Abstract

Government Regulation No. 24/1997 on Land Registration (henceforth, PP on Land Registration) regulate the implementation of land registration stipulated in Article 19 of UUPA. Legal provision found in Perkaban No 8/2012 which is the administrative regulation of PP No 24/1997 as the administrative regulation of UUHT. The imposition of Perkaban No 8/2012 which determines SKMHT has to be made in the form of Notarial or PPAT deed. Based on the provision in Article 1868 of the Civil Code, a notarial deed can be considered authentic provided that it meets the requirements as follows: 1) the Deed has to be made “by” (door) or before (ten overstan) a public official, 2) the Deed has to be made in the form determined by law, 3) the public official has to have the authority to draw up that Deed.Keywords: Authenticity, Power of Attorney on Burdening Hypothecation, Directive of the Head of the National Land Agency, Notary, Law No. 2/2014 on Amendment of Law No. 30/2004 on Notarial Position

Ethics is a critical, methodical, and systematic reflection of human behavior concerning human good and bad norms and behavior. Article 1, figure 2 of Notarial Code of Ethics of the INI (Indonesian Notarial Association) deals with the moral principle determined by and based on the Decision of the Congress of the INI. As a public official who serves people, he can have personal and occupational errors. The imposition of sanction on the violation against the code of ethics is adjusted to the quantity and quality of the violation. By viewing the Notarial Act and the Notarial Code of Ethics, we can see how fat the upholding of law in violation of the code of ethics done by a Notary as the public official in Medan.Keywords: Notary, Code of Ethics, Notarial Honorary Council

Abstract

The procedure of legal provision on land right transfer because of inheritance, based on the Decree of the Minister of Agrarian Affairs/the head of the National Land Agency No. 3/1997 on Land Registration is that the petitioner as the heir/his attorney files a request for transfer registration by submitting Land Certificate in the name of the heir. Death Certificate in the name attached in the certificate, affidavit in the from of a will, the Court’s Verdict, Judge’s Decision, and heirs’ identity cards. If there is more than one heir, the registration for transfer has to be accompanied by a certificate of inheritance distribution containing notification about the land or building rights which is based on the Corticated of the distribution of the inheritance. If the Land is a grant, the above certificates have to be attached by the certificate of grant/will plus BPHTB ( Duty on Land and Building Rights Acquisition), but if the grant is stiil uncertain, the transfer registration has to be done by heirs and grant receiver and it is considered as joint property. In order to avoid loss of the parties as in the Religious Court’s Verdict No. 96/Pdt.G/2014/PTA.Mdn, the implementation of inheritance distribution has to be done according to legal certaintyby recognizing the process of inheritance land ownership with the prudential principles to ward off legally defective Notarial deed by checking the Certificate of transferring inheritance before the Notary/PPAT, supporting by the evidence of heirs’ approval by checking the land location, getting information about the labd ownership from neighbors, examining the other supporting data, with the seller’s and the buyer’s good faith. The Religious Court’s Verdict No.96/Pdt/2014/PTA. Mdn provides legal protection for the buyer by revoking the Religious Court’s Verdict, Medan, and foreclosure on the case object is considered invalid.Keywords: Court’s Verdict, Grant receiver, Considered as Joint Property

Abstract

People’s rapid demand for registering fiduciary collateral has caused the government to make it by online. The launching of fiduciary by online is a concrete effort to provide positive contribution to strengthen movable property as a collateral system in Indonesia. In practice, however, many obstacles faced by a Notary in registering fiduciary collateral by online. Syafnil Gani Tsunami disaster has brought an impact to the community especially in the fild of land in which the owner and the border of the land is unknown, the evidence of ownership in the form of Land certificate either owned by the owner or the one kept in the Office National Land Board has been penished. This normative juridical study with analytical descriptive approach described and analyzed the problems to be presented referring to the existing provisions of legislation.The result of this study showed that the implementation of certification of rights to land had succeeded in providing a guarantee of certainty of rights to some of the communities impacted by the tsunami disaster, but the result is not yet able to meet the target set due to several constraints met in the field. The constraints found in the implementation of certification of rightd to land were the emergence of multiple certificates, improper land area, unclear boundary of land because it is not mentioned in the certificate due to the unlikely condition in the field, and the emergence of the name of the previous owner in the new certificate even though the rights to land has been transferred.Keywords : Certification, Adjudication, Tsunami Disaster

Yefrizawati The guardianship concept grounded on the positive law in Indonesia is principally not far different, according to Law No. 23/2002 on Child Protection, Law No. 1/1974 on Marriage, the Compilation of Islamic Laws, Islamic Laws and Adat Law stating that the guardianship is specified only for minors (underage children), although the age limitation of minors is regulated differently among all these laws. A divorce causes parents’ authority into guardianship. Therefore, when a marriage is separated by the judge, it has the impacts on the guardianship for their minors. The assigning of guardianship can be reviewed by the judge on request of the father or mother based on the change in condition. The legal consequence for the guardianship annulment due to judicial technical mistake of the court in assigning the guardianship is the annulment of the guardianship belonged to the mother named Alda Winona Nurrahmadhani based on the Ruling No. 400/Pdt.G/2011/PN.Sby. The guardianship for the child is returned to both parents as the guardians for their underage child.Keywords: Guardianship, Minor, Divorce.

Muhd Yamin A cooperative suffers a loss and is not able to pay off its debt, two methods can be used to solve the problem, either by the decision of membership meeting or by the government directive. The Ruling No. 01/Pailit/2008/PN.Niaga.Smg states the bankruptcy of Koperasi SAM, located in Solo, by the request for bankruptcy by its three managers: BS, LTT, and AW. This research was descriptive analytic with judicial normative approach. The data comprised secondary data which were obtained by gathering primary, secondary, and tertiary legal materials. The legal consequence of the ruling on the bankruptcy of the cooperative’s assets was that all of the cooperative’s assets were under the curators’ control and management. Generally, the rest of the assets of a cooperative which has been closed down is not sufficient to pay off the debt. The legal status of a cooperative as the result of bankruptcy is that it will be closed down. The problems usually come from the debtors who have bad intention or who do not want to pay off their debts; they can embezzle investment when the curators are filing the debtors’ assets by transferring their assets to other places. The result is that the curators cannot detect the debtors’ assets. The non-professional curators in managing bankrupted debtors’ assets can cause another problem. When a cooperative is closed down, its members are only responsible for their main savings and initial capital they have deposited. In the case of some members who give their personal loan to the cooperative, they will have the same status as the other creditors in claiming the payoff of the loan to the cooperative which has a legal entity.Keywords: Status of Cooperative, Bankruptcy, Request for Paying Off Debt

Sutiarnoto Article 27 of the Directive of the Minister of Finance No. 27/PMK/065/2016on Guidelines for Implementing an Auction states that an auction can be revokedonly when it is asked by the seller or by the Court’s verdict. There is a problem asfollows: Syahbuddin Purba, through the Consumer Dispute Settlement Board ofCoal’s Ruling No. 126/P3K/JS-III/BPSK-BB/IV/2016, revoked foreclosure sale ofhypothecation. The research problems are how about the revocation of foreclosuresale of hypothecation for realizing legal protection, how about the authority of BPSKof Coal to revoke the foreclosure sale of hypothecation, and how about legal remedyof the revocation of auction to the buyer based on BPSK of Coal’s Ruling.The research used juridical normative and descriptive analytic method.Primary data were gathered by conducting interviews and secondary data consistedof Law No. 4/1996 on Hypothecation on Land and Anything Found on It, theDirective of the Minister of Finance No. 27/PMK/065/2016 on Guidelines forImplementing Auction, Law No 8/1999 on Consumer Protection, and the DirectiveNo. 1061 K/Pdt.Sus-BPSK/2016. Secondary legal material consisted of books, andtertiary legal material consisted of dictionary and dictionary of jurisprudence.The result of the research showed that revocation on foreclosure sale ofhypothecation can be revoked when it does not comply with legal provisions, theauction does not meet Article 1320 of the Civil Code, the buyer is foreign citizen ormixed marriage based on Article 21 in conjunction with Article 28 of Law ofAgrarian Affairs. The authority of BPSK is merely to impose on compensation on thedamage, pollution, and/or consumer’s loss as the result of consuming the goodsand/or using business people’s service so that revocation cannot be done. Legalremedy for revoking foreclosure sale of hypothecation to buyers through the Rulingof BPSK of Coal No.126/P3K/JS-III/BPSK-BB/IV/2016 cannot be done because theregulation on the revocation of a credit contract which becomes the ground for prateexecution right has to be through District Court’s verdict and not through the Rulingof BPSK so that Syahbudin Purba should do legal remedy through litigation.Keywords: Revocation, Auction, Consumer Dispute Settlement Board

Abstract

Dedi Harianto A credit contract is a consensus agreement between a debtor and a creditor ( Bank) leading to payable accounts, in which the debtor is required to return the credit provided by the creditor, under terms and conditions approved by both parties. The research problems are how about the criteria of creditor’s default as stated in the debtor’s lawsuit concerning the implementation of the banking credit contract with addition of collateral to the total amount of the credit facility, how about the legal force of the lawsuit on default filed by the debtor against Bank Sumut as the creditor concerning the implementation of the credit contract which has been effective in line with PMK (Approval to Make Credit) No.32/KC-15/KCP-070/KAL/2011 on November 6, 2011; and how about the analysis on the ground of the Supreme Court Judges’ consideration in the Ruling No. 1932.K/Pdt/2016 in debtor’s lawsuit against creditor’s default.This is a normative juridical research which studies the prevailing laws and regulations, in this case, Law No.7/1992 in conjunction with Law No.10/1998 on Banking, Law No. 42/1999 on Fiduciary Collateral, Law No. 4/1996 on Mortgage, and the third book of the Civil Code on Contract. This is analytical descriptive which describes, explains and analyzes the problems, and finds the right answer to the problems.The research showed that one of the parties did not fully comply with the agreement in implementing the credit contract, did not completely fulfill their obligations or they did not fulfill their obligation punctually. The claim filed by debtor, RE, does not meet the elements of default since it is proved in the Court’s hearing that Bank Sumut has defaulted and the claim is considered error in personal toward the defendant. The Supreme Court Ruling has been in line with the prevailing legal provisions in a credit contract since there is no written evidence in the credit contract that requires Bank Sumut as the creditor to add the number of credit facilities when the collateral is added by the debtor.Keywords: Creditor, Debtor, Default, Credit Contract
