Abstract

A hypothecation is the right over a mortgaged piece of land as stipulated in the Law No. 5/1960 on Land Act, along with or without other things which constitute to the land, to pay off a certain debt, which puts one particular creditor in higher priority than the others. When a debtor wants to pay off all his debts with the extended hypothecation and the Hypothecation Certificate is missing, the Notary makes Cancellation Consent Deed or Cancellation Hypothecation Permit Deed. The results show that the role of Cancellation Consent Deed is necessary to substitute the missing Hypothecation Certificate. It plays the role of a living law. Some Notaries mention that the clause is based on the report of missing, but some others do not mention it in the deed. This difference does not lead to a dispute because it is not specifically regulated. Due to the frequency, this habit can be said to be legally acceptable without any regulation and it applies to any party and there is not any rejection from any party to it. Abstract

In the fiduciary guarantee, the object that becomes the fiduciary object is still in debtor’s possession, not in the creditor’s, so the handing over of ownership of the object is carried out without handing over the object physically.The Article 23 in the Law No. 42/1999 on Fiduciary Guarantee, a debtor must not transfer, pawn or rent to another party the object of the Fiduciary Guarantee which is not a supply, unless there is a written approval from the creditor.The results show that the title of the fiduciary object in the fiduciary agreement is transferred to the creditor, while the property is still kept by the debtor. In other words, the debtor is not legalized to transfer the fiduciary object to the third party and any transfer made without the creditor’s approval becomes null and void. The liability of the debtor who has transferred the fiduciary object is to indemnify the restoration into the former condition because he has committed an unlawful act, he is convicted by the penal law and sentenced by maximum of 2 (two) years’ imprisonment and fined by maximum of IDR 50,000,000.- (fifty million Rupiah) pursuant to Article 36 of the Law No. 42/1999 on Fiduciary Guarantee. Abstract

Putusan Mahkamah Konstitusi bisa merubah hubungan keperdataan dari manusia yang satu dengan manusia yang lain. Bukan hanya didalam hal perusahaan atau negara saja, tetapi orang dan keluarga juga termasuk didalamnya. Dapat dilihat dari putusan Mahkamah Konstitusi yang baru, dimana perkawinan yang sah atau tidak, bukan hanya mempengaruhi kehidupan dari kedua belah pihak, antara pria dan wanita saja. Melainkan sah atau tidaknya perkawinan  juga mempengaruhi status dari anak yang dihasilkan dari sebuah perkawinan ataupun hubungan gelap ayah biologis dengan ibu dari anak tersebut. Sebelum putusan baru ada hanya ibu dan keluarga ibu yang mempunyai hubungan keperdataan anak diluar nikah, tapi untuk sekarang anak diluar nikah juga sudah memiliki hubungan keperdataan dengan ayah biologisnya apabila bisa dibuktikan dengan test DNA. Setelah diputuskan oleh pengadilan, maka ayah yuridis yang telah menikah secara sah dengan ibunya secara otomatis tidak ada hubungan keperdataan lagi dengan anak dari istrinya.   Kata kunci : putusan, anak, ayah biologis

Abstract

The philosophical bases of OJK fee from the profession of capital market support are the 1945 Constitution, and Article 34 of Law No. 3/2004 on Bank Indonesia as the basis for the birth of Law No. 21/2011 on OJK in which Article 37, paragraph 6 indicates the provision on fee regulated in PP No. 11/2014 on OJK Fee from those who perform their activity in financial service sector. The positive effect of OJK fee is that it will be used for administrative activity, the procurement of assets and other supporting activities which can be used by industry (recycling), and for professions in financial service sectors. Its negative effect is that it will decrease the trust of professionals in professional associations like Notarial Profession, INI. If the fee is not paid, sanction in fine and administration will be imposed. Judge’s legal consideration is that OJK fee is not contrary to the 1945 Constitution and to the other legal provisions; therefore, the request for judicial reviews is not reasonable because it is not in accordance with Law No. 21/20011 on OJK. Abstract

The role and liability of the Notary are to ensure whether the call for the RUPS (General Meeting of the Shareholders) is made which is in line with Article 82 of the Law on Limited Company, includes the agenda of the RUPS, ensures that the stakeholders attending the meeting matches the most recent list of the shareholders, makes minutes of the meeting and is responsible for the application of the addendum of the article of association to the Minister. The obstructions are caused by some factors such as the limited company incomplete data, management, application cost, unregistered addendum of the article of association, unsuitable data, Notary’s negligence and weakness in the laws. Moreover, the legal consequences to the Limited Company for its late application of the addendum of the articles of association to the Minister or that the addendum has not been recorded in the Limited Company List run by the Ministry of Law and Human Rights is that the Ministry can refuse all applications for then addendum. Consequently, it will cause difficulty for the limited company when it needs some credit from the bank because the bank will require a memorandum of association or its last addendum of articles of association. Abstract

A Notary is a public official who has the authority to draw up authentic deeds and the other authorities as it is stipulated in Article 1868 of the Civil Code. A foundation as a legal entity is established by using a notarial authentic deed. Therefore, a Notary plays an important role in the establishment and the authorization of a foundation as a legal entity. The research used juridical normative method. It also used descriptive analytic method. The result of the research showed that the regulation on making a deed on the amendment of statutes and the structure of foundation management according to Law No. 16/2001 in conjunction with Law No. 28/2004 on Foundation states that the amendment can be done according to the decision of the patron’s meeting which is presented by 2/3 of them. The Panel of Judges’ consideration and the analysis on the legal consideration in the Supreme Court’s Ruling No. 1873 K/Pdt/2012 is that the revocation of the notarial deed No. 2/2004 on November 3, 2004 made by Notary/PAAT ST as the defendant III is in accordance with legal provision because the making of the deed is illegal and legally defective. Abstract

Erdemu impal marriage is an adat marriage in the Karo community in which the bride has the same impal kin (the daughter of the groom’s uncle who is his mother’s brother). This marriage is favored by the Karonese community because of dome reasons: the inheritance will be received only by their relatives, keep the kinship in the big relatives, and there are some worries about the looseness of kinship in the big family when a girl gets married with a man who is not close to the family so that there will be conflicts in the family. The research used juridical empirical and descriptive analytic method; the result of this research was expected to provide complete and systematic description on the legal consequence of divorce in the ‘erdemu impal’ marriage. At Kelurahan Lau Cimba, Kabanjahe Subdistrict, Karo Regency, North Sumatera. The result of the research showed that this type of marriage is performed in adat (custom), and it is not registered in a legal Marriage Institution. In reality, marriages which occur at Kelurahan Lau Cimba, Kabanjahe, Karo Regency, have no divorce since this type of marriage does not recognize divorce (mulih) since the bride and the groom are still close relationship. If there is a divorce, it is because of death which seperate them, and it is in accordance with the religious doctrine. The legal consequence of marriage is the same clan with what happens with the other marriages when they are in accordance with religion, adat, and the prevailing regulations. When there is disharmony in this marriage, it will be settled by the family and relatives of both husband and wife until the adat leader. Abstract

In performing his duties, a Notary has to comply with the provisions and rules stipulated in the Laws and other regulations determined by the Association of Indonesian Notary. When a Notary makes a mistake related to his professionalism, the Court of Notary is the only authorized institution to verify and hand a decision down to him, held by a hierarchical Supervisor of Notary. The problems in this thesis are about the mechanism of Notary Supervisory run by the MPD (Regional Supervisors), what kinds of Notary’s actions can be prevented from by the MPD, and how about the role of MPD to prevent a Notary form committing actions contrary to the Notary Act. There were 3 informants in this research; namely, 2 notaries and 1 Secretary of Regional Supervisor of Medan. The mechanism of the notary supervision conducted by MPD consists of some stages. The form of violations or prohibitions for a notary pursuant to the Notary Act and the mostly recommended sentence from MPD to MPW is a written warning. The role of the Regional Supervisor of Medan to manage and supervise a notary is firstly, to implement a preventive and curative supervision by preventing the Notary from committing violation and managing the Notary; and secondly, to conduct socialization to relevant parties. Abstract

A substituted Notary is a person who is temporarily appointed as a Notary to substitute a Notary who is on leave, sick, or temporarily involuntarily absent. The requirement for appointing substitute Notary is different from the actual Notary, but his task and responsibility are the same as that of an actual Notary. The research used juridical normative and descriptive analytic method, supported by interviews. The data were gathered by conducting library research and documentary study and analyzed qualitatively by describing them in the form of sentences and drawing conclusion. Theconclusion of the research was that, based onArticle 65 of Law No. 2/2014 on Notarial Position, a substitute Notaryis liable for every deed he has made even though Notarial Protocol has been submitted to the person in charge of Notarial Protocol. It means that substitute Notary is always liable for the deeds he has made although his tenure ends. Keywords : Liability of Substitute Notary, the End of Tenure

Abstract

One of the government's methods to carry out land acquisition for public interest is by issuing Law No. 2/2012 on Land Acquisition for Public Interest and its Administrative Regulation (PP No. 71/2012). Its implementation has to be done by performing negotiation and reasonable price for the land owner by sticking to the principle of justice so that his economic condition will be better. The result of the research showed that land acquisition for the construction for public interest in small scale is regulated in Law No. 2/2012 in conjunction with PP No. 71/2012 as it has been amended four times and the last one is PP No. 148/2015 which states that the land acquisition for the construction for public interest in small scale is started by with the area from one hectare until five hectares. Its procedure begins with establishing land acquisition committee, determining permit for location, and determining land price with SK No. 1230/KAT/1/2013, SK No. 325/IKA/VI/2013, andSKNo. 492/160/2013 respectively on June 3, 2013. The obstacles faced by the Aceh Tamiang District Administration in implementing land acquisition for the construction of traditional market is the lack of socialization about the implementation of the project and the low price proposed by the Land Acquisition Committee for the construction of traditional market in Aceh Tamiang Regency.
