Hasim Purba PTPN III Membang Muda has been registered as the holder of HGU (leasehold) since December 23, 2005, based on the Directive of the Head of BPN (National Land Agency) No. 119/HGU/BPN/2005, and it will last until December 23, 2005, and it will be possibly renewed for 25 years. The problem is that a SHM (debenture) of the same land location in the name of HSN was issued by the Land Office on April, 2012. The research problems are how about the validity of registering HGU by PTPN III Membang Muda, how about the settlement of dispute attempted by PTPN III Membang Muda on the issuance of SHM on the HGU land of PTPN III Membang Muda, and how about the legal certainty on the issuance of SHM on the land located in PTPN III Membang Muda.Keywords : Land Registration, Debenture, Leasehold

Saidin Pengadaan tanah bagi pembangunan untuk kepentingan umum merupakan salah satu manifestasi dari fungsi sosial hak atas tanah, pengadaan tanah dipandang sebagai langkah awal dari pelaksanaan pembangunan yang merata untuk meningkatkan kesejahteraan rakyat atau masyarakat itu sendiri. Pengadaan tanah bagi pembangunan untuk kepentingan umum hanya dapat dilakukan atas persetujuan pemilik hak atas tanah mengenai dasar dan bentuk ganti rugi yang diberikan kepada pemilik hak atas tanah itu sendiri. Karena merupakan perbuatan pemerintah untuk memperoleh tanah pada prinsipnya pengadaan tanah dilakukan dengan cara musyawarah antara pihak yang memerlukan tanah dan pemegang hak atas tanah yang tanahnya diperlukan untuk pembangunan. Pengadaan tanah selalu menyangkut dua sisi yang harus ditempatkan secara seimbang yaitu kepentingan masyarakat dan kepentingan pemerintah. Tugas pemerintah sendiri mempunyai kewajiban untuk melindungi, mengamankan, dan mensejahterakan masyarakat secara keseluruhan termasuk para korban pembebasan tanah.Kata Kunci : Perlindungan Hukum, Pemilik Hak Atas Tanah, Pengadaan Tanah, Kepentingan Umum

Utary Maharany Barus Credit contract is a principal agreement while a contract on collateral is an accesoir contract which follows a principal contract or credit contract. The implementation of credit contract with collateral owned by the third party has its own regulation so that it is legal and final and conclusive. The research used juridical normative method. The nature of the research used descriptive analytic method. The result of the research showed that the legal position of the third party as the giver of the collateral in credit renewal between the Bank as creditor and the client as debtor has the same right as the debtor when the process of burdening collateral is done according to the prevailing law.. The legal consideration of the Panel of Judges in the Meulaboh District Court which state that debtor B as the defendant I has committed illegal act by not informing the implementation of the contract on collateral to the Third Party, TD, as the owner of the collateral. Therefore, SKMHT and APHT deeds becomes legally defective ad does not have any binding legal force for the parties and the Third Party.Keywords: Credit Renewal, Collateral, Third Party

Tax arrears in Indonesia are significant that they require law enforcement by fiscal authorities in collecting tax. The research problems are how the legal certainty is fulfilled in the provisions of collecting system of BPTHB (Duty on Land and Building Right Acquisition) in Medan, how the fiscal authorities and tax collecting for BPTHB that is underpaid by taxpayers. This is a prescriptive normative juridical research. An appointed Notary/PPAT has already had NPWP. Article 28 of UU KUP, Article 14 of UU PPh, and PER-17/PJ/2015 which regulates the calculation of PPh OP Notary/PPAT for gross circulation below Rp. 4.8 million can choose to organize bookkeeping or calculating norm, while a Notary/PPAT who has his earnings Rp.4.8 million or more has to organize bookkeeping. Regulation on the calculation of PPh of individuals for a Notary/PPAT who obtains earnings from professional service and business does not meet the principle of justice, either vertically or horizontally, because ideally the same earnings will have the same amount of tax, and the bigger the earnings, the more taxable which has to be paid.Keywords: Notary, PPAT, PPh, Bookkeeping, Recording, NPWP, Taxpayer

Idha Aprilyana Sembiring There are two factors which ca revoke a marriage: violation against the procedure such as the requirements for the presence of Wali Nikah (male next of kin and guardian whose consent is required for the marriage) and witnesses is not fulfilled, or it is carried out by unauthorized a marriage registrar and the violation against the marriage materials as it is stipulated in Article 22 of Marriage Law and Article 70 until Article 72 of KHI. Legal protection for those whose marriages are revoked stipulated in Article 28, paragraph 2, point b of Law No. 1/1974 on Marriage and in Article 75 and 76 of KHI in which the revocation is not put into effect retroactively on children, and the married couple who have good faith and the third party whose rights are fulfilled with good faith. The marriage between defendant I and defendant II is carried out is beyond the authority of Wali Nikah. It is carried out by a marriage registrar in Payung Sekaki Subdistrict as Wali Hakim (a person, appointed by the Court, who is not related to the bride) who marries defendant I and defendant II; therefore, the judge hands down a Verdict which revokes the marriage in which it is performed by a Wali Hakim who has no right as it is stipulated in Article 26, paragraph 1 of Law No. 1/1974 on Marriage and Article 71 of KHI.Keywords: Legal Protection, Marriage, Revocation of Marriage

Madiasa Ablizar A self-protection clause is a clause stating that if there is a statement that is not in accordance with what is stated in the deed, there is a dispute or there are things/statements which have been proven to be incorrect from the complainants themselves, then that will not involve a Notary. refers to the provisions of article 38 paragraph (3) letter c UUJN, the inclusion of the self-protection clause may be included if it is the wish of the intended parties because the deed made for the parties is the wish of the parties, not the desire of the Notary. The Notary is not a party to the deed so that the Notary may not include any clause. It is stated in the Civil Code and KHI (Compilation of the Islamic laws) that the testator is allowed to distribute only one third of his property to protect his heir. The research used juridical normative method. The research used descriptive analytic method The result of the research, based on the Civil Code, Chapter XIII, Book Two, Article 874 until Article 912. Article 194 until Article 209 of KHI states that a Notary is required to ask the testator in a written Deed whether the property belongs to him as stipulated in Article 194, paragraph 2 of KHI, whether the other heirs have agreed, and only one third of the property which is allowed to be given as it is stipulated in Article 195, paragraph 2 of KHI. The Plaintiff has made LL binti Y, a 17 year-old girl as the Defendant III as it is stipulated in Article 330 of the Civil Code in conjunction with Article 68, paragraph 1 of KHI since she is not an adult yet. When the property is the inheritance controlled by defendants, it becomes a dispute in ownership. Based on this consideration, the plaintiff’s claim is obscure (obscuur libel); therefore, the case is not accepted (niet onvankelijke verklaart).Keywords: Notary’s Liability, Revocation of Will, Exceeding Regulation

Rudy Haposan Food Estate program is a government program to realize the national food security, based on the legal background, PP (Government Regulation) No. 18/2010 on Crop Cultivation. This program needs a wide agricultural land area. The research used juridical normative method which analyzed. The nature of the research was descriptive analytic The result of the research shows that the regulation on land acquisition of farmers’ land rights for implementing Food Security program, related to the maximum boundary of individual or legal entity land area based on Law No. 56 Prp 1960 on Regulation on Agricultural Land Area, is contrary to PP No. 18/2010. The implementation of the program in Bulungan Regency, East Kalimatan Province and in Merauke Regency is also contrary to PP No. 18/2010 concerning maximum boundary of land area which is allowed to be controlled by investors. Legal protection for land owners in the implementation of the program related to the Indonesian positive law is that land owners must not be treated arbitrarily, and the land transfer has to be carried out based on the agreement on the market price between farmers as the land owners and investors.Keywords: Food Estate, Land Transfer, Maximum Boundary of Land Area
