Abstract

Consumer protection is an important part of national legal development aimed at realizing the welfare of society and social justice. In the context of tourism, consumer protection is not only concerned with fulfilling the rights of tourists as service users, but also concerns legal certainty for tourism business participants. The study uses a normative juridical approach by examining the provisions of legislation, legal doctrine, and legal norms related to consumer protection in the tourism sector. Consumer protection is seen as part of the implementation of the country’s objectives as mandated in Alinea IV Opening the State Basic Act of the Republic of Indonesia in 1945, namely protecting all Indonesian and all Indonesian blood spills. The rapid development of the tourism sector in Indonesia, which is characterized by the increasing diversity of tourist destinations such as religious, marine, mountainous, and cultural tourism, raises the complexity of legal relations between consumers and tourism business. The Condition demands comprehensive and implementative consumer protection regulation. Tourism consumers in fact cover all walks of life, so protection against tourism consumers is an integral part of protection against Indonesian society. Effective consumer protection is expected to create a sense of security, comfort and legal certainty for consumers while encouraging a healthy and equitable tourism business climate. The results of normative studies show that the legal framework of consumer protection of tourism in Indonesia has been regulated through Law No. 8 of 1999 on Consumer Protection and Law No. 10 of 2009 on Tourism, in particular the provisions of Article 53 which emphasizes the responsibility of tourism business actors. In addition, in the context of Sharia-based tourism, Fatwa DSN-MUI Number 108/DSN-MUI/X/2016 provides normative guidelines on the implementation of tourism that are in accordance with Sharia principles and consumer rights protection.

Abstract

Freedom of expression is a constitutional right guaranteed by the 1945 Constitution, but in practice, the implementation of the Electronic Information and Transactions Law (EIT Law) faces various challenges, including the fact that it is often viewed as a “rubber clause” due to overly broad interpretations, leading law enforcement officials and government officials to frequently use it to restrict or even silence public criticism. This study aims to analyze the implications of Constitutional Court Decision No. 105/PUU-XXII/2024 on law enforcement practices in defamation cases, as well as its impact on the protection of freedom of expression and legal certainty in Indonesia. The research method employed is a normative legal approach using a statutory framework and a case-based approach, supported by a literature review of primary and secondary legal sources. The research findings indicate that the Constitutional Court’s decision provides a constitutional interpretation that clarifies the scope of the provisions in Article 27A in conjunction with Article 45(4) of the ITE Law, particularly by limiting the phrase “another person” to individuals and interpreting “a matter” as an act that degrades a person’s honor or reputation. This interpretation narrows the scope for multiple interpretations and reduces the potential for abuse of the defamation provisions. Furthermore, this ruling has a positive impact in strengthening the protection of freedom of expression, reducing the potential for the criminalization of criticism, and enhancing legal certainty. Nevertheless, the implementation of the ruling still faces challenges, necessitating public awareness campaigns, regulatory harmonization, and the strengthening of a human rights-based approach among law enforcement officials so that the goal of protecting freedom of expression can be fully achieved.

Abstract

This study aims to analyze the policies of the Kuranji Dalang Village government in developing the tourism sector and to examine the extent to which these policies are able to integrate local potential with sustainable village development planning. This study uses a qualitative approach with a case study method. Data was obtained through in-depth interviews, observation, and documentation involving village officials, community leaders, and local residents. Data analysis was conducted through the stages of data reduction, data presentation, and interactive conclusion drawing. The results of the study show that Kuranji Dalang Village has considerable potential for marine tourism, particularly in the coastal area, which has a direct economic impact on the community through fishing and small businesses such as food and beverage sales. However, the village government does not yet have a specific vision and mission formally directed at tourism development, so existing policies are still general and unstructured. Tourism development is more focused on basic infrastructure development and the formation of community groups such as Pokdarwis and MSMEs, which indicates efforts towards a community-based tourism approach. The main obstacles faced include budget constraints, weak coordination, low community participation in village deliberations, and a lack of regulations related to visitor safety and supervision. Nevertheless, the level of community trust in the village government is relatively high, which is an important social capital in sustainable tourism development. This study concludes that tourism development in Kuranji Dalang Village requires strengthening more targeted village policies, increasing institutional capacity, and active community participation so that tourism can develop inclusively and sustainably in accordance with the principles of sustainable tourism.
