Abstract

Studi tentang hukum Islam dalam bidang sosial ditemukan adanya pelembagaan wakaf. Wakaf tidak hanya merupakan ibadah dalam rangka mendekatkan diri kepada Allah saja, namun pada perkembangannya telah menjadi yang integral dalam kehidupan bernegara. Akan tetapi tidak banyak pihak yang memandang perjalanan wakaf yang telah mengambil bentuk kebijakan negara juga dianggap sebagai bagian pranata hukum yang integral dengan agama. Agama dan negara yang seharusnya disikapi sebagai dua sisi lembaga sosial yang saling mengisi harus diletakkan sebagai dua hal yang saling mendukung dan menguntungkan. Karenanya perlu kesadaran epistemologis tentang wakaf dalam relasinya sebagai hukum agama dan hukum negara. Kesadaran epistemologis ini diharapkan agar pelembagaan wakaf, baik oleh agama maupun negara, akan sama-sama memberikan kemaslahatan yang maksimal bagi masyarakat.

Abstract

Abstract : It has become an agreement among Sunni scholars that obeying the leader of the state is an obligation. The obligation to obey this applies to every Muslim leader whether he is cautious or not while not yet falling into real kufr. No one sneaks in this principle except the Khawarij and Mu'tazilah. But there is a figure named Abu Muhammad Al-Maqdisi who in principle has the same understanding as the Sunni scholars in the matter of the obligation to obey the leader even though they are acting arbitrarily against the people. The problem is that there is a statement from al-Maqdisi that shows the fall of the obligation to obey the leader now, as if Muslim leaders have now apostatized from Islam so that they must not be obeyed or be loyal to them and even obliged to fight. The formulation of the problem is: (1) how al-Maqdisi's views on obedience to the leader, (2) how the ulama's response to al-Maqdisi's views, (3) What is al-Maqdisi's view according to siyasah fiqh. This study aims to describe and describe the ai-Maqdisi thinking systematically. From this study it can be concluded that al-Maqdisi saw no adherence to the leaders of the Islamic world now because they had apostatized due to abandoning Islamic laws, therefore obliged to fight them according to their respective abilities. Many scholars opposed Al-Maqdisi's ideas but many supported them. However, if viewed from the perspective of the Siyasah fiqh, al-Maqdisi's thinking is incorrect, even very dangerous because it will cause a war between the government and the people so that the country will be chaotic.Key word: obeying the leader, Muhammad Al-Maqdisi, siyasah fiqh

Abstract

The simultaneous regional head elections held in 2018 were one of the largest elections that took place in Indonesia, one of which was in North Sumatra. Its implementation is certainly full of interests for the elected regional head candidates and therefore sometimes they ignore ethics in the process. Practical necessity gives the impression on politics that achieving a goal must justify all means. In Islam, political ethics must be built as a guide for leaders in order to be more sensitive to the needs and benefits of the people. The establishment of good political ethics will give the impression that the authorities uphold the values of justice. In this study, the main focus is to know the appreciation of lecturers in the Siyasah study program at the Faculty of Sharia and Law at UIN North Sumatra Medan for the implementation of Islamic political ethics which took place in the 2018 North Sumatra gubernatorial election.

Abstract

The temettok tradition in the context of law is basically permissible, but in its journey, this shift in tradition has undergone significant changes, especially in the essence of this tradition itself, which is a tradition built on the principles of ta'awun and mutual cooperation, but shifts to economic values ​​that are demanded its citizens to bear expenses which in principle were like debt. This research aimed to find out how the Temettok tradition at walimatul ursy according to Aceh Ulama Traditional Assembly (MAA). The approach used in this research was to use a qualitative approach. The results of this research indicated that first, The tradition of recording Temettok money when the walimatul ursy in Aceh Singkil Regency had two percentages, the first is the Cinendang river, which was estimated to have existed since 1985. The two Sungkhaya rivers were thought to have existed since 1956. So, this Temettok tradition held at the time of the walimah to be precise on the last day. Second, The Temettok tradition, in the view of Aceh Ulama and Traditional Assembly (MAA), allowed this tradition by reason of the principle of fiqh “a custom can be made into law”, besides that the Temettok tradition was also in the form of a grant, not a debt, because if a debt was owed, the law was haram, because tradition might not conflict with Islamic law. Thret, After analyzing more deeply based on the verses of the Qur'an and the hadith of the Prophet Muhammad SAW, that the Temettok tradition was classified as ‘urf Sahih, because, this urf applied in general, it did not contradict Islamic law, the gift was in the form of a grant. So apart from that, if it was seen from the social side, the Temettok tradition at the time the walimah put forward help, strengthened ties, strengthened ukhuwah and the Temettok tradition was well known in the community.

Abstract

The most important problem that is so easy to see is the problem of understanding and knowledge about waqf, both those who are waqf and those who manage the waqf. So far, those who do waqf only understand that waqf is only a worship whose reward will flow continuously without limit. This type of research is field research and juridical normative. In order to obtain answers from this research, the researchers conducted direct research in North Labuhanbatu Regency. The primary data from this study are waqf data originating from the Ministry of Religion of North Labuhanbatu Regency, KUA throughout North Labuhanbatu Regency and those from waqf nazirs in North Labuhanbatu Regency. In addition, secondary data sources are Law No. 41 of 2004 concerning Waqf, Government Regulation No. 42 of 2006 concerning the Implementation of Law no. 41 of 2004, books related to research. This study explains whether waqf in North Labuhanbatu Regency has a role or not in helping finance social activities. Then explain the application of Law No. 41 of 2004 concerning Waqf in North Labuhanbatu Regency. There are three research questions that are answered in this study, including those related to waqf institutions in North Labuhanbatu Regency in terms of Law no. 41 of 2004 concerning Waqf. Then about the procurement and management process of waqf in financing social activities in North Labuhanbatu Regency. Then in North Labuhanbatu Regency there is no BWI representative. So that the waqf there is managed by waqf nazirs who are legalized by the existence of the Waqf Pledge Deed (AIW) issued by the Head of the District Office of Religious Affairs. None of the waqf nazir has been approved by the Indonesian Waqf Board.

Abstract

Pengadilan Agama sebagai salah satu pelaksana kekuasaan kehakiman, memiliki kewenangan yang disebut dengan kewenangan absolut untuk menyelesaikan sengketa keluarga muslim. Penelitian ini bertujuan untuk menjawab bagaimana pelaksanaan mediasi non litigasi sebagai penyelesaian sengketa keluarga pada Jamaah Tabligh Kabupaten Deli Serdang dan bagaimana efektifitas mediasi non litigasi dalam menyelesaikan sengketa keluarga pada Jamaah Tabligh Kabupaten Deli Serdang. Penelitian ini adalah penelitian hukum empiris, dan teknik pengumpulan data pada penelitian ini yaitu observasi, wawancara, dan studi dokumen. Penelitian ini menemukan bahwa: Pertama, mediasi sebagai penyelesaian sengketa keluarga Jamaah Tabligh Kabupaten Deli Serdang dalam pelaksanaannya terdapat beberapa tahapan yaitu, pengumpulan data dan ta’aruf wa ta’alub (perkenalan dan pendekatan) dengan para pihak, tahap sidang mediasi, dan tahap penyelesaian mediasi. Kedua, berdasarkan analisis dari data-data yang telah dikumpulkan, ditemukan bahwa mediasi non litigasi dalam menyelesaikan kasus perceraian pada keluarga Jamaah Tabligh Kabupaten Deli Serdang berjalan efektif, dan dalam perspektif hukum progresif menurut Satjipto Rahardjo hukum adalah untuk manusia dan menolak status quo dalam berhukum. Untuk itu, dalam kacamata hukum progresif mediasi non litigasi kasus perceraian pada keluarga Jamaah Tabligh Kabupaten Deli Serdang walaupun bukan bagian dari PERMA No. 1 Tahun 2016 Tentang Prosedur Mediasi Di Pengadilan, mediasi tersebut boleh dilakukan dan tidak bertentangan dengan aturan perundang-undangan.Key Word : Mediasi, Jamaah Tabligh, Efektifitas

Abstract

This study aims to understand and analyze: 1. The understanding of the administrators of the Mosque Prosperity Agency in North Medan regarding the concept of amil zakat, 2. The extent to which zakat regulations regarding amil zakat are implemented in North Medan mosques, and 3. What factors influence the implementation of zakat regulations. on the concept of amil in the North Medan mosque. The type of research that the researcher conducts is empirical research with a sociological legal approach, and the nature of this research is qualitative-descriptive-inductive. The subject of this research is the mosque community or BKM in North Medan. Primary data were obtained by researchers through interviews, as well as questionnaires (questionnaires) that researchers gave to 46 (forty six) BKMs in all urban villages in North Medan. The results of the study show that: 1. The majority of BKM in Majid Medan Utara in the period before 2020 understood that KUA was the institution authorized to raise zakat amil at the North Medan mosque (81% of all respondents). The factors that influence the implementation of zakat regulations on the concept of amil are: first, the lack of education to the mosque community about zakat regulations; second, the lack of socialization of zakat regulations; and third, the narration of the Islamic State has not yet been completed.Keywords: Implementation, Zakat Regulation, Amil, North Medan Mosque.

Abstract

The prolonged conflict situation and the tsunami natural disaster in Aceh, resulted in the need for more progressive and philosophical legal reasoning to answer existing legal needs. Formal rules that apply legally are not sufficient conditions to explore legal justice. This is a juridical issue at the Syar'iyah Court. There needs to be legal findings in the midst of a society that is all squeezed and difficult. Among the legal issues that must be answered is how the marriage status was determined during the conflict, which was generally not recorded, plus the number of key witnesses who died during natural disasters. This is a challenge at the Meulaboh Syar'iyah Court in the case of itsbat marriage by imposing a witness known as Syahadah al-Istifadah or in customary legal nomenclature called Testimonium de Auditu. This article is a field research approach to civil law laws, civil law books, and Islamic books, especially focused on Islamic fiqh which discusses "Shahadah Al-Istifadhah". The conclusion results state that the Meulaboh Syar'iyah Court Judge is in consideration of accepting the testimony of the witness Syahadah al-Istifadah for the sake of creating a determination that creates certainty, justice for the benefit of the law for the parties, so that the desired benefits in life can be fulfilled.

Abstract

Abstract: One of the Government's strategic policies in suppressing and stopping the transmission of COVID-19 is to take the vaccination movement seriously. Even though the vaccination program has positive goals, while people are hesitant and even refuse to use vaccines because they are considered illegal and dangerous. Responding to this friction, this is where the importance of the MUI fatwa in socializing that vaccination is very urgent and permissible to do. There are no serious objections to vaccination in Medan City; even the majority of Medan Muslims claim that the MUI fatwa is beneficial. This article includes field research with a qualitative approach. The methodology used is an interpretive study of legal sociology by conducting interviews and reviewing documents related to the MUI fatwa regarding the COVID-19 vaccination. The results conclude that; the Medan City MUI fatwa has been well received by the public and deemed necessary. Second, the effectiveness of the Sinovac halal vaccine has been tested and is of good quality and is allowed to be used. There are no serious objections to vaccination in Medan City; even the majority of Medan Muslims claim that the MUI fatwa is beneficial
