Abstract

In their development, some countries have implemented electronic notarial deeds in their national legal system, especially in the need for the guarantee of the authenticity in electronic information. The provision which regulates authentic deeds is in UUJN (Notarial Act) and in the Civil Code which indicates that the use of notarial deeds and the drawing up authentic deeds are difficult to be implemented since there is no change in the understanding of authentic deeds stipulated in the notarial Act and in Law on ITE. The result of the research showed that the drawing up electronic deeds had become the beachhead of legal ground. For example, Article 15, paragraph 3 of UUJN and Article 17 of UUPT, include registration of electronic fiduciary deeds, registration of Notary electronically, amendment of articles of association of legal entity, etc. The obstacles of drawing up electronic deeds are influenced by some factors such as legal substance, legal structure, and legal culture. Abstract

Akitnese adhere to Patrilineal system in which sons play more important roles than daughters regarding inheritance. However, in practice, they distribute their inheritance to their daughters. Inheritance is supposedly given only to sons while daughters do not receive any of it. The research is a judicial empirical research with descriptive analysis using data resources consisting of primary and secondary data. Akitnese is eligible to be categorized into Customary Law Community viewed from physiological and sociological aspects of the existence of the customary law community. However, when observed from judicial point of view, Akitnese has not fully met one of the requirements to be categorized into Customary Law Community as stipulated in the Law No.41/1999 regarding Forestry in conjunction with the Regulations of Ministry of Domestic Affairs No. 52/2014 regarding Orientation for Recognition and Protection of Customary Law Community,namely  regarding the clear law area such as adat land. Inheritance distribution according to Akitnese customary law is held on the seventh day after the inheritor passed away. It is performed in three ways, namely grant (‘peninggal aeh heta’) by the testator during his/her life, through will and testament left for all heirs, and distribution after testator passes away. The efforts to settle the dispute over inheritance distribution for the Akitnese are taken with two ways, namely: a. musyawarah or a meeting leading to consensus (‘hapat/behonding’) among family members and Customary Musyawarah (‘hapat/behonding’).

Abstract

In establishing a CV (Limited Partnership), there are 2 types of partners: limited partner and active partner. Active partner acts as a managing partner in a CV. In its development, a problem arises as when the director dies so that the CV has to stop temporarily, including in its legal act toward the third party and vice versa. The result of the research showed that the position of the clause in the changing of active partners can be changed because of saisine principle concerning the right and obligation of the testator’s assets or financial liabilities adhered to his heirs. It is recommended that the regulation of CV should be confirmed, especially about the position and the liability of the new active partner of the CV. Abstract

Land is the bounty of God the Almighty which has great benefit so that it becomes the source of the creatures’ live in the world. judicial analysis on legal certainty in land registration  by minors and guardian’s custody showed that 1) the position of a minor as a legal subject in registering his land was that age limit or a child who requests for registering since 2015 has been 18 years, according to the Circulation Letter of Agrarian Affairs and Layout/the Head of the National Land Agency No. 4/SE/I/2015 on January 26/;2015 on Age Limit in Land Service. Abstract

The Indonesian Notarial Association in developing Notaries and supervision of Notarial Code of Ethics through the Notarial Supervisory Council that has the authority to develop Notary’s moral and ethics by conducting inspection on the violation against the Code of Ethics and imposing sanction on those who violate them. The role of the Indonesian Notarial Association in developing Notaries and supervising notarial code of ethics in North Sumatera is by giving input to the Notarial education to make the balance in notarial education and profession, providing code of ethics test, providing activity in increasing Notaries’ knowledge and morality, providing advocacy and assistance for Notaries who have problems, and imposing sanction on those who violate Notarial Code of Ethics.In implementing notarial development and supervising code of ethics, the Indonesian Notarial Association faces some obstacles: notaries’ population, integrity, indifference, and non-transparency toward organization. Abstract

Land transact in Salak Subdistrict is still done according to the custom; land transact is done before the Village Head, witnessed by the relatives of the seller and the buyer, and by Sukut Nitalun. Land status as a transact object in Salak Subdistrict is an adat land which has been used and cultivated from generation to generation and as an inheritance. The transferred plots of land are wet rice fields, rice fields, and land to be used for housing which have been controlled from generation to generation or from inheritance and from land transfer with buy and sell. Land transact in Salak Subdistrict is usually dine underhandedly; it uses only stamped paper or any paper with stamp and done it before the Village Head. Keywords: Land Transact, Pakpak Community

Abstract

Article 3, paragraph (1) of the Directive of Board of Directors of Bank Indonesia No. 23/69/KEP/DIR, on February 28, 1991 regarding Guarantee in Giving Credit states that guarantee is confidence of a Bank in debtor’s capacity to pay off his credit according to what has been agreed. In practice, there is the use of the Directive for Goverment Employee as a mortgage which will risk the Bank in giving a credit, let alone if the government employee is dismissed before retiring. The research used descriptive analytic method which described, explained, and analyzed the implementation of execution on non-performing loan by using the Directive for Government Employee, the position of mortgage, using the Directive for Government Employee when the debtor was dismissed, and the attempt of PT Bank Aceh, Sabang Branch, to settle non-performing loan when the debtor was dismissed. Abstract

According to the Islamic Law, a widow is an heir to her husband and receives a particular part of the inheritance because she is included into the group of people who has the right to inherit called Dzul fara-idh (the heirs whose part is specifically determined). Practically, the widow is often left alone without any descendant after her husband passes away; this was what happened in the case number 73K/AG/2015 that was taken for analysis. The research problem was how a widow without any descendant was positioned in her husband’s inheritance distribution according to the Islamic Law, how much her part was in accordance with the Islamic Law, and how the judge’s legal consideration was in handing out the Ruling of the Supreme Court on the Case Number 73K/AG/2015 in the Islamic Law. Abstract

Plantation is one of the biggest economic sectors in North Sumatera Province. Plantations in North Sumatera are dominated by oil palm, rubber, coconut, and cocoa. It is a promising sector for large profit so that legal entities and individuals are very interested in doing their business in plantation. Smallholders’ plantations are managed by individuals who do not have enough capital, compared with those which are managed by corporation. They only have on the average of two hectares or less, while they need sufficient capital to increase production. Not all land areas owned by planters are included in land registration system so that they cannot be used as collateral as it is stipulated in Law No 4/1996.                  Legal certainty has to be given to land right holders so that there will be the feeling of safety and reduce land conflict, so that what is intended by Article 33, paragraph 3 of the Constitution can be realized for the life of the nation and Indonesia. Abstract

A notary is a public official who is given the authority by the state tu draw up authentic deeds. He has to make them properly and correctly. If one feels the he is harmed by the deed, he can file a complaint against the Notary for not making it right as in drawing up a will. The research used juducial normative and descripstive analytic method by collecting primary and secondary data carefully. A deed can be legally null and void or revoked by court’s verdict when its material an formal requirements are not fulfilled. When it is revoked by court’s verdict, it will not have any legal force, and when it is revoked by the parties concerned it will become an underhanded deed. If a Notary makes a mistake in drawing up a deed, civil, criminal, administrative, or code of ethnics can be imposed upon him. Keywords: Revocation of Deed, Illegal Act, Notary’s Liability
