Abstract

The Village Consultative Body (BPD) plays a strategic role in the system of checks and balances at the village government level under Law No. 6 of 2014 on Villages. However, in practice, this institutional oversight function often faces various regulatory and operational obstacles. This study aims to conduct an in-depth legal analysis of the BPD’s authority to oversee the performance of the Village Head. Through a normative legal approach supported by a literature review of various regulations, this study examines the operational limitations and the effectiveness of BPD oversight. The research findings indicate that the BPD oversight norms stipulated in Ministry of Home Affairs Regulation No. 110 of 2016 remain administrative-preventive in nature and have not yet addressed the realm of repressive sanctions. The primary obstacles to oversight stem from the low legal literacy of BPD members, the lack of transparency in village executive reporting, and the suboptimal technical guidelines for oversight at the regional level. Consequently, the oversight that takes place tends to be merely a formality and is prone to triggering horizontal conflicts with the Village Head. To optimize this control function, regulatory strengthening is required through the standardization of Village Head performance parameters and the continuous enhancement of BPD members’ legal capacity. Strong synergy between the BPD and the village community is the key to realizing accountable and transparent village governance.

Abstract

An Initial Public Offering (IPO) is a capital-raising mechanism in the capital market that is fundamentally based on the principle of information disclosure to ensure investor protection. However, in practice, prospectuses may contain false, incomplete, or misleading information (misleading disclosure), potentially causing financial losses to investors. Responsibility for such disclosure extends beyond the issuing company to the underwriter, who is obligated to conduct due diligence and ensure the accuracy and completeness of the information presented in the prospectus. This study aims to analyze the legal liability of underwriters involved in misleading disclosure during IPOs and to examine the legal protection available to affected investors. The research employs a normative juridical method using statutory and library approaches by reviewing Indonesian capital market regulations, including Law Number 8 of 1995 on the Capital Market, Law Number 4 of 2023 on the Development and Strengthening of the Financial Sector, and regulations issued by the Financial Services Authority (OJK). The findings indicate that underwriters may be held administratively, civilly, and criminally liable if proven responsible for misleading disclosure. Investor protection is provided through preventive mechanisms, such as disclosure principles, OJK supervision, and due diligence, as well as repressive mechanisms, including compensation claims, dispute resolution, and legal sanctions. Nevertheless, the effectiveness of these protections depends on consistent supervision and law enforcement.

Abstract

The enactment of Law Number 17 of 2023 concerning Health has brought fundamental changes to the civil liability mechanism for medical malpractice in Indonesia. This research aims to analyze the theoretical transformation and judicial implications of the dualism of medical breach of contract (wanprestasi) and tort (PMH) claims following the implementation of this regulation. The research method used is normative legal research with statutory and conceptual approaches. The results indicate that Article 308 paragraph (2) of Law Number 17 of 2023, which requires a recommendation from the Professional Disciplinary Board for civil claims against individual medical personnel, creates significant procedural hurdles in tort claims. This has implications for a shift in patient litigation strategies, which tend to opt for breach of contract or tort claims directed at Health Service Facilities based on the Corporate Liability doctrine. Furthermore, Article 275 paragraph (2) reinforces the exemption from compensation in emergency conditions as a form of professional protection. In conclusion, Law Number 17 of 2023 strengthens procedural protection for medical personnel while simultaneously encouraging the centralization of civil liability burdens on healthcare institutions.

Abstract

The use of Identity Cards (Kartu Tanda Penduduk/KTP) as collateral in debt agreements remains common despite the absence of legal provisions recognizing KTP as a valid security object. This study analyzes the legal validity of using KTP as collateral and the legal consequences arising when a debtor defaults. A normative juridical method was employed using statutory and conceptual approaches, with primary, secondary, and tertiary legal materials analyzed through qualitative legal interpretation. The results show that KTP cannot be classified as either proprietary or personal security because it is an official state identity document with no economic value and does not fulfill the legal requirements of collateral under Indonesian civil law. Consequently, KTP cannot establish preferential rights for creditors or function as an executable security object in the event of default. Moreover, retaining a debtor’s KTP as collateral may violate the principles of personal data protection under Indonesian law. Although the principal debt agreement may remain valid if it fulfills Article 1320 of the Indonesian Civil Code, the collateral agreement involving KTP is legally invalid. Strengthening public legal awareness and government supervision is recommended to prevent misuse of identity documents in private debt transactions.

Abstract

Bali is globally renowned not only for its natural beauty but also for its rich cultural heritage. However, the island's growing popularity as a tourist destination has led to increasing concerns over the erosion of its local traditions and values. This study explores the concept of restricting visitor numbers as a strategic effort to preserve Bali’s cultural identity. Using a qualitative approach that includes literature review and in-depth interviews with cultural practitioners, local traditional leaders, and sustainable tourism stakeholders, this research reveals that well-managed visitor restrictions can create a more sustainable balance between tourism and cultural preservation. Key strategies include setting visitor quotas, implementing culturally-focused entry requirements, and fostering cooperation between local government and traditional communities to determine cultural carrying capacity. The findings suggest that cultural conservation and tourism development are not mutually exclusive when managed with a shared vision of sustainability. This paper advocates for a cultural-based tourism policy that prioritizes quality over quantity, ensuring that Bali remains a living heritage for future generations.
