Abstract

This article addresses new and contemporary problems and calls for improvements. It is important for religious advocates to understand that, depending on the circumstances and requirements, many legal questions have been resolved. Therefore, they had to research and re-evaluate thoroughly. This research category includes literary research. This study also found that there are five different periods in the history of the development of ijtihad: the time of Rasulullah SAW, the companions, the tabiin period (the time of the madhhab imams), the period after the madhhab imams, which has passed the period of taqlid and the decline of ijtihad, and now, or the contemporary period . Increasing the vitality of Islamic law is one of the latest and most up-to-date ways of applying ijtihad in addressing modern Islamic legal problems

Abstract

During the Umayyad era, Islamic civilization experienced rapid progress in various fields such as politics, economics, social, culture and science. In the field of science, the Umayyads established a large library in Damascus and helped translate Greek and Syriac books into Arabic. This research method uses a qualitative descriptive method through a library observation approach, using book and journal observations which are then analyzed and conclusions are drawn from the findings quoted. In conclusion, the Umayyad Dynasty was an important period in Islamic history where Islamic civilization experienced great progress in various fields. Although the Umayyad Golden Age left a valuable legacy for human civilization, it became less important for the subsequent development of Islam

Abstract

This paper discusses the legal status of stolen goods, whether they are stolen goods unknown to the buyer or stolen goods that were fully known to the buyer but he was still unsure whether the item was stolen or not. To answer this The problem is that the author uses quantitative methods using literature or libraries approach, in this case the author seeks answers from various jinayah fiqh books. The findings in this article are that the practice of buying and selling is stolen goods are strictly prohibited in Islam, especially buying goods with status it is clearly known to be a product of theft or it is not clearly known, but there are indications that point to stolen goods, then it is unlawfull to buy them even if they are priced at a relatively cheap price.

Abstract

Abstract : This article aims as a tool to explore the development of Islamic law starting from the formation of the Abbasid dynasty until the collapsea nd decline of the Abbasid government. In this era, the heyday of ment in the fields of law and politics, especially its achievements, puta n icon of enthusiasm and experience in world civilization today. The development of the Abbasid civilization was also inseparable from the attention of just law enforcement as a driving force for the development oflaw, especially Islamic law at that time.  The research technique used uses qualitative research methods from a historical approach and collects data obtained from books, articles, journals and many more. This scientific work notes that there are several histories and legal practices that became the development of Islamic law during the Abbasid dynasty. such as the formation of diwans, judicial bodies such as the judiciary and the prosecutor's office. Developments in certain periods, the orderliness of the legal system, the flow and formation of the justice system which was formed in detail with the fuqoha.
