Abstract

Notary’s protocol is a part of the administration in a notary’s office which plays a very essential function and role so that the notary can perform his duty well and properly. It is a State’s archive that has to be organized and managed well. Therefore, it has to be treated like a State’s document which has to always be saved and conserved to remain authentic. It has to be kept and preserved in any condition even though the notary takes leave, retires, or passes away. However, despite the safe management, notary’s protocol may be damaged due to the paper age that only lasts about ten years, eaten by termites, missing because of natural disaster that strikes the area where notary’s office is located, or missing due to its holder’s negligence. Abstract

Inheritance Law is a part in the Civil Code in a whole and is the smallest part of the Law of Mutual Cooperation. Therefore, it is necessary to have a strict regulation which meets the elements of legal consequence in making a latter of notification of heir which is the proof of heir, either concerning the official’s authority that makes it or the procedure of making it. With the Letter of Notification of Heir, an heir can show a proof of being an heir when a problem arises related to the determination of heirs of the dead person. It is a proof so that the problem can be settled. It is a proof for the society to correctly find out who is the rightful heir for the property inherited by the dead person; thus, the heir can show the letter of notification of an heir as evidence so that the case can be solved. This letter of notification is evidence for the society to properly find out the rightful person for the inheritance which is used as the ground for its distribution to the rightful person and/ or how much the part belonging to the heir either according to the legitimate portie or the will. Abstract

The case in the Ruling of the Supreme Court started with the extension of the Leasehold of anentity named PT.Pertekstilan TD.Pardede. According to the Law No.5/1960 on the Land Actwhich states that the Leasehold of an entity can be extended. The party who is liable for theextension of the Leasehold is the director, pursuant to the Law No. 40/2007 on Limited LiabilityCompany. However, when arranging the extension of the Leasehold, the director found obstaclesbecause the Leasehold Certificate was being saved in the safe deposit box blocked by theshareholder of PT.Pertekstilan TD.Pardede causing loss to the company. The research is doneby employing the normative juridical approach with descriptive analysis. The results show thatthe handing of the Leasehold to an entity must be completed with the decree of the ministery ofjudge concerning entity Legalization and announced in the state news, a reference letter from astate bank which shows the applicant’s bonafides, preliminary study in affording the land andexpert availability. The shareholder’s liability for the extension of the leasehold is enforceableto, in this case, open the safe deposit box so that the Leasehold Certificate can be taken andsubmitted to BPN (the Land Office) for the Leasehold Extension. The consequence for notextending the Leasehold is that it will be eliminated, and the land will be returned to bepossessed by the state.Keywords: Shareholder, Extension, Leasehold

Abstract

The research results show the Islamic Law views  that transgender is illegitimate because it is contradictory to the Qoran Al Hujarat Verse 13, Buchari’s tradition relating to the sayings and deeds of The Prophet Muhammad and the ulemas’ view, especially, the legal decision of Indonesia Ulemas No. 03/UMNas-VII/MUI/2010. However, if the purpose is to repair the sex, it is legitimate/permitable. The legal consequence of  transgender in Indonesia is based on Article 56, paragraph 1 of LawNo.1/2013 about the Amandement on Law No.23/2006 about the Population Administration is that those who transgender should apply for their new sex legitimacy to the Court and change their population data, especially, on the sex in the Demography and Civil Regestry Office by bringing along the legal decision. The Islamic Law views the marriage of those who perform sex reassignment surgery is illegitimate because in principlethey have married with the same sex. Abstract

Notary is a public official who makes authentic deed. Notaries running his positition as a public official,an addition to abiding by the rules of office, also bounded by the oath of office which has taken at the time he appointed as a notary, such as keep the contents of the deed and the information obtained. This research is normative. The collection of data’s from the literature study were analyzed qualitatively describing as well as analyzing the existing problems, in this case used deductive-inductive method which will be drawn the appropriate conclusions. The results showed a Notary as a public official who makes authentic deed, must keep the contens of the deed it self and any information obtained in the office, caused by the Notary as a public official who has the privilege, namely the right of refusal, name the right not to give testimony. Legislation requires the provision and protection of the Notary function, in particular in terms to dublicate the minuta. In article 66 parargraf (1) of the Law of the Notary office of the honorary Council approval Notary is to give the application. If  the Notary negligent or careless in performing their duties as a public official who makes authentic deeds, notary can been issued by the parties or clients were dissatisfied or feel disadvantage as a result of an authentic deed made by the Notary, Notaries in this case may be sued in civil and criminal, and accountability morally, ethically an legally to the public. Abstract

A witness, in general, is someone who provides an oral or written testimony describing what he himself sees (waarnemen) someone’s action or deed or a situation or an event. In every legal event, including the making of a certificate by a notary, the witnesses must be presented. They are themselves the ones who witness and see the legal event. Two kinds of witness are recognized in the notary, instrumental witness and known witness. An instrumental witness is an absolute witness obliged to be present at the making of a certificate by a notary and a known witness is a witness introduced to the notary by the person appearing. Article 40 of Law No.2/2014 on position of notary regulates about this witness where terms of a witness are stipulated. One of the terms is that a witness in not allowed to have a marital relationship or blood relationship in a straight line above or below without degree limitation and side line to the third degree to the notary or the parties. Abstract

Legitimate marriage gives legal consequence on joint property. The provisions regulate joint property in the Marriage Law No. 1/1974. This thesis analyzes the transfer of Land and Building Rights after a divorce and the Ruling No. 30/Pdt.G/2013/2013/PN.MTR.  The research problems are as follows: how about legal protection for a married couple on joint property sold by one of them   after the divorce, how about the legal domicile on land building rights of joint property which does not exist in the Marriage Certificate, and how about the judge’s legal consideration in the Ruling No. 30/Pdt.G/2013/2013/PN.MTR on the transfer of land rights after a divorce. The research used juridical normative and descriptive analytic method. Primary data were obtained from Law No. 1/1974 on Marriage, the Civil Code, and PP. Abstract

A brand is a sign or a group of signs which can distinguish goods and services of one company from the other companies. For the recognition of a certain brand, the owner of the brand has to register it to the Directorate General of HAKI. In the verdict in the Commerce Court No 68/Pdt.Sus.Merek/2014/PN/Jkt.Pst, there a case of dispute in brand registration in which KOI and KONI compete over the Logo of Olympics Five Rings. The research problems include the existence of Logo of Olympics Five Ring in Indonesia, the evidence of the dispute in brand registration between KOI and KONI in the Commercial Court No. 68/Pdt.Sus.Merek/2014/PN/Jkt.Pst, and judge’s legal consideration in the Verdict No 68/Pdt.Sus.Merek/2014/PN/Jkt.Pst.

Abstract

Property separation agreement is dine to separate joint property. Its consequence is that joint property in a marriage there are only a husband’s personal property and a wife’s personal property. Property separation agreement will influence the distribution of inheritance to heir(s) when one of the married couple dies. The Supreme Court’s Ruling No. 804/Pk/Pdt/2009, there is a case when the husband loses his right to be the heir of his wife because they have made property separation agreement. The research problems are how about the legal consequence of property separation agreement in a marriage, how about the legal protection for an heir on the inheritance of one of them as the result of property separation agreement, and the judge’s legal consideration in the Supreme Court’s Ruling No. 804/Pk/Pdt/2009. Abstract

Every married couple longs for a child as an offspring and an heir. However, it is sometimes not realized; therefore they usually adopt a child to be raised and treated as their own biological child. Adoption in the Batak Toba community uses local adat law which does not have any strong evidence. As time goes by, the  child becomes an adult, raised by his adoptive parents. Then, his biological parents intend to take him from his adoptive parents. The research problems are as follows: how about the mechanism of adopting a child in the Batak Toba community, how about the position of an adopted child, adoptive parents, and biological parents in adopting a child underhandedly in Batak Toba community, how about the legal remedy of the adoptive parents when the adopted child is taken again by his biological parents underhandedly in Batak Toba community in Simanindo Subdistrict, Samosir Regency.
