninggalkan keluarga baik istri dan anak maka bentuk pengawasan sebagai suami atau ayah berkurang, terlebih lagi jika kedua orang tua baik suami ataupun istri mengikuti kegiatan aktifis dakwah tersebut. Mereka rela meninggalkan anak mereka selama beberapa hari dan apabila seorang ayah yang pergi dakwah akan meninggalkan istri dan anak-anaknya lebih lama lagi hingga berbulan-bulan dengan lokasi yang cukup jauh demi berdakwah. terkait hal ini perlu adanya suatu pengawasabn lebih terhadap anak yang ditinggal pada saat khurj atau masturah sehingga anak yang ditinggal tidak terjun dalam kenakalan remaja dengan usaha memberikan suatu pemahaman nilai agama, niai sosial dan lain-lain.

Abstract

Jenis penelitian ini adalah penelitian lapangan (field research) dan pengembangan (Research and Developement) dengan pendekatan yuridis sosiologis. Sumber Data primer berupa data hasil wawancara dari tiga informan yaitu, Panitera Pengadilan serta Mediator non Hakim dan didukung dengan observasi serta dokumentasi Hasil penelitian ini menunjukkan bahwa (1) Selama masa pandemi Covid-19 kecenderungan kasus cerai gugat di Pengadilan Agama Medan tidak mengalami perubahan jumlah perkara yang signifikan, hanya saja pada bulan April dan Mei terjadi penurunan jumlah kasus gugat cerai dikarenakan dibatasi jumlah perkara yang ingin di daftarkan oleh pencari keadilan. (2) Kelima faktor tersebut menjadi tolak ukur efektivitas mediasi di Pengadilan Agama yakni, faktor hukum, faktor penegakan hukum, faktor sarana dan prasana, faktor masyarakat dan faktor kebudayaan. Sehingga pada perkara perceraian tolak ukur keberhasilan mediasi adalah banyaknya jumlah perkara yang dicabut (3) Mediasi yang dilakukan secara online belum efektif sebagai alternative penyelesaian sengketa dalam upaya perdamaian para pihak yang ingin melakukan perceraian sehingga diperlukan pembaruan hukum terkait peraturan yang mengatur tentang Mediasi secara online yang dilengkapi insfratuktur telekomunikasi, sistem keamanan, dan lembaga mediasi online terutama di masa pandemi Covid-19.
