Abstract

The agrarian reform program launched by the government basically aims to improve the welfare of the people, especially landless farmers. Through Presidential Regulation Number 86 of 2018 concerning Agrarian Reform, the government is trying to redistribute land for farmers, including those carried out in Kubu Raya Regency. However, in practice the land redistribution program carried out by the government isn’t in accordance with the procedures stipulated in Presidential Regulation Number 86 of 2018. Of the 10 access arrangement activities as stated in Presidential Regulation Number 86 of 2018, only 2 activities were carried out by Kubu Raya District Land Office. Before carrying out the implementation of land redistribution, the Land Office must first make a plan which is preceded by the preparation of operational instructions. Counseling on land redistribution activities should be carried out at the planning stage. In practice, the Kubu Raya Land Office doesn’t go through established mechanisms or procedures and directly conducts counseling at the implementation stage of activities that should have been carried out at the planning stage. In addition, the Land Office doesn’t control land whose area exceeds the maximum land ownership limit, which the government wants to control through the agrarian reform program.

Abstract

Pretrial Request Number 3/Pid.Pra/2021/PN.Tpg from the Tanjung Pinang District Court, citing expiration as the basis for the request. This study focuses on how Pre-trial object arrangements are governed by the Criminal Procedure Code in relation to the Constitutional Court's decision No. 21/PUU-XII/2014 and whether the legal considerations and dictum of the Pretrial decision No. 3/Pid.Pra/2021/PN.Tpg were in accordance with the provisions of the Criminal Procedure Code and the Constitutional Court's decision No. 21/PUU-XII/2014. The author conducted normative research in order to respond to this query. Data management is conducted qualitatively, with reference to secondary data or library materials, while analysis and conclusion-drawing are qualitatively descriptive and deductive, respectively. Conclusions drawn from the research and discussion are that the legal considerations and the judge's dictum in Tanjungpinang District Pre-Trial Case Number 3/Pid.Pra/2021/PN.Tpg are not appropriate because there are only two grounds for determining a suspect: the allegation that the suspect committed a crime and the existence of sufficient preliminary evidence.

Abstract

Uchechukwu Alvan Okafor menggunakan izin tinggal terbatas sebagai penanam modal untuk melakukan usaha perbedaan atas Pasal 75 Undang-Undang Nomor 6 Tahun 2011 tentang Keimigrasian mengakibatkan izin tinggal terbatas sebagai penanam modal menggunakan izin tinggal terbatas sebagai penanam modal untuk melakukan usaha. Permasalahan dalam penelitian ini adalah bagaimana Uchechukwu Alvan Okafor menangani kasus pelanggaran izin tinggalnya untuk menjalankan usaha, bagaimana Kantor Imigrasi Kelas I Non TPI Jakarta Pusat mengambil tindakan hukum keimigrasian terhadap Uchechukwu Alvan Okafor, dan bagaimana Kantor Imigrasi Kelas I Non TPI Jakarta Pusat menangani proses penuntutan terhadap Uchechukwu Alvan Okafor sesuai Undang-Undang Nomor 6 Tahun 2011 tentang Keimigrasian. Penelitian ini bersifat normatif dan mengandalkan bukti sekunder, analisis kualitatif, dan penalaran deduktif untuk sampai pada kesimpulannya. Hasil analisis menunjukkan bahwa Uchechukwu Alvan Okafor menyalahgunakan izin tinggal terbatas dengan mempekerjakannya sebagai investor bisnis. Perbuatan hukum yang dilakukan Kantor Imigrasi Kelas I Non-TPI Jakarta Pusat terhadap Uchechukwu Alvan Okafor merupakan pengusiran berdasarkan Pasal 75 Undang-Undang Nomor 6 Tahun 2011 Tentang Keimigrasian. UU Keimigrasian Nomor 6 Tahun 2011 diikuti dalam melakukan proses deportasi.

Abstract

When handling disputes between workers and employers in industrial relations, action is required in accordance with applicable labor law. The initial step that must be taken is to carry out bipartite negotiations between the two parties to find a solution to the dispute. If bipartite negotiations are unsuccessful, the next step is to file for mediation and sue the Industrial Relations Court. The problems that arise between the Plaintiff and the Defendant relate to the mechanism for resolving disputes in termination of employment (PHK) in industrial relations, as well as whether the procedures carried out are in accordance with the statutory regulations explained in decision Number 67/Pdt.Sus-PHI/2020/ PN. JKT. PST. From this decision, it is not considered that any negotiations took place, which is the debate in this case. To answer this problem, normative juridical research was carried out with a descriptive analytical approach. This research refers to primary and secondary data which was analyzed qualitatively, and conclusions were drawn using deductive methods. The process of resolving this industrial relations case involves mediation with a mediator from the East Jakarta Social and Employment Service, as well as filing a lawsuit with the Industrial Relations Court at the local District Court. However, statutory regulations are not in accordance with the steps taken in this case, because bipartite negotiations are thought to have never occurred.

Abstract

Defamation is an event where social interaction in the community environment harms one party, both materially and immaterially. With the development of the digital world, which moves social interaction from the real world to the digital world, it causes a newtype of crime, namely defamation on social media, and this type of crime is included in the category of computer-related crime. The legal basis for enforcing this criminal act of pollution is regulated in the Criminal Code and Law Number 19 of 2016 concerningInformation and Electronic Transactions. With the existence of dif erent forms of accountability for perpetrators of criminal acts, this is the basis for the creation of this paper using the library research method. This type of research is normative, with the nature of analytical descriptive research, and draws conclusions using deductive logic. There are several similarities in the acquittal and guilty verdicts, namely the existence of acts that allegedly attacked the victim's honor by perpetrators based on slander and the application of errors in the judge's considerations that looked more at psychological errors than normative errors

Abstract

According to the National Narcotics Agency, drug abuse increased from 1.80% to 1.95% in 2021-2022. This has resulted in overcrowding in prisons. The majority of inmates in correctional facilities are drug offenders, estimated at 145,413 out of 151,303 individuals. This study discusses the case of Rahmat Handoyo, also known as Doyok, who committed the crime of "Misuse of Narcotics Group I, Non-Plant-Based" and was sentenced to prison. In this case, the perpetrator should have received rehabilitation as an alternative form of punishment as stipulated by the laws and regulations. The main issue revolves around the judge's failure to impose rehabilitative measures on drug offenders. The findings of this study indicate that the judge erred in considering the decision based on applicable laws and wrongly assessed drug addicts as sick individuals, where punishment is not the appropriate answer morally and legally, taking into account the expert opinion assessment in accordance with Article 55. This research adopts a descriptive analytical approach, gathering both primary and secondary data. Primary data were obtained through interviews and were qualitatively analyzed using deductive logic, supported by secondary data from literature studies.

Abstract

The consideration of the DKI High Court judge in the Pinangki Malasari case which turned out to be not in accordance with the facts, and not in accordance with the provisions of Article 5 of Law No.48 of 2009. the formulation of the problem of how the judge's consideration in determining the verdict against the suspect in the crime of bribery in a corruption case in decision No. 10/PID.SUS.TPK/2021/PT and how the judge's consideration is related to the provisions in Article 5 of Law No. 48 of 2009. The rresearch method used is normative type, descriptive in nature, the main data is secondary data supported by interviews, how to collect data by literature study and interviews, qualitative analysis and how to draw conclusions using the deductive method. The results and discussion of this study are that judges have not been able to realize a sense of justice in their decisions. The conclusion of the research is that the considerations given by the panel of judges at the appellate level are not in accordance with the fact. Suggestion: The panel of judges in the future in providing consideration matters both mitigating and aggravating must always pay attention to legal principles.

Abstract

Territorial disputes are border issues between countries that often occur internationally. As happened in the relationship between Bolivia and Chile regarding the dispute over the Silala River, the use of Silala waters began in 1906. Where the two countries were involved in disputes regarding the status and use of Silala. Bolivia emphasized that the Silala spring did not meet the requirements to be considered an international waterway due to the canalization and that Chile had to pay compensation. On the other hand, Chile claims Silala as an international waterway. With these overlapping claims, Silala disputes cannot avoided. This dispute was submitted to the International Court of Justice by Chile on June 6, 2016. This research examines the status of Silala based on UNWC 1997 and the efforts taken by the two countries in resolving the Silala waters dispute. Abstract

The Tangerang Religious Court has decided to cancel marriage due to forced marriage with Number 2801/Pdt.G/2018/PA.Tng where the husband requests to cancel the marriage because the marriage was carried out by force. The 2 (two) main issues raised are whether forced marriages can be used as a reason for annulment of marriages based on Islamic family law in Indonesia and whether the decision of the Tangerang Religious Court is in accordance with Islamic family law in Indonesia or not. The research was conducted normatively with the nature of descriptive-analytical research and drawing conclusions using deductive logic methods. Forced marriage causes disputes in the household, so it can be a reason for filing an annulment of marriage. Tangerang Religious Court Decision No. 2801/Pdt.G.2018/PA.Tng states that the marriage annulment is granted so that, in this case, the marriage annulment has fulfilled the reasons according to the provisions of Article 71 letter (f) Compilation of Islamic Law which was caused by coercion. Thus, the decision is appropriate based on a review of Islamic family law in Indonesia.

Abstract

As the owner of the ‘Om Telolet Om’ font, Arwan OD objected to using his font for the Greenfields brand. The font is used in writing attached to the Greenfields milk packaging. This study aims to find out how the Copyright Law protects fonts as copyrighted works and whether the use of the ‘Om Telolet Om’ font by Greenfields products is a copyright infringement. The research uses normative legal research methods, with secondary data supported by primary data. Based on the results of the research, it is known that based on Article 40 of the Copyright Law Number 28 of 2014, fonts are copyrighted works in the field of calligraphy art so the use of the font ‘Om Telolet Om’ without permission on greenfields milk packaging is a violation of the economic rights of the creator.
