Abstract

Marriage is a physical and spiritual bond that has a sacred nature, ideally it can be done once in a lifetime, but in reality many husbands and wives take court action. The formulation of the problem of this research is how mediation is regulated in religious courts according to statutory regulations, and how effective the implementation of mediation is in resolving divorce cases in the Kuningan religious court and the Majalengka religious court. The aim of this research is to determine the legal regulations and effectiveness of mediation in divorce cases at the Kuningan religious court and the Majalengka court. The research method uses empirical juridical methods. The results of the research show that divorce cases in Kuningan Regency and Majalengka Regency can be resolved through mediation in religious courts, based on Supreme Court Regulation (PERMA) Number 1 of 2016 concerning Mediation Procedures in Court. Mediation is a process that is private, confidential and cooperative in nature. solve the problem. Because the mediator as a third party helps the disputing parties in resolving the conflict and resolving or bringing their differences closer together. Therefore, the effectiveness of the mediation carried out in the two courts can be proven by the ongoing mediation which can be attended by both parties to the case. Factors that hinder the effectiveness of the law regarding mediation include one of the parties not appearing in the case, and the law enforcement factor itself which is caused by certain reasons. In conclusion, the implementation of mediation in divorce cases can be effective if both parties to the case are present so that mediation can be carried out by the mediator to achieve peace, in accordance with the Regulation of the Supreme Court of the Republic of Indonesia Number 1 of 2016 concerning Mediation Procedures in Court.   Perkawinan adalah suatu ikatan lahir batin yang bersipat suci idealnya boleh dilakukan satu kali seumur hidup, tetapi pada kenyataanya banyak suami istri yang melakukan gugatan kepengadilan. Rumusan masalah dari penelitian ini adalah bagaimana pengaturan mediasi di pengadilan agama menurut peraturan perundangan-undangan, dan bagaimana efektifitas pelaksanaan mediasi dalam penyelesaian perkara perceraian di pengadilan agama kuningan dan pengadilan agama majalengka. Tujuan dalam penelitian ini untuk mengetahui pengaturan hukum dan efektivitas pelaksanaan mediasi dalam perkara perceraian di pengadilan agama kuningan dan pengadilan majalengka. Metode penelitian dengan menggunakan metode yuridis empiris. Hasil penelitian menujukan bahwa perkara perceraian di Kabupaten Kuningan dan juga Kabupaten Majalengka dapat diselesaikan melalui mediasi di pengadilan agama, berdasarkan Peraturan Mahkamah Agung (PERMA) Nomor 1 Tahun 2016 Tentang Prosedur Mediasi Di Pengadilan, Mediasi adalah suatu proses yang bersifat pribadi, rahasia dan kooperatif dalam menyelesaikan masalah. Karena mediator selaku pihak ketiga membantu para pihak yang bersengketa dalam menyelesaikan konflik dan menyelesaikan atau mendekatkan perbedaan-perbedaannya. Oleh karena itu, efektivitas mediasi yang dilakukan dikedua pengadilan tersebut dapat dibuktikan dengan berjalanya mediasi yang dapat dihadiri oleh kedua pihak yang berperkara. Faktor yang menghambat efektivitas hukum tentang mediasi ini salah satunya salah satu pihak tidak datangnya yang berperkara, dan faktor penegak hukumnya itu sendiri yang diakibatkan oleh alasan-alasan tertentu. Kesimpulan pelaksanan mediasi dalam perkara perceraian ini dapat berjalan efektif apabila hadirnya kedua pihak yang berperkara untuk dapat dilakukannya mediasi yang dilakukan oleh mediator untuk mencapai perdamaian, sesuai dengan Peraturan Mahkamah Agung Republik Indonesia Nomor 1 Tahun 2016 tentang Prosedur Mediasi di Pengadilan.

Abstract

Honorary workers often experience injustice at work. This is indicated by the life of honorary workers who are far from prosperous. These honorary staff are really needed in every regional government agency to assist with the duties of the State Civil Apparatus so that the obligations of these honorary staff are the same as those of the State Civil Apparatus but earn an income below the regional minimum wage for Kuningan Regency. So a problem formulation emerged on how to regulate and legal protection for honorary staff in Kuningan Regency. This research aims to examine legal regulations and protection for honorary workers in Kuningan Regency. This research uses a Juridical-Empirical research method. The results of the research show that the regulation of honorary staff as workers is regulated in Law Number 43 of 1999 concerning Personnel Principles, Number 98 of 2000 Government Regulations on the Formation of Civil Servants, and specifically in Government Regulation Number 48 of 2005 concerning the Appointment of Honorary Personnel. Becoming a Civil Servant, Kuningan Regent Regulation Number 30 of 2018 concerning Management of Non-Civil Servant Personnel in the Kuningan Regency Government Environment. Honorary workers receive preventive protection in the form of health insurance, repressive protection in the form of work accident insurance, death insurance, and legal aid. In conclusion, the regulation of honorary staff has been regulated in statutory regulations, then legal protection for honorary staff in Kuningan Regency is divided into 2 forms, namely preventive legal protection and reflexive legal protection. Suggestions, the government should reform the law in order to develop the welfare of honorary workers so that in the future honorary workers in Indonesia can prosper, receive a fair and decent salary in accordance with their workload and responsibilities, give priority to honorary workers to be appointed as Civil Servant Candidates or Government Employees with a Work Agreement (PPPK).   Tenaga honorer sering mendapatkan ketidak adilan dalam pekerjaan. Hal tersebut diindikasikan dengan kehidupan tenaga honorer yang jauh dari kata sejahtera. tenaga honorer ini sangat dibutuhkan di setiap instansi pemerintah daerah untuk membantu tugas-tugas Aparatur Sipil Negara sehingga kewajiban tenaga honorer ini sama dengan Aparatur Sipil Negara tetapi mendapatkan penghasilan dibawah upah minimum daerah Kabupaten Kuningan. Sehingga muncul rumusan masalah bagaimana pengaturan dan perlindungan hukum bagi tenaga honorer di Kabupaten Kuningan. Penelitian ini bertujuan untuk mengkaji pengaturan dan perlindungan hukum bagi tenaga honorer di Kabupaten Kuningan. Penelitian ini menggunakan metode penelitian Yuridis-Empiris. Hasil penelitian menunjukan bahwa pengaturan tenaga honorer sebagai pekerja diatur dalam Undang-Undang Nomor 43 Tahun 1999 tentang Pokok-Pokok Kepegawaian, Nomor 98 Tahun 2000 Peraturan Pemerintah Formasi Pegawai Negeri Sipil, dan secara spesifik datur dalam Peraturan Pemerintah Nomor 48 Tahun 2005 Tentang Pengangkatan Tenaga Honorer Menjadi Pegawai Negeri Sipil, Peraturan Bupati Kuningan Nomor 30 Tahun 2018 tentang Manajemen Tenaga Non Pegawai Negeri Sipil Di Lingkungan Pemerintahan Kabupaten Kuningan. Tenaga honorer mendapatkan perlindungan secara preventif berupa mendapatkan mendapatkan jaminan kesehatan, perlindungan secara represif berupa jaminan kecelakaan kerja, jaminan kematian, bantuan hukum. Kesimpulan, Pengaturan tenaga honorer sudah diatur dalam peraturan perundang-undangan, kemudian perlindungan hukum terhadap tenaga honorer di Kabupaten Kuningan dibagi menjadi 2 bentuk, yakni perlindungan hukum secara preventif dan perlindungan hukum secara refresif. Saran, pemerintah hendaknya melakukan pembaharuan hukum agar dapat mengembangkan kesejahteraan terhadap tenaga honorer agar kedepannya tenaga honorer di Indonesia dapat sejahtera, memperoleh gaji yang adil dan layak sesuai dengan beban pekerjaan dan tanggung jawabnya, memberikan prioritas kepada tenaga honorer untuk diangkat menjadi Calon Pegawai Negeri Sipil atau Pegawai Pemerintah dengan Pejanjian Kerja (PPPK).

Abstract

Correctional Institutions do aim to eliminate the sense of freedom possessed by convicts, but the deprivation of freedom must also refer to the human rights of inmates which must be maintained by correctional officers. In an effort to protect human rights in special prisons for women, special treatment is required for them and correctional institutions are expected to be the spearhead in implementing and protecting convicts so that the absolute rights of the convicts themselves can be given as they should. The purpose of this research is to find out how the regulation of legal protection for the rights of female convicts in the Kuningan Class IIA Penitentiary. The method used in this study uses an empirical juridical approach and data collection techniques with primary legal materials, secondary legal materials and tertiary legal materials. The results of the research in this research are legal protection arrangements for the rights of women convicts based on statutory provisions contained in the 1945 Constitution of the Republic of Indonesia, Law Number 7 of 1984 concerning Ratification of the Convention Concerning the Elimination of All Forms of Discrimination Against Women, Law Number 12 of 1995 concerning Corrections, Law Number 39 of 1999 concerning Human Rights. The implementation of legal protection for the rights of female convicts in the Kuningan Class IIA Correctional Institution has been carried out but has not been implemented optimally and is still not effective, besides that excess capacity (over capacity) is an obstacle. Suggestions from the author are that the Kuningan Class IIA Penitentiary can find solutions to the problem of implementing convict rights based on Law Number 12 of 1995 concerning Corrections, especially for the rights of female convicts and the Kuningan Class IIA Penitentiary to find solutions to the problem of excess capacity because it becomes an obstacle in the implementation of the implementation of the rights of female convicts in the Kuningan Class IIA prison.   Lembaga Pemasyarakatan memang bertujuan untuk menghilangkan rasa bebas yang dimiliki oleh narapidana, tetapi penghilangan kebebasan tersebut juga harus mengacu kepada hak asasi manusia dari warga binaan yang harus dijaga oleh petugas pemasyarakatan. Dalam upaya perlindungan hak asasi manusia dalam Lembaga Pemasyarakatan khusus bagi perempuan, maka diperlukan perlakuan khusus bagi mereka dan Lembaga Pemasyarakatan diharapkan menjadi ujung tombak dalam pelaksanaan dan pengayoman bagi narapidana sehingga hak-hak mutlak dari narapidana itu sendiri dapat diberikan sebagaimana mestinya. Tujuan dalam penelitian ini yaitu untuk mengetahui bagaimana pengaturan perlindungan hukum terhadap hak narapidana wanita di Lembaga Pemasyarakatan Kelas IIA Kuningan. Metode yang digunakan dalam penelitian ini menggunakan pendekatan yuridis empiris dan teknik pengumpulan data dengan bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Hasil penelitian dalam penelitian ini yaitu pengaturan perlindungan hukum pada hak narapidana wanita berdasarkan aturan perundangan termuat dalam Undang-Undang Dasar Negara Republik Indonesia Tahun 1945, Undang-Undang Nomor 7 Tahun 1984 tentang Pengesahan Konvensi Mengenai Penghapusan Segala Bentuk Diskiriminasi Terhadap Wanita, Undang-Undang Nomor 12 Tahun 1995 tentang Pemasyarakatan, Undang-Undang Nomor 39 Tahun 1999 tentang Hak Asasi Manusia.  Implementasi perlindungan hukum terhadap hak narapidana wanita di Lembaga Pemasyarakatan kelas IIA Kuningan sudah dilakukan tetapi belum dilaksanakan dengan maksimal dan masih kurang efektif, selain itu kelebihan daya tampung (over capacity) menjadi kendala. Saran dari penulis yaitu supaya Lembaga Pemasyarakatan Kelas IIA Kuningan dapat mencari solusi permasalahan dari penerapan hak narapidana berdasarkan Undang-Undang Nomor 12 Tahun 1995 tentang Pemasyarakatan khususnya bagi hak narapidana wanita dan Lembaga Pemasyarakatan Kelas IIA Kuningan untuk mencari solusi dalam permasalahan kelebihan daya tampung karena menjadi kendala dalam pelaksanaan penerapan hak narapidana wanita di Lapas Kelas IIA Kuningan.

Abstract

The aim of this research is to find out about the implementation of the principle of simplicity in tax collection in Indonesia. Tax collection by the government must be based on the principle of simplicity. The principle of simplicity means that the taxes collected by the government must be easy and understandable by the public. Currently, it is estimated that Indonesians have around 40 identity numbers, including taxpayer identification numbers. So, to achieve the principle of simplicity in tax collection, the government issued a policy regarding the integration of NIK and NPWP as one unit in managing tax administration. This research is normative legal research with a deeper understanding of secondary information in the form of literature reviews and related laws and regulations. The results of this research show that the application of NIK to NPWP as a means of tax administration has been regulated in Law Number 7 of 2021 concerning Harmonization of Tax Regulations, and Regulation of the Minister of Finance of the Republic of Indonesia No. 112/PMK.03/2022 with the policy of integrating NIK and NPWP, it will have the potential to increase the number of taxpayers in Indonesia, as well as tax revenues in Indonesia.

Abstract

Good waste management is very necessary for good waste management to maintain a clean environment. According to Law no. 18 of 2008, the Government and regional governments are tasked with ensuring that good and environmentally sound waste management is implemented in accordance with the objectives of this Law. In the Kuningan Regency environment, waste management policies are supported by the Kuningan Regency Regional Regulation Number 4 of 2010 concerning Waste Management. Even though there is a regional regulation that regulates, problems regarding waste management still occur. One of the waste problems in Mancagar Village, Garawangi District, Kuningan Regency is that people throw rubbish into the river, causing environmental pollution. This is a lack of awareness among the local community regarding waste management. The research method used is an empirical juridical research method by examining the applicable legal provisions and what is happening in reality in the field with the aim and purpose of knowing and finding the facts and data needed, after the required data is collected then it goes to identifying the problem at hand. finally leading to solving the problem. Regarding the obstacles that occur in the Mancagar Village community, the Village Government already has strategies and steps to be taken in the future, but before this the Government must first increase awareness of the local community.
