Abstract

The emergence of Corona-virus 19 (COVID-19) requires the Indonesian government to impose social distancing provisions in the form of laws and regulations so that the Indonesian government can reduce the percentage and rate of spread of COVID-19 in the country. As a result of the social distancing policy, people depend on information technology to support their activities. In using information technology services, technology service providers require technology service users to fill in personal data information and upload personal identity documents. Technology service providers ask for approval from users that the information and documents that have been provided will only be used for the benefit of technology services, will not be used for other things without the consent of technology service users. With regard to the protection of personal data, the Indonesian government issues regulations regarding the protection of personal data. However, recently there has been a leak of people's personal data that is misused by unauthorized parties. This is contrary to one of the obligations of the Indonesian government which must ensure the protection of people's personal data.

Abstract

Providing drinking water is a crucial aspect in efforts to improve community welfare. Collaboration between government and business entities has become a common approach in developing drinking water infrastructure. This research aims to analyze cooperation project schemes with the government and business entities end to end drinking water supply system. This research aims to analyze the implementation of the end-to-end SPAM project scheme and its conformity with the provisions regulated in PP Number 122 of 2015, especially Article 56. One important aspect of this regulation is Article 56, which regulates administrative sanctions for SPAM operators who does not comply with his obligations. The analysis results show that the suitability of the end to end SPAM project scheme with Article 56 PP Number 122 of 2015 depends on the extent to which the project complies with all the obligations and provisions stipulated in the regulation. Thus, this research provides in-depth insight into the implementation of the SPAM project scheme in the context of regulations in force in Indonesia.

Abstract

Economic life is inseparable from daily life in running a business to create prosperity, and one way to do this is through borrowing capital. However, obtaining capital is not easy; it requires a process and collateral to secure the loan. One of the avenues to obtain capital is through bank loans. Banks, as financial institutions, provide capital to facilitate access to credit. In this process, banks often require collateral. In the execution of credit facilities, debtors who have repaid business loan credits with collateral such as land certificates and building certificates at a bank are entitled to receive back the collateral that was handed over to the bank. The bank, as the creditor, has the obligation to return the collateral to the debtor who has fulfilled their obligations. However, there are cases where creditors do not return the debtor's collateral documents. In such cases, the legal recourse for the debtor to regain the collateral from the creditor will depend on factors such as the cancellation of the mortgage rights and the effort to reclaim the collateral if the creditor does not return the collateral documents.

Abstract

This study examines the legal implications of the Minister of Trade Regulation (PERMENDAG) No. 3 of 2024, which amends PERMENDAG No. 36 of 2023, on the consignment service business for imported goods in Indonesia. In response to the dynamics of globalization and digital economic growth, this regulation was revised to strengthen import management by raising international compliance standards. The analysis shows that PERMENDAG No. 3 of 2024 introduces more detailed and strict provisions regarding licenses and import procedures, aiming to ensure the security and quality of imported goods. This step is crucial for maintaining consumer trust and ensuring fairness in Indonesia's business environment. Based on these regulatory changes, it is recommended that consignment business operators enhance their understanding of and compliance with the new regulations, and strengthen cooperation with suppliers and logistics partners to meet existing standards. The conclusion of the study is that the new regulation affects the consignment service business by demanding higher compliance and more organized import processes. It is advised that consignment businesses enhance their understanding of the new regulations, strengthen cooperation with suppliers, and ensure adherence to updated procedures.

Abstract

Artificial Intelligence-based (AI) Health Service is a solution to the limited number and distribution of doctors in Indonesia. However, the use of AI technology also presents several challenges. This research used a normative juridical approach to analyse protection regarding the development of AI-based technology-based health services in Indonesia. The analysis shows that challenges to utilizing AI in healthcare include bias, protection of personal data and risk of malpractice. As a system that has no moral values, doctors is expected to be wiser in operating it. To ensure the delivery of quality AI-based health services, patients, doctors, service providers and the government need to understand and carry out their respective roles collaboratively.

Abstract

The uncertainty of legal regulations concerning the economic entitlements of songwriters or musicians and related rights in asserting royalties can arise due to the failure to register the data of songwriters or musicians along with their related rights in the Song and Music Information System (SILM) and the Directorate General of Intellectual Property (DJKI) database. In an attempt to offer legal safeguard for copyright or related rights in the music industry that are not registered in SILM, this study seeks to examine the legal consequences of such situations and the patterns of dispute resolution. Through observation of the research object and the degree of its application in practice, empirical sociology is the applied method used to evaluate the efficiency of legal tools in complying with prevailing regulations. Findings indicate that in cases of music compositions or songs not included in SILM, users are willing to pay royalties in exchange for not releasing new recordings, and that to achieve mutually beneficial agreements, conflict resolution procedures typically require mediation through PPNS before resorting to litigation.

Abstract

Human beings need a home as their basic necessity. Purchasing a house through installments has been the most popular method for several decades. The Home Ownership Loan Agreement (KPR) is a legal document between the debtor and the bank regarding the purchase of a house that is paid in installments by the debtor. According to Banking Law, KPR agreements tend to have provisions that benefit the bank, including high interest rates and significant additional costs. These implications further strengthen the need for increased transparency and legal protection for debtor customers, as well as stricter regulations in the banking industry to ensure a balance of interests between the bank and the debtor, given the debtor's relatively weak position. With legal protection for debtor customers, if debtor customers incur losses or risks in the KPR agreement, the creditor is obliged to handle, address, and resolve various complaints or losses experienced by the debtor party.

Abstract

PMK No. 96 of 2023 contains several important reform aspects which lie in adjusting regulations to the latest business practices, including the use of technology in customs and excise procedures, which promises process efficiency and greater transparency. Although PMK No. 96 of 2023 has positive objectives, implementation challenges include regulatory complexity and ambiguity which creates confusion and can hamper the import and export process. Seeing the complexity of PMK No. 96 of 2023 makes the author interested in analyzing the problem. What are the implications of PMK No. 96 of 2023 on Import and Export Business in Indonesia? and What are the challenges faced by export and import business actors in Indonesia in implementing the provisions of PMK No. 96 of 2023?, in this writing using normative juridical methods. This PMK stipulates policies that support and facilitate the delivery of e-catalogue and e-invoice data, speed up the customs clearance process, and increase transparency and efficiency by determining the responsibilities of each party involved.

Abstract

The WON by BWS application is a form of digital banking product that allows Customers/Users to access banking services directly (real-time) and without the need for face-to-face interaction at the Bank's office. Banking services provided in the WON by BWS application include account opening, transfers in Indonesian Rupiah and US Dollar (both to accounts within BWS and to accounts in other banks), US Dollar purchases (USD-IDR and IDR-USD), bill payments (e.g., credit cards, electricity, telephone bills, etc.), purchases (e.g., flight tickets, phone credit, internet data, etc.), electronic money top-up (OVO, Gopay, ShopeePay), ATM/Debit Card blocking, and other features. Customers/Users intending to use the WON by BWS application are required to understand and agree to the end user license agreement (EULA) established by the Bank, which is a standard agreement as regulated by the Financial Services Authority. BWS, in drafting a standard agreement, must ensure a balance, fairness, and reasonableness between the Bank and Customers/Users. Based on this, the author intends to analyze the end user license agreement (EULA) of the WON by BWS application, to determine whether the standard agreement provides legal protection for Customers/Users.
