Abstract

Suprayitno Notary is a Public Official as written in the Law of the Republic of Indonesia No. 30/2004 in conjunction with the Law No. 2/2014 on Notary, in Chapter I on General Provisions. This is a normative legal research, which is descriptive analytical, which approach to the problems done by studying the provisions in the prevailing laws and regulations in the field of notarial law, in this case, UUJN (Notarial Act) No. 3/2004 in conjunction with UUJN No. 2/2014. The results of the research finds out that the legal status of the notary candidate who is a former juvenile prisoner, with the provisions in Article 3 letter (h) of UUJN-P No. 2/2014. Article 28 D paragraph (1), (2), (3) and (4) of the Constitution 1945 has firmly secured human rights to have an occupation, to make a living that is decent for the benefit of humanity, as long as the occupation is not contrary to the laws. The validity of the provisions in Article 3 letter (h) of UUJN-P No. 2/2014 can be revoked by performing the rights of Material Test to the Constitutional Court so that the former juvenile prisoner can also be designated as a notary.Keywords: Legal Partiality, Former Juvenile Prisoner and Notary Designation

Mahmul Siregar The form of online clothing purchase agreement protected by ITE (Law on Electronic Transaction) Act in Indonesia is not specifically regulated in legislation in Indonesia, but it does not make a legal vacuum. With a special regulation governing this virtual agreement, it automatically agreements on the internet are subject to ITE legislation. Regarding electronic trading transactions, inseparable from conventional concepts of agreements as contained in those articles essentially describes the engagement of parties on the basis of the needs of each party to derive the achievement of the agreement. The contract on buying and selling clothes by online which is legally protected by ITE is an agreement in the form of electronic. Electronic document in UUTE is meant as electronic information which is made, forwarded, sent, received, or kept in an analogue which can be seen and displayed through computer or electronic system.Keywords: Legal Protection, Stakeholders, Buying and Selling Transaction, Through Internet Media

Syafnil Gani Land has an important status in Customary Law because it is the only property which in spite of any condition will remain in the original state. Land title can be transferred by: Trading, Inheritance and Bequest. The selling method commonly applied by Mandailing people refers to Customary Law. This thesis discusses the frequently encountered problems in land trading among the society i.e. the land trading in which the land seller and buyer has a dispute over the buyer with good faith who has not made full payment, and the legal protection for the buyer with good faith who has paid part of the price with the agreed amount of money in advance when the seller does not acknowledge that his land has been sold. It can be concluded that the trading method performed by Mandailing people refers to the Customary Law. The preserved method is the culture that has been implemented for years by Maindailing people from generation to generation, but the long process of making the legal basis for the land so that it can become evidence that the transaction is actual, proofing that the title of the land has actually been transferred to the buyer which time limit is not made that it can cause uncertainty and dispute in the future.Keywords: Land, Trading, Customary Law

Tales Inti Sawit is a company which operates in PKS (Oil Palm Processing) Plant established with Memorandum of Association No. 28 on August 11, 2003 which has gotten the validity from the Minister of Justice and Human Rights No. C-30204 HT.01.01.TH.2003 on December 30, 2003 . The HGB was from HGU (Leasehold) owned by PT. Tamiang Sari in the area of 20 hectares of the total 494.57 hectares. The establishment of PT. Tales Inti Sawit was from the cooperation agreement between PT .Tamiang Sari and PT. Duta Marga Lestarindo. The transaction was bound in a contract under NJOP (Taxable Value of Property), followed by investing the capital. Meanwhile, according to Tax Law No. 16/2009, the basis for tax assessment is the true/appropriate transaction value which is in accordance with the value the sales object in the transaction. The research used juridical normative and descriptive method, using primary data supported by secondary and tertiary data. The data were gathered by conducting library research and interviews. The result of the analysis showed that BPN RI (National Land Agency) had implemented the process of the request for the right and title transfer of the Process of Request for Separation a part of HGU owned by PT. Tamiang Sari which had implemented even though its procedure was complicated and took a long time by the permit of releasing a part of HGU No. 14-V.B-2004 and was bound in a Sales Binding Contract with the price below NOJP. This research is entitled “A Legal Analysis of Tax Charge to the First Application of Land Title and Its Registration in Medan.” The research problems are what taxes are charged to the first application of land title and it registration in Medan and how the justice principle is fulfilled in the provisions of tax charge to the first application of land title and its registration in Medan. This is a normative legal research which is analytical descriptive. It uses secondary data consisting of primary data such as the Law No. 36/2008 on Income Tax and the Law No. 28/2009 on PDRD (Regional House of Representatives) and the regulations related to the laws, secondary legal materials such as books and tertiary legal materials such as general dictionaries and legal dictionaries.Keyword: Tax, Land Title Regisration, Medan

DOSEN PEMBIMBING:1. Budiman Ginting2. Saidin3. Rudy Haposan Credit/Loan agreement is one of the agreements made between bank as the creditor and consumers as the debtor. The authority of a notary in the issuance of a bank loan agreement deed is grounded on these provisions. The liability of a notary who performs an illegal act in the issuance of a bank loan agreement deed is that the notary is obliged to civilly take the responsibility which is to pay the compensation to the financially harmed parties in accordance with the provision in Article 1365 of the Civil Code and Article 84 of UUJN No. 30/2004 in conjunction with UUJN No. 2/2014. The legal consequence of signing an authentic loan agreement deed in which the notary is absent is the authentic deed is degraded to be an underhanded deed which no longer has the complete proving force for all parties in case a dispute takes place at the court in the future time.Keywords: Violation of Liability, Notary and Loan Agreement Deed

It is one of the honorable and noble professions (officium nobile). As a public official, a Notary is the one who is trusted to give advice. Since Law No. 2/2014 on the Amendment of Law No. 30/2004, the Notarial Advisory Council has been established. The role and authority of this new institution replaces the role and authority of the Regional Advisory Council in giving approval of summoning a Notary by investigator, general prosecutor, and judge stipulated in Article 66, paragraph 1. The research problems are how about the guidance done by the Notarial Advisory Council according to Article 66 of the Notarial Act, how about the legal ground of the Notarial Advisory Council in giving approval of summoning by investigator, general prosecutor, and judge stipulated in Article 66 of the Notarial Act, and how about the right and obligation of a Notary after the Notarial Advisory Council has given their approval.Keywords: Notary, Article 66, Notarial Advisory Council

Hasim Purba A loan agreement authentically made by a notary is followed by the issuance of a deed of acknowledgement of debt which is also made authentically by the notary. This is a normative legal research which is done to the Civil Code i.e. the Third Book of Agreement Law especially the loan agreement as referred to in Article 1721 of the Civil Code. This research is descriptive analytical endeavoring to describe, explain and analyze the research problems; and to find out the appropriate solution. The results of the discussion find out that the legal force of the deed of acknowledgement of debt made by the notary with an authentic deed is a perfect evidence for all parties when a dispute takes place at the court. Defendant I HH and Defendant II DH have been bound in a loan agreement that have been acknowledge by both through an authentic notarial deed i.e. the deed of acknowledgment of debt.Keywords: Deed of Acknowledgement of Debt, Notary, Dispute

Suprayitno In channeling financing and doing any business activities, Bank Syariah and UUS have to do any methods which do not harm Bank Syariah and the interest of clients who entrust their deposit. However, in the case of the Bogor District Court’s Verdict No. 125/PID.SUS/2014/PN.Bgr, there were 113 fictive financing at PT. BSM which involved the defendant, a Notary who was imposed criminal sanction of 5 months and 6 days because it was evident that he had been judicially correct in violating Article 264, paragraph 1 of the Penal Code in committing authentic deed forgery. The objective of the research was to find out the legal aspect of sharia financing according to Akad Murabahah, a Notary’s legal liability for facilitating sharia financing according to Akad Murabahah and for fictive financing deeds in the Bogor District Court’s Verdict No. 125/PID.SUS/2014/PN.Bgr.Keywords: Akad Murabahah, Notary, Legal Liability

Keizerina Devi A  According to Article 77 paragraph 1 of the Law No. 40/2007, RUPS (Shareholders’ General Meeting) which is held by means of electronic media can be conducted using teleconference and videoconference; however, UUPT (the Law on Limited Liability Companies) does not clarify the mechanism of the implementation. It is then very risky considering its mechanism is very essential as it determines the validity of the minutes of RUPS and any authentic deed resulted from the RUPS.
