Abstract

Human rights are rights inherent in a person that no one can contest. Therefore, the state's role in protecting these rights is also responsible for creating prosperity in social life. The problem formulation in this research is the role of the state in protecting human rights in Indonesia from an Islamic legal perspective. This research uses qualitative research methods with a descriptive approach. The findings in this research are the role of the state in protecting human rights Humans in Indonesia have been given such attention as can be seen from the many laws and regulations regarding Human Rights whose aim is to protect the rights of humans themselves. Islam also views the obligations of the state in carrying out its role as protector of human rights for all its people, must be maximal and every right must be fulfilled, because these rights absolutely come from Allah SWT and no one can interfere with them. However, in practice discrimination against human rights is still often encountered because injustice originating from the ruler himself.

Abstract

The Shiffin War in 657 AD caused divisions among Muslims. This war ended with arbitration which was not accepted by Ali bin Abi Talib, thus triggering a split into three political factions, namely the Khawarij, Muawiyah and Shiite groups. The Shiites believe that Ali bin Abi Talib was the elected caliph and the first imam after the Prophet Muhammad SAW. They believe that the highest leadership in Islam is the imam, not the caliph. The concept of imamate in the Shiite school of thought is based on the belief that Ali bin Abi Talib is the heir of the Prophet Muhammad SAW. The Shiite sect is divided into several groups, including Shiite Imamiyah, Shiite Ismailiyah, and Shiite Zaidiyah. Each group has a different view of the imamate. Shiite Imamiyah and Shiite Ismailiyah do not recognize the leadership of Abu Bakr, Umar and Uthman. However, the Zaidiyah Shiites recognize the leadership of Abu Bakr, Umar, and Uthman, but only as caliphs, not imams. During its heyday, the Shiite school of thought was able to build a civilization and contribute to Islamic civilization. One example is the Fatimid dynasty which ruled Egypt in the 10th to 12th centuries AD.

Abstract

This article was written in order to find out more deeply about the influence of social media on democracy from a religious perspective. This analysis can help understand how social media can influence democratic processes and how this influence can be managed to ensure that social media contributes to strengthening democracy. This article concludes that in Islam there are guidelines and values that must be followed to disseminate information, including in political matters. You can express yourself on social media, but it must be within the framework of sharia.

Abstract

This journal explores the intricate relationship between religion and state within the framework of Fiqh Siyasah, a branch of Islamic jurisprudence focusing on governance and politics. Religion, conceptualized as a set of obligations toward God, society, and oneself, serves as a guiding principle for human conduct across various aspects of life. Fiqh Siyasah emphasizes the crucial role of the state in implementing Islamic law on a broader societal scale. In the context of Fiqh Siyasah, the state transcends its administrative and political dimensions, emerging as an institution facilitating the application of Islamic principles in daily life. The leader, or imam, is entrusted with moral and spiritual responsibilities, not only to the community but also to Allah, requiring adherence to criteria such as justice, knowledge, and competence in managing the affairs of the people. Examining historical cases such as the Rashidun Caliphate provides an ideal model for understanding the balanced relationship between religion and state in Islam. The classical Islamic era demonstrates a symbiotic relationship, where religion and state mutually support and complement each other. However, contemporary challenges arise with the dynamics of globalization and diverse concepts of modern Islamic states.

Abstract

Regional head elections have become the focus of ongoing debate in Indonesia. The two known electoral systems are the indirect system during the early days of independence and the direct system after the reform era. By considering the principles of siyasah jurisprudence such as justice, benefit, and popular sovereignty, we will explore the arguments for and against each system. It is hoped that this article can provide a better understanding of regional head election systems in the context of Islamic law and Indonesian society, as well as help optimize the system to achieve justice and benefit in a society based on Islam.

Abstract

Women are often the targets of public anger. The role of women in society is not only as a development process, but also as a strong structural foundation. A leader is a person who rules an area. Managers must have a leadership spirit when moving around the environment. The results of the study show that leaders in Medan Tembung District, Medan City are dedicated to providing services and work policies that are in line with the vision and mission in Medan Tembung District, especially for electronic services that offer electronic support. Free electronic services are available from Feel in the center of Medan City to make it easier for the general public to get services that are timely, efficient and in accordance with Siyasah syar'iyyah quotations. It has value both in the world and in Islam

Abstract

This study explains how Islam developed during the Umayyad II era in Andalusia. The aim of this research is to find out more about the origins of the Umayyad Dynasty, Islamic civilization during the Umayyad era, as well as the factors that caused the decline and eventual destruction of the Umayyad Bani. The end result was the Umayyad dynasty, named after Umayyad Ibn 'Abdi Shams Ibn 'Abdi Manaf. This dynasty was actually founded during the reign of Caliph Uthman bin Affan, but only after the caliph was killed and Hasan ibn Ali was elected by the people, Iraqi Muslims handed over their power to Muawiyah through discussion and agreement. the unity of the Islamic world under one ruler. The year 41 AH (661 AD) was called the year of congregation ('Am al Jama'ah) at that time. And a number of factors contributed to the decline and destruction of the Umayyad Dynasty, such as the struggle for power within the royal family, ongoing hostility with Shiite and Khawarij opposition groups, ethnic conflicts between tribes in North and South Arabia, the inability of the people's caliphs to carry out his government. leading the government, and the tendencies of the rich. Bani Abbas, who received full support from Bani Hashim, the Shia group, and the Mawali group, overthrew the government.

Abstract

Polygamy is the practice of a man marrying more than one woman simultaneously. The foundation of polygamy in Indonesia, apart from marriage law, also comes from Islamic law. This article was written in order to examine how marriage law in Indonesia and Islamic law regulate the practice of polygamy. Even though polygamy is permitted in Islamic law, there are several things that must be considered, such as justice and others. Meanwhile, in Indonesian marriage law, regulations regarding polygamy are strictly regulated with various requirements that must be met to carry out polygamy.

Abstract

Women's leadership in politics is still a matter of debate among the ulama. On the one hand, most ulama do not give rights to women unless it is forbidden for them to become political leaders. They refer textually to the Koran, surah al-Nisa' verse 34, and the hadith narrated by Abi Bakrah. However, on the other hand, some Muslim reformers allow it on the grounds that there has been an accumulation of extraordinary social changes so that women today are considered relatively equal to men. This article aims to try to describe the two groups of ulama's opinions, then analyze their thinking historically and contextually, as well as provide an assessment by reconstructing old thinking to adapt it to the current context. Mufassir and fiqh scholars in the past tended to interpret verses and understand hadiths with a gender bias. This was because apart from the culture that surrounded them at that time, the position of women at that time was also very backward in various fields. Such interpretation and understanding have received a response from contemporary Muslim reformers and thinkers who try to interpret verses and understand hadith contextually. They see that women have the right to be leaders, and in reality it is proven that some women have the same abilities and expertise as men. This means that political leadership is not related to male or female gender, but is related to the capacity and abilities that must be possessed.

Abstract

Discussions are taking place on Islamic legal viewpoints and women's role in politics. When it came to the prospect of a female president in Indonesia, Islamic political groups were adamant in 1999; however, they have since "revised" their stance. Through a variety of positive strategies, they attempt to legitimate women's leadership within a nation. It is crucial to undertake research on women's leadership from the standpoint of siyasah fiqh in light of this situation. Descriptive analysis is combined with qualitative approaches in this study.In this study, secondary data was gathered from relevant documents or files, whilst primary data was gathered through observations of activities and phenomena. Despite disagreements on this point, the research indicates that, according to the Islamic perspective, women pursuing leadership roles should have the right to be picked and chosen. Regarding women's leadership in politics, there are various fiqh siyasah points of view. The majority of the classical Sunni Siyasah Syar'iyah Ulama, such as Imam Al-Ghazali, require men, although some do not, such as al-Mawardi and Ibn Tarmiyah.
