Abstract

The interaction between economic development and the banking sector, particularly in the provision of credit, is crucial, with the resolution of non-performing loans (NPLs) being a significant issue. This study, titled "Resolution of Non-Performing Loans with Collateral Rights in Banks and Auction Houses," aims to investigate the mechanisms for resolving NPLs through the execution of collateral rights as stipulated by Law No. 4 of 1996. Utilizing Verdict No. 550/Pdt/2019/PT MDN as a case study, the research employs normative and legal analysis methods to explore the implementation of collateral rights in the auctioning of collateral assets when debtors default on their loans. The findings reveal the legal procedures and effectiveness of collateral execution in mitigating NPLs. The study concludes that the proper application of collateral rights laws can significantly aid in resolving NPLs, with implications for improving banking sector stability and credit recovery processes.

Abstract

The revitalization of the ijarah contract is urgently needed by the community so that the community not only uses the classic ijarah contract in daily life but can use the ijarah contract that has been revitalized in modern times, such as the muntahiyah bi al-tamlik ijarah contract and multi-service ijarah contract, so that more service products can be produced from the ijarah contract, and can make the community more empowered by the continuous development of the times. This study aims to explain ijarah contracts that have undergone revitalization so that they can be used more by the community, to develop the service products used. So the problem in this study is "What are the forms of the revitalization of ijarah contracts in Islamic banking service products." To find the answer to this question, the research method uses qualitative research, the type of research library research, and the nature of analytical descriptive research. The findings in this study are that there has been a revitalization of ijarah contracts in service products in Islamic banking, such as ijarah muntahiyah bi al tamlik and multi-service ijarah contracts. If this contract is maximized both in products and their use, it will be very profitable and convenient to get, both from the service provider and the community.

Abstract

The Pancasila economic system aims to renew the national economy in a structured, systematic, and massive manner by ensuring constitutional freedom in sustainable development based on family values to improve the quality of human life. The research formulates an effective strategy to implement the Pancasila Economic System within sustainable development, identifying challenges and obstacles and evaluating the impact of its family-based approach. This study employs literature research, collecting data through reviews of books, articles, journals, and relevant internet sources. The data collection tool is document research, and the data is analyzed qualitatively. Results indicate that an effective strategy for implementing the Pancasila economic system involves stakeholder and government involvement in policy-making, using a conceptual foundation to guide development. The system faces challenges such as global competition, foreign cultural influences, and technological transformation. To address these, collaboration among the government, private sector, and community is essential. For economic progress, the Pancasila economic democracy should be implemented based on kinship principles, emphasizing ethical, democratic values and a social sense of kinship among economic actors.
