Utary Maharany Barus Mortgaging tanah pusako tinggi (ancestral land) in Minangkabau is also called „pagang gadai‟ which is done when it is in emergency such as „Mayik tabujua ateh rumah‟ (the deceased lies in the house), Gadih gadang alun balaki (A girl who can be a spinster), Rumah gadang katirisan (rumah gadang is utterly damaged), and „Membangkik batang terandam‟ (to save from oblivion). Pagang gadai in Nan Sabaris Subdistrict is social matters to help each other in the adat community of Minangkabau. DOSEN PEMBIMBING:1. Sunarmi2. Muhd Yamin3. T. Keizerina DeviA Various kinds of collateral in banking system cannot be separated from thedynamic business development. One of them is stalls as collateral. A stall cannotbe categorized as real property rights as stipulated in Book II of the Civil Code sothat the binding of credit security for a stall cannot use real property rightinstitution such as hypothecation, mortgage, pawn, and fiduciary. Therefore, theabsence of norm will be substituted with cessie institution in banking system in acredit contract for stalls. What factors which influence the use of cessie and howabout the legal domicile and consequence for a Bank as creditor are analyzedbased on legal provisions on collateral. The use of cessie institution in thebinding of stalls as collateral has its legal consequence that the bank legaldomicile toward the stalls as collateral is only as unsecured creditor so thatjuridically it cannot give security for paying off credit because it does not haveany executorial power as intended by credit security institution. When a debtordefaults, creditor will have difficulty to cash the collateral of the stalls. In thiscase, legal protection for creditor is weak.Keywords: Cessie, Collateral, Stalls

Edy Ikhsan Leasing contract today becomes a profitable business opportunity although it also has the risk for the damage of the house after the time period of the leasing ends. The damage will, of course, harm the owner. The research used juridical normative method Its nature was descriptive analytic which was aimed to describe, explain, and analyze the problems, and find the correct answers as the solution of the problems. The result of the research shows that the implementation of the principle of a good host as a tenant in a leasing contract is that the tenant has to be responsible to maintain, take care of, and look after the house he is renting. The Panel of Judges’ legal consideration in the Supreme Court’s Ruing No. 2542.K/Pdt/2016 on the dispute in renting a house is that the damage of the house owned by I Nyoman Yudhiawan is because the tenant defaults (breaches of contract) in carrying out the points of the leasing contract, especially on the principle of a tenant who has to be a good host for the house he is renting.Keywords: Tenant, Good Host, House Rent

Mahmul Siregar The Government Procurement Policy Institution as a Non-Ministerial Institution established based on Presidential Regulation No. 106 Year 2007. This research is done through normative juridical approach which is descriptive approach. Sources of research data is obtained from literature and field research. Then analyzed by using qualitative analysis that describes as well as analyzing important data then drawn a conclusion to get the answer from the problems that exist in this case used inductive method.The result of this study that the implementation of the principle of procurement of goods / services that are clean and free of corruption, collusion and nepotism in electronic procurement based on Presidential Regulation No. 54 of 2010 and its changes are; efficient, effective, transparent, open, competitive, fair / non-discriminatory and accountable. However, in its application there are often disharmonization of regulation or overlapping regulation causing legal uncertainty to the implementation.Keywords: e-procurement, government, effective.

Abstract

One of the methods of preventing from the incidence of dispute in distributing inheritance is by giving it by the parents to thei children while they are still alive. In this case, some people give all of their property to only one of their children and ignore the other children’s right. It, of course, violates against the inheritance law stipulated in KHI (Compilation of the Islamic Laws). The result of the research shows that the regulation on hibah which is regarded as inheritance is stipulated in Article 211 of the KHI. When parents grant their property to all or one third (1/3) of their children, they must get agreement or approval from the other heirs. According to Compilation of the Islamic Laws, if one or more heirs complain about the distribution of inheritance or feel harm, negotiation has to be carried out among them or they can bring the case to the Religious Court to revoke the hibah or distributed it according to Compilation of the Islamic Laws. The review of the Supreme Court’s Ruling No. 10 PK/AG/2006 revokes the judge’s consideration in the Highest Appellate Court which states that the hibah is valid as ampikale is correct and the property is distributed to the other heirs according to their own shares.Keywords: Hibah, Inheritance, Compilation of the Islamic Law

In order to optimize the city development, the municipal land-use plan needs to be directed in the municipal spatial plan consisting of spatial structure and pattern. Article 11 paragraph (2) of the Law No. 26/2007 on Spatial Plan states that a municipality has the authority to the implementation of its spatial plan, including the municipal spatial plan, land-use plan and land-use control. Abdul Rahim Lubis The role and liability of the Notary are to ensure whether the call for the RUPS (General Meeting of the Shareholders) is made which is in line with Article 82 of the Law on Limited Company, includes the agenda of the RUPS, ensures that the stakeholders attending the meeting matches the most recent list of the shareholders, makes minutes of the meeting and is responsible for the application of the addendum of the article of association to the Minister. The obstructions are caused by some factors such as the limited company incomplete data, management, application cost, unregistered addendum of the article of association, unsuitable data, Notary’s negligence and weakness in the laws. Moreover, the legal consequences to the Limited Company for its late application of the addendum of the articles of association to the Minister or that the addendum has not been recorded in the Limited Company List run by the Ministry of Law and Human Rights is that the Ministry can refuse all applications for then addendum. Consequently, it will cause difficulty for the limited company when it needs some credit from the bank because the bank will require a memorandum of association or its last addendum of articles of association.Keywords: Limited Company, Notary, Application of Addendum of Articles of Association to the Minister.

KEIZERINA DEVI A   Basically, each birth should be reported to the related Agency at least 60 (sixty) days since the birth and the registration which exceeds 1 (one) year deadline should be carried out according to the Court's Verdict as stipukated in Article 32, paragraphs 1, 2, and 3 of Law No. 23/2006 on Aminduk (Population Administration). There is a problem in Article 32 of Law on Aminduk so that it has to be judicial reviewed, and now it is considered legally invalid.The objective of the research is to find out 1) the implementation of makinng birth certificates according to Law No. 23/2006 on Aminduk and the Constitutional Court's Ruling No. 18/PUU-XI/2013 at the Dukcapil (Civil Registry and Population) Office of Medan, 2) the consequence of the Constitutional Court's Ruling No. 18/PUU-2013 on protoviding birth certificates which exceed the deadline in the pre and post the Constitutional Court's Ruling No. 18/PUU-XI/2013 at the Dukcapil Office of Medan, and 3) the obstacles faced by the Dukcapil Office of Medan in providing certificates which exceed the deadline in the post Constitutonal Court's Ruling No. 18/PUU/XI/2013 and the efforts to handle the obstacles.
