Abstract

The problems of the research were what were the Judge’ considerations in settling the case in the Verdict of the PK (Judicial Review) No. 37 PK/TUN/2013, how the legal efforts of PT. Pelabuhan Indonesia I, and how the execution of the Verdict of the PK No.37 PK/TUN/2013 was. In order to find the answers to the problems, this research was descriptive analytical. The Judge’s considerations in the Verdict of the PK No.37 PK/TUN/2013 regarding the annulment and revocation of the certificate was in line with the procedure. The legal efforts that could be made by PT. Pelindo I (Persero) was applying for the establishment that the invalidation was nonexecutable, making remeasurement of the land and making resistance. The Verdict of PK No. 37 PK/TUN/2013 regarding the annulment and revocation of the certificate of Management Rights No.1/1993 belonging to PT.Pelindo I (Persero) could not be executed (non-executable). Abstract

The Law on Marriage Property regulates the legal consequences on the husband and wife’s property. The arrangement of marriage property can be seen from how they obtain the property. The object of the research was the Verdict of Medan District Court No.290/Pdt.G/2013/PN regarding the settlement of the personal property that has been made joint property. The problem discussed in the analysis of this research was: how to classify the property that was received after the marriage has been dissolved and how about the legal consequences toward the inheritance that was not distributed yet, how the trade between mother and son/daughter is in accordance with positive law in Indonesia, and how the judge’s legal considerations were in the Verdict of Medan District Court No.290/Pdt.G/2013/PN.Mdn. the research used descriptive analytical and judicial normative method. Abstract

Standard contract is a binding agreement of the stakeholders who sign it. Any loss which occurs later will be their responsibility, based on the clause of the contract, unless the clause is forbidden according to Article 18 of Law No 8/1999 on Consumer Protection. The analysis of the research is the Supreme Court’s Ruling No. 368/Pdt.Sus-BPSK/2013 in examining a special civil case on complaint about the Decision of Consumer Dispute Settlement Body in the cassation appeal between PT Express Limon Nusantara as business person and Dedek Cahyo as consumer. The research used theory of legal certainty with judicial normative and descriptive analytic methods. The ruling should have the sense of justice for those who should get legal protection so that legal certainty and justice in handing down a ruling so that there will balance in the ruling. A judge has to be fair in his ruling and give sanction upon consumers who have breached a contract. Keywords: Standard Contract, Business Person, Consumer

Abstract

In conclusion, Notary’s PHGR Deed also has proving legal force as the ground of the right when the title is to be registered for receiving the land ownership right and also having legal force to prove as evidence in court of justice. This is proven in a decision of the rulling of district court No.76/Pdt//2014/PT-Mdn dated April 16,  which has won PHGR deed as the land owner. This showing that even the right of land certificate is a letter evidence of right that happened as a strong and perfect, but if physical date and or judicial date on it has wrong, so will be a weak evidence. In this case the officer which is issued proof of the right do not pay attention to the principle of accuracy to the ground object, in the issueance of the certificate. The principle of the negative publicity that is practiced in our country open opportunities to do the rebuttal although the land who has registered his rights in the national land agency. So with the notarial deed which is the authentic deed that has been set by law. There is a good Notaries still act professional, by using the principle of awareness with first make sure that the PHGR deed have legal certainty before making it. Abstract

Sumatera Utara is one of the provinces in Indonesia having several agricultural products which are potential to be the geographical indication. The agricultural product produced by each region in Indonesia have certain characteristic caused by the natural and human factyors or the combination of both of them which distinguish the agricultural product of the same kind originating from different regions in Indonesia. The purpose of this descriptive analytical normative juridical study was to describe and analyze the problems related to the registration of geographical indication of agricultural product in Sumatera Utara discussed in this study. The data for this study were the secondary data obtained through library research in the forms of the regulations or legal materials. Based on the result of this study, the conclusion is that: (1) Mandailing Coffee, Lintong Coffee, Sidikalang Coffee, Deli Tobacco, Binjai Rambutan are several agricultural products which are potential to be the geographical indication originating from several regions in Sumatera Utara, (2) the protection for geographical indication of agricultural product regulated by the law and government regulation is not yet effectively implemented, and (3) the constraints occured during the registration of geographical indication of agricultural products in Sumatera Utara in terms of regilations of legislation, role of government, and the farmers as the producers of georaphical-indicated agricultural products. Abstract

System of industrial design registration in Indonesia adopts a constitutive, who got / obtained the certificate of industrial design from the Ministry of Law and Human Rights are the holder of Design Indutri, although the provisions of Article 2 of Law No. 31 of 2000 on Industrial Designs entails the principle of novelty (novelty). The principle of novelty in the Law on Industrial Designs set with a first application filed and at the time of registration was filed, no other party can prove that such registration is not new or existing disclosure/ publication, whether written or unwritten. Consideration of the legal panel of judges in the Central Jakarta Commercial Court decision number 49/Industrial Design/2004/PN/Niaga.Jkt.Pst is already appropriate, given Shower Scrub registration bangkoang Sari has been qualified novelty (novelty), the Plaintiff is the first registrant who apply Packaging Industrial Design registration Sari bangkoang Shower Scrub. Abstract

A Notary is a public official who has the authority to draw up authentic deeds and the other authorities as it is stipulated in Law No. 2/2014 on Notarial Position. Notary, in undertaking his job, enters into a agreement which bounds him with the stakeholders that causes legal relation so that each party is legally protected and the goal can be achieved as what has been agreed. The research was descriptive analytic. A Notary’s responsibility in drawing up a sales contract which is indicated as default is in the civil case. The process of settling it is also impeded probably because of the weakness of the regulations, these have made it difficult to settle the case of Notary X. The sanction imposed upon a Notary in drawing up a sales contract which indicated as default is civil sanction such as compensation for the cost, indemnity, and interest. Abstract

Before PP (Government Regulation) No. 54/2007 on the Implementation of Child Adoption was in effect, a Notary played his role in drawing up Child Adoption Certificate. At that time, child adoption was legal when there was a Notarial Deed. The reasearch shows after PP No. 54/2007 An Adoption Certificate which was made by a Notary before PP No. 54/2007 was in effect is valid and it is final and conclusive for those who made it before a Notary. This is in accordance with the transitional provision which states that by the time this PP is in effect all regulations on adoption are valid as far as they are not contrary to the PP. The role of a Notary in drawing up Adoption Certificate after PP No. 54/2007 is in effect is providing counseling and consultation for those who are involved in child adoption in order that people get information and understand the requirements and   procedure of child adoption. Abstract

By enacting Financial Service Authority Regulation No. 32/POPJK.04/2014 and No. 33/POJK.04/2014, it is certain that there is the amendment in both regulations on Law No. 40/2007; its legal consequence is that a public corporation must adjust its Article of Association both Financial Service Authory regulations. The research used descriptive analytic and judicial normative method. It can be concluded that there are some changes in the both regulation when they are compared with Law No. 40/2007. The changes are made to adjust them to the current needs in order to increase the level of good corporate governance of issuer or public corporation, to maximize the role of board of directors and board of commissioners of issuer or public corporation so that corporation can run positively. The legal consequence od enacting both regulations is that public corporation must readjust it Article of Association within 1 (one) year after both regulations are enacted. Abstract

Since there is no regulation on a group company in Indonesia, it has its own loophole in the law about the liability of holding company in co-financing subsidiaries although Law No. 40/2007 on Corporation states that a holding company and a subsidiary are independent legal entities. The conclusion of the research was that the holding company, Chuan Son Huat Industrial Group (CSH) which co-financed its subsidiary, PT. Cemerlang Selaras Wood Working (PT. CSWW) cannot be categorized as money because it does not meet the elements of the phrase, ‘in amount of money’, and the phrase, ‘based on the agreement’. It is recommended that, in having legal certainty concerning law and liability in group companies, Law No. 40/2007 on Corporation be completed and strengthened. The judges who pronounce judgment on bankruptcy cases and other cases which involve holding companies and subsidiaries should be guided by the principles of legal person, separate legal entity, limited liability, and piercing the corporate veil in order to create legal certainty.
