Abstract

This study analyzes the possession of marital property as an object of fiduciary security by a financing company without the wife’s consent based on Medan District Court Decision Number 492/Pdt.G/2025/PN Mdn. The research focuses on the financing company’s authority to possess marital-property collateral and legal dispute resolution. This study employs a normative juridical method with a descriptive-analytical approach using statutory and case approaches. Legal materials consist of primary, secondary, and tertiary materials collected through library and document studies and analyzed qualitatively. The findings indicate that the Toyota Vellfire BK 1819 LW was acquired during the marriage and registered in the Plaintiff’s name. The Plaintiff established that the vehicle was encumbered as collateral without her knowledge or consent and that she did not sign the financing agreement. Pursuant to Articles 35(1) and 36(1) of Law Number 1 of 1974 on Marriage, property acquired during marriage constitutes marital property, and legal acts concerning such property require the consent of both spouses. This requirement relates to Article 1320 of the Indonesian Civil Code concerning consent as a requirement for a valid agreement. The Court held that the Defendant’s possession of the vehicle registration certificate and vehicle constituted an unlawful act and that the encumbrance lacked binding legal force. The dispute was resolved by ordering the return of the vehicle registration certificate. The decision underscores the importance of protecting spousal rights and applying prudential principles when financing companies accept marital property as fiduciary collateral.

Abstract

The use of e-Toll cards as electronic payment instruments provides convenience and efficiency for toll road users. However, system failures, double debits, unsuccessful transactions despite balance deductions, and delays in refunds or complaint handling may cause consumer losses. These conditions raise legal issues concerning service providers’ contractual obligations and consumer legal protection. This study aims to analyze forms of breach of contract by e-Toll service providers, consumer rights and legal protection, and dispute resolution mechanisms. This research employs normative legal research using a statutory approach. Legal materials consist of primary, secondary, and tertiary sources obtained through literature study and analyzed qualitatively using deductive reasoning. The results indicate that breaches of contract include failure to perform obligations, improper performance, and delays, particularly in payment services, double debits, balance deductions without successful transactions, and delayed refunds or complaint handling. Legal protection is provided through the Consumer Protection Law and Bank Indonesia regulations concerning electronic money and payment service providers, particularly regarding consumer rights to security, accurate information, complaint handling, dispute resolution, and compensation. Disputes may be resolved through internal complaint mechanisms, out-of-court mechanisms such as the Consumer Dispute Settlement Agency (BPSK), or litigation. Effective consumer protection depends on regulatory compliance and accessible remedies for consumer losses. These mechanisms are essential to restore consumer rights and strengthen legal certainty in electronic payment transactions.

Abstract

Communal life is a fundamental component of human existence, particularly within the family. Divorce, however, raises concerns regarding children's rights, particularly the obligation to provide child support to meet essential needs, including food, education, medical care, and balanced development. In practice, enforcement of post-divorce child support obligations does not always achieve the expected results. This research aims to analyze the legal framework and implementation of enforcement measures for post-divorce child support obligations through a case study at the Medan Religious Court and to identify factors hindering their enforcement. This research employs a case study approach using a socio-legal (empirical-juridical) method. Data were collected through analysis of applicable laws, legal standards, and principles, as well as interviews and observations involving judges, court clerks, legal counsel, legal practitioners, and case parties at the Medan Religious Court. The findings indicate that obstacles to enforcing child support decisions arise from internal and external factors. Internal factors include the limited authority of judges to compel compliance and enforcement procedures characterized by excessive formalism and prolonged timelines. External factors include limited legal awareness, adverse economic conditions, bad faith of the obligor, and inadequate monitoring mechanisms. These obstacles hinder the effective protection of children's rights after divorce and demonstrate challenges in ensuring compliance with court-ordered child support obligations.

Abstract

The first land registration is an important stage in providing certainty and legal protection for land rights. The safe principle as one of the principles of land registration requires that the implementation of registration be carried out carefully and carefully so that the physical and juridical data produced provide security guarantees for rights holders. This study aims to analyze legal arrangements regarding the application of the safe principle in land registration for the first time in Indonesia, its application by the Medan City Land Office, as well as the legal consequences for land certificates and land offices if the principle is not applied. This study uses normative and empirical legal research methods with primary, secondary, and tertiary data sources obtained through literature studies and field research. The results of the study show that the safe principle has a legal basis in land laws and regulations, especially Government Regulation Number 24 of 1997 concerning Land Registration. Its implementation by the Medan City Land Office is carried out through the examination and verification of physical and juridical data, measurement and mapping, document validation, and supervision at the registration stage. The non-application of the safe principle can cause administrative defects that result in weak certificate proving power, the possibility of cancellation if proven to be legally flawed, as well as legal and administrative consequences for the Land Office in accordance with laws and regulations, as well as increasing the potential for land disputes and legal uncertainty for interested parties.
