Muhammad Hamdan In running a buiness activity in baking field, board of directors frequently encounters a polemic that obliges them to make a decision and take responsibility for the bank which is potentially bankrupt. Board of derectors is the body of company which is authorized and fully responsible to manage the company for its sake, in line with its significance and objective, and represents the company inside and outside a court in accordance with the provisions in Article of Association. A systemic bank is the bank that, due to its size of asset, capital, and obligation as well as its involvement with other financial sector, can fail some parts or all parts of other banks or financial service, either operationally or financially, if it undergoes trouble or fails. The research problems are how standards are determined in a systemic bank, how a director's liability in a systemic bankis, and how fiduciary duty doctrine and business judment rule are implemented.

DOSEN PEMBIMBING:1. Hasim Purba2. Sunarmi3. Suhaidi One of the problems studied in this research is related to the subsidized KPR or what is called KPR Rumah Sejahtera. It also focuses on the private relationship between bank and developer in which the developer of KPR Rumah Sejahtera acts as the seller and bank acts as the executor. The results of the research demonstrate that the target group of non subsidized KPR is people with middle-upper economy and that of subsidized KPR is people with middle-low economy. The down payment for KPR which is not subsidized by the government is 15% whereas that of subsidized KPR is IDR. 4,000,000.- (four million Rupiahs). In addition, the cooperation between Bank Artha Graha Internasional Tbk, Medan Branch and the developer is written in a cooperation agreement regulating the procedures, credit agreement and money disbursement which is made gradually, namely 80% before the signming of AJB, SKMHT, APHT and 20% after the signing of AJB, SKMHT, and APHT.Keywords: bank, developer, cooperation agreement.

DOSEN PEMBIMBING:1. H. M. Hasballah Thaib2. Utary Maharany Barus3. Yefrizawati A legitimate marriage should meet the basic principle and requirements of marriage. If they are fulfilled, the marriage will be revoked, including a marriage which is based on the forgery of identity by one of the new married couple. The research used juridical normative. It also used descriptive analytic method. The result of the research shows that revocation of a marriage is embodied in Article 27 of Law No. 1/1974 in conjunction with Article 72, paragraph 2 of KHI in which the authority to revoke a marriage when there is forgery in identity done by one of the new married couple so that one of them has the right to lodge the revocation of the marriage. Secondly, PPN as the third party in the revocation of the marriage does not have any legal position because PPN has no right to revoke the marriage based on Article 23 of Law No. 1/1974 on Marriage in conjunction with Article 72 of KHI. Thirdly, the judge, in his decision, rejects the lawsuit for the revocation of the marriage due to the forgery of identity by PPN based on Article 23 of Law No. 1/1074 on Marriage in conjunction with Article 72 of KHI.Keywords: Revocation of Marriage, Third Party, Forgery of Identity

Idha Aprilyana Sembiring Customary inheritance law is a method of distributing inheritance to grandchildren who has been suspended earlier than his grandfather, so that the grandchildren cannot be considered as heirs to inherit the inheritance of his grandfather at the time of his grandfather today and Article 185 Compilation of Islamic Law annulled or borrowing the method of distributing the inheritance in Gayo, Central Aceh and approved by the substitute inheritance concept This study uses descriptive analytics using empirical juridical research methods, in order to discuss the legal conflicts in the implementation of Patah Titi as a method of dividing customary inheritance in the Gayo community of Central Aceh against the enactment of Compilation of Islamic Law.The results of the study show that the implementation of Patah Titi customary inheritance law is still carried out by the Gayo indigenous people in Central Aceh, because customary law in the community is not contradictory. Patah Titi method in the distribution of inheritance according to the Compilation of Islamic Law clearly determines at the time of its implementation because it excludes the portion of grandchildren, is not included in the court and legal certainty for grandchildren to obtain inheritance by looking for experts to find related to the world mentioned and called Article 185 Law Compilation Islam, then opens the opportunity for grandchildren who appear as heirs to inherit because the portion is not the same as the portion obtained by heirs while still alive and renewing the law that can be done by heirs who multiply Patah Titi through supporting media adat, among others, through the transition of peace, overcoming the level of Mukim (resolution of the law of appeal), overcoming the level of the Aceh Adat Council and through a lawsuit in the Court of the Aceh Syar'iyah Court. It is better if the Gayo Central Aceh indigenous people continue to carry out the Patah Titi inheritance method as a form of legal awareness that continues to live in their customs. The government asked no one to impose inheritance over grandchildren who were issued first from the world because it would eliminate the existence of adat wari law as the universality of inheritance law and allow the public to settle legal inheritance settlement through deliberations and consensus in helping the inheritance in Gayo, Aceh Tengah.Keyword: Gayo, Inheritance Distribution, Patah Titi, Aceh Tengah.

Faisal Akbar Nasution Auction is the way to sell goods publicly by offering a written form and/or orally which is inclining or declining the highest price. It is usually preceded by an auction announcement. The research used juridical normative and descriptive analytic method. The approach to the research problems is done by analyzing the prevailing legal provisions on legal protection for auction winners. The result of the research showed that a creditor has the authority to execute and sell the collateral which been executed through auction body when debtors default in paying off their debt to creditors. Auction Letter is an authentic deed used by sellers/owners of goods, buyers, and auctioneers to maintain and carry out their right and obligation and to have complete evidence according to Article 1, figure 32 of the Decree of the Minister of Finance No. 27/PMK.06/2016, and the Deed of the Auction Letter can be used by an auction winner to register his land which he has bought through auction.Keywords: Legal Protection, Auction, Auction Winner

Dedi Harianto The case in Ruling No. 514/Pdt.G/2013/PN-Mdn was started with a construction cost sharing agreement of a house and determination of its parts between the land owner Mrs. AA , and the developer Mr. BB on April 21, 2009, that they would construct 5 (five) units of shophouses on Mrs. AA’s land by the developer. It was agreed that Mrs. AA would get 2 (two) units and Mr. BB would get 3 (three) units, in which the construction of Mrs. AA’s units would have been completed no longer than 12 (twelve) months. However, the construction of Mrs. AA’s shophouses had not been completed until 2013. Mrs. AA filed a lawsuit against Mr. BB to annul the agreement and indemnify the financial injuries due to the default done by the developer. The objective of this study is to discover the cause of the default in the construction cost sharing agreement of the shophouses, the legal protection for the land owner due to the developer’s default, and the consequence of the default to the third party as the buyer of the object of this case.Keywords: Default, Agreement, Construction cost sharing

DOSEN PEMBIMBING:1. Muhamamd Yamin2. Saidin3. T. Keizerina Devi A Problems regarding double certificates are frequently found. The owner usually report it to Administrative Court to obtain justice. It spporoaches the problems by analyzing the ruling of the Supreme Court of the Republic of Indonesia No. 381/k/tun/2017. It is also supported by outcome from interview with the Land Agency of Medan, section v public case. The results of the research discovers that practically, the freehold title certificate registrateion has been regulated and issued in accordance with the regulation, yet the ruling of the administrative court annuls one of the certificate that has to be done by the land office of Medan. It is suggested that the land office of Medan correct the bookkeeping system of certificate issuance and other steps required to issue a certificate, so that the society will trust and feel secure to register their land and that there will be not any double certificates.Keywords: Double Certificate, Annulment of Double Certificate I.

Sutiarnoto Kehadiran jabatan notaris dikehendaki oleh peraturan perundang-undangan dengan maksud untuk membantu dan melayani masyarakat yang membutuhkan alat bukti tertulis yang bersifat otentik, mengenai keadaan peristiwa atau perbuatan hukum atas keterlibatan lsngdung oleh para pihak yang menghadap. Namun demikian, notaris dalam menjalankan tugasnya tidak jarang dipanggil oleh aparat hukum negara sebagai tersangka sehubungan dengan akta otentik yang dibuatnya.Sehingga dipandang perlu untuk mengetahui analis yuridis tentang notaris yang melakukan tindak pidana pemalsuan keterangan dalam akta otentik.Kekuatan pembuktian akta notaris dalam perkara pidana merupakan alat bukti yang sah menurut undang-undang dan bernilai sempurna. Nilai kesempurnaan itu didukung oleh akta notaris. Notaris yang menjalankan tugasnya tidak menjamin yang dikatakan oleh penghaap adalah benar.Berdasarkan uraian ini permasalahan yang diangkat adalah pertama, bagaimana aspek hukum pidana atas akta otentik yang memuat keterangan palsu, kedua bagaimana perbuatan notaris dapat dikategorikan menempatkan keterangan palsu dalam akta otentik dan bagaimana pertimbangan hukum hakim atas keterangan palsu dalam akta otentik berdasarkan Putusan Mahkamah Agung Nomor 1099/k/pid/2010.Penelitian ini bersifat yuridis normatif yang bersifat perskriptif. Pendekatan yuridis yang mempergunakan sumber data sekunder, digunakan untuk menganalisa berbagai peraturan diperundang-undangan tentang di bidang tindak pidana pemalsuan keterangan yang dilakukan oleh notaris, buku-buku dan artikel yang mempunyai korelasi yang relevan dengan permasalahan yang akan diteliti.Hasil penelitian ini dapat disimpulkan bahwa aspek hukum pidana atas akta otentik yang memuat keterangan palsu meliputi tindak pidana pemalsuan keterangan dalam akta otentik seperti yang tertera pada Pasal 266 KUHP, unsur-unsur tindak pidana pemalsuan keterangan dalam akta otentik dan ancaman hukuman bagi notaris yang memuat keterangan palsu dalam akta otentik. Perbuatan Notaris yang dapat dikategorikan sebagai menempatkan keterangan palsu dalam akta otentik meliputi kategori delik dalam menempatkan keterangan palsu, identifikasi kepalsuan akta dan akibat hukum pemalsuan keterangan dalam akta otentik. Dasar pertimbangan hukum hakim dalam memutus perkara ini berdasarkan unsur-unsur dalam ketentuan pasal terpenuhi yaitu turut serta melakukan memasukkan keterangan palsu dalam akta otentik dan penerapan sanksi pidana dalam Putusan Mahkamah Agung RI Nomor 1099/k/pid/b/2010. Berdasarkan hal ini maka pemerintah perlu merevisi berupa penambahan ketentuan pasal di dalam UUJN yang mengatur khusus tentang tindak pidana pemalsuan keterangan dalam akta otentik ini dan diperlukan ketentuan yang mengatur jelas tentang kedudukan notaris setelah melakukan tindak pidana dan perlu adanya tambahan pengetahuan dan pemahaman terhadap notaris tentang penerapan sanksi pidana oleh notarisKata kunci: Akta Otentik, Notaris, Pemalsuan, Tindak pidana.

Keizerina Devi A According to executorial title, the receiver of fiduciary can directly execute the collateral through public auction without going to the court. Auction has advantage compared to other kind of sale, namely fair, quick and safe; and it achieves the highest price and provides legal certainty. This is a normative juridical research. It is a legal research that uses secondary data; started with the analysis of legal problems from either books or laws. The legal protection for the third party is obtained by filing a lawsuit first. The other legal efforts are by submitting objection to the auction office and leasing company; and filing a claim for indemnity for the money that has been paid to buy the auction object.Keywords: Legal Protection, Auction, Confiscated Goods, Fiduciary

Hasim Purba Pada dasarnya tanah mempunyai arti yang sangat penting oleh karena sebagian besar dari kehidupan manusia bergantung pada keberadaan atas tanah. Semakin berkembangnya zaman maka semakin berkembang pula kebutuhan dan kepentingan manusia akan tanah, keinginan untuk memiliki tanah semakin tinggi dan semakin tinggi pula permasalahan di bidang pertanahan. Salah satu contoh sengketa tanah yang banyak terjadi adalah sengketa penguasaan tanah yang terjadi karena dasar pendudukannya yang tidak jelas. Seperti kasus Ida Farida melawan PT Pakuan Sawangan Golf. Adapun permasalahan yang dikaji yaitu bagaimana kekuatan hukum bukti perolehan hak atas tanah dengan dasar SK Kinag Nomor 205 DN III 1954-1964, bagaimana kedudukan hukum terhadap tanah yang memiliki dua bukti perolehan hak atas tanah dalam sengketa Ida Farida dan PT. Pakuan Sawangan Golf, serta bagaimana putusan Mahkamah Agung Nomor 480/K/TUN/2012 apabila ditinjau dari aspek hukum tanah nasional dan aspek keadilan.
