Abstract

Indonesia is reorganizing land tenure in a more equitable and equitable manner called Agrarian Reform. This activity was also carried out in Citorek Village. However, in its implementation there is a discrepancy between the implementation and the applicable laws and regulations. Therefore, the problem that arises is how the implementation of the land redistribution program in East Citorek Village is in accordance with Presidential Regulation No. 86 of 2018 and what obstacles exist during the implementation of the land redistribution program in East Citorek Village. The type of research method used is sociological jurisprudence, descriptive in nature, data sources are obtained through literature study and secondary data, data collection methods are carried out through literature study techniques, data analysis using qualitative methods and deductive inference. The conclusion of the research found that in its implementation, there are discrepancies regarding the subject of land redistribution recipients and at the implementation stage there are counseling activities that should be carried out at the planning stage. The obstacles to the implementation of land redistribution are found in the regulations, in the implementation and in the community.

Abstract

A brand is a sign to differentiate one good/service from another, protected under Article 3 of Law No. 20 of 2016 concerning Marks and Geographical Indications. How to protect the rights holders of the Onitsuka Tiger brand, which are used by other parties without rights based on Law No. 20 of 2016 concerning Trademarks and Geographical Indications, and what is the law regarding sales made by account holders without blue ticks who use other parties' brands without rights on Instagram is the main problem in this thesis. The type of research used is normative, which is analyzed qualitatively, with primary and secondary data as sources of information. Research findings indicate (1) Legal protection for registered trademark owners to protect their trademarks from fraudulent or detrimental actions from other business actors is stated in Article 21 Paragraph (1) and Paragraph (3) of the Trademark Law,Instagram, Instagram will only deactivate the violator's account and is not responsible for any losses experienced by the owner of the registered mark.

Abstract

In essence, humans and the environment are interconnected. The environment is considered an exploitative factor that causes natural disasters. The government's position in controlling illegal logging is one of the factors in finding a balance between environmental improvement and poverty. The issues discussed in this journal are: The authority and position of the Government of Probolinggo Regency, East Java Province in efforts to protect and manage forests and whether the efforts made by the Government of Probolinggo Regency, East Java Province in carrying out forest protection and management are in accordance with relevant laws and regulations. The type of research used by the author is normative research and statutory research. Based on the essence of the studies and discussions conducted, it can be concluded that (1) forest  cover tenure rights are granted by the district government, such as: restoration, security, and forest preservation, (2) The position of the government and regional governments in forest management is to guarantee forest and land security, forests, (3) The competence of local governments in their efforts to eradicate illegal logging as happened in the area can be prevented. into five categories, mainly under local government announcements as determined by law.

Abstract

- The dispute on the Timberland brand with the Timberlake brand happened caused by substantial similarity which was being sued on similarities in pronunciation, type of goods, and visuals which decided in Commercial Court Decision Number 42/Pdt.Sus-Merek/2020/PN.Niaga.Jkt.Pst and Number 881 K/Pdt.Sus-HKI/2021. The problem in this journal is how to determine the substantial similarity criteria in the dispute on the Timberland and Timberlake brands based on Article 21 (1) of Law Number 20 of 2016 on Trademarks and Geographical Indications? and whether the implementation of substantial similarity criteria on Commercial Court Decision Number 42/Pdt.Sus-Merek/2020/PN.Niaga.Jkt.Pst jo. Number 881 K/Pdt. Sus-HKI/2021 is  fulfill Article 21 (1) of Law Number 20 of 2016 on Trademarks and Geographical Indications? Abstract

The title of this research is "Legal Analysis of the Crime of Persecution Planned in Decision Number 155/Pid.B/2021/PN Kdl". This research aims to evaluate whether the actions of the accused, Beni Agus Tono Bin Mundakir, can be considered premeditated maltreatment according to the Criminal Code's Article 353 Paragraph 2. Additionally, the judges' perspectives on this case's legal aspects will be discussed. The research is conducted using a normative approach and descriptive analysis method. Secondary sources, primarily literature studies, are utilized as data sources. The analysis concludes that the accused's actions do not fully meet the criteria for severe maltreatment according to Article 351 Paragraph 2 of the Criminal Code. However, they are more appropriate to be classified as premeditated maltreatment resulting in serious injury according to Article 353 Paragraph 2 of the Criminal Code, based on the legal facts and requirements during the trial process.

Abstract

This research discusses the immigration crime of storing falsified Republic of Indonesia documents by Thevarajah Mathiraj, the law enforcement applied at the Central Jakarta District Court, and the preventative efforts from immigration authorities.  Research  Object,  Decision  Number 82/Pid.Sus/2022/Pn.Jkt.Pst. The research is normative juridically and descriptive in nature. The analysis uses secondary data and then analyzed qualitatively using deductive methods. The results of this research is the occurrence of an Immigration Crime was discovered after immigration officers received public reports or complaints of immigration violations committed by Thevarajah Mathiraj by keeping his KTP and Passport of the Republic of Indonesia while waiting to submit fake Republic of Indonesia documents to Jamil, an Indian citizen in the form of one Indonesian passport and one ID card in the name of Anthony Anadjeron which were forged. Therefore, Thevarajah Mathiraj violated Article 127 of Law Number 6 of 2011 concerning Immigration. The law enforcement applied in this case at the Central Jakarta district court was imprisonment for ten months and a fine of two hundred million rupiah. The preventative efforts made by the immigration authorities in dealing with this case are tightening the selection of foreigners, and Indonesian immigration permits domestically and abroad for foreigners.

Abstract

Bankruptcy often occurs when the list of bankruptcy assets of bankrupt debtors is added to the collateral assets of non-debtor third parties by the curator, this is done to protect the interests of creditors. This study intends to discover whether the bankruptcy estate includes the collateral assets of non-debtor third parties, as well as to see the authority of the curator to execute collateral assets owned by third parties who are not bankruptcy debtors. In this normative legal research, qualitative descriptive analysis is utilized. It was found that this research concludes that bankruptcy assets do not include debt guarantees owned by third parties Thus, there is no authority possessed by the curator in managing the debt guarantees of bankrupt debtors, which is contrary to Law Number 37 of 2004 concerning Bankruptcy & Suspension of Debt Payment Obligations, as found in Decision Number: 15/Pdt.Sus-Other Suits/2019/PN.Niaga.Jkt.Pst. Bankruptcy is a legal issue that is quite complex, so it requires caution in discussion and decision-making.

Abstract

The criminal act of extortion and threats with electronic media containing pornographyon social media was committed by the defendants Alfilah Ramadhan and IzzudinArrazzi. In this case the judge sentenced the defendant to Article 27 paragraph (4) inconjunction with Article 45 paragraph (4) of Law Number 19 of 2016 in conjunctionwith Article 55 paragraph (1) of the Criminal Code. Based on the discussion, thedefendant should have been subject to Article 27 paragraph (1) in conjunction withArticle 45 paragraph (1) of Law Number 19 of 2016 in conjunction with Article 55paragraph (1) of the Criminal Code. The issue that can be raised is whether the actionsof the perpetrators of the crime of extortion and threatening someone with electronicmedia containing pornography are appropriate based on Article 27 paragraph (4) inconjunction with Article 45 paragraph (4) of law number 19 of 2016 Jo Article 55paragraph (1 ) Criminal Code and whether the aggravating elements in the crime ofinformation and electronic transactions can be applied to cases of extortion and threatscontaining pornography in the decision. This type of research uses normative research,is descriptive analysis, secondary data, analyzed qualitatively, the method of drawingconclusions uses deductive logic. The writing of this law results in the actionscommitted by the two defendants fulfilling the elements of Article 27 paragraph (4) inconjunction with Article 45 paragraph (4) and Article 27 paragraph (1) in conjunctionwith Article 45 paragraph (1) of the ITE Law Jo Article 55 paragraph (1) of theCriminal Code and criminal sanctions using continuing and concurrent criminal acts.

Abstract

The purpose behind this composing is to talk about the assessment of the ne bis in idem case which was reconsidered by the South Jakarta Area Court. Will a case that has been inkracht be resubmitted in an assessment strategy at the Locale Court (Ne bis inidem) and what is the legitimate thought of the board of judges in the High Court choice Number 873 K/Pid/2020 concerning Assessment of the Nebis In Idem Case? This is the primary issue in this postulation. The composition of this postulationdepends on standardizing research, which is enlightening scientific by utilizing optional information which is investigated subjectively with the logical strategy as an end. In view of the examination led, it tends to be presumed that (1). Cases that have been inkracht at the High Court level must be reconsidered at the High Court, as specified in Part XVIII of the Criminal Strategy Code concerning Phenomenal Legitimate Cures by Cassation In light of a legitimate concern for Regulation as well as Legal Survey. Sothat in the event that a reconsideration is completed at the Region Court level, it should utilize another case number that isn't important for the connected subordinate case number. ( 2). The lawful outcomes of the High Court Choice Number 873 K.Pid/2020on the subsidiary of choice number 1036/Pid. B/2018/PN Jkt.
