Abstract

Dosen Pembimbing:1.  Prof. Dr. Sunarmi, SH, MHum2.  Prof. Dr. Hasim Purba, SH, MHum'3.  Dr. Dedi Harianto, SH, MHum Consumer financing agreement contains a credit contract in which fund is given to a consumer as a debtor. It becomes a debt which has the same value as the fund, plus interest agreed by the parties. The research used juridical empirical and descriptive analytic method. The data were gathered by using library research and field research technique and conducting literature study, interviews, and documentary study. The result of the research shows that the defaults in consumer financing agreement at PT. Mandiri Tunas Finance was that debtors are not able to pay off their credit or are late in paying off their credit. A sanction will be imposed on a debtor who defaults by handing in a mortgage to creditor and paying off all debts, based on consumer financing agreement by executing fiduciary collateral according to Article 29 of Law No. 42/1999 on Fiduciary Collateral. Legal protection for a debtor can be given preventively and repressively. Preventive legal protection is done to save non-performing loan, and repressive legal protection is done to settle non-performing financing.Keywords: Legal Consequence, Debtor, Default, Consumer Financing

Dosen Pembimbing:1.  Notaris Dr. Suprayitno, SH, MKn2.  Notaris Dr. Henry Sinaga, SH, MKn3.  Notaris Dr. Rudy Haposan, SH,MKn Amendment of the Notarial Honorary Council of the Extraordinary Congress of Banten Indonesian Notarial Association in 2015, The Central Honorary Council has the authority to give recommendation to dismiss the Notary with dishonorable dismissal to the Minister of Law and Human Rights as it is stipulated in Article 77, letter d of Law No. 30/2004.The synergy between the Notarial Honorary Council and the Notarial Supervisory Board can only be seen in the case of supervision and development. They prepare for the test for extraordinary member of the Indonesian Notary Association and the Examination of Notarial Code of Ethics, but not in imposing the sanction. Therefore, the Notarial Honoray Council is expected to examine the violation, followed by the decision of the Notarial Supervisory Board on the Code of Ethics violation based on the Notarial Act and the code of ethics based on the Notarial Code of Ethics.Keywords: Notarial Honorary Council, Notarial Supervisory Board, Sanction, Code of Ethics

Abstract

Dosen Pembimbing:1.  Prof. Dr. Syafruddin Kalo, SH, MHum2.  Notaris Dr. Suprayitno, SH, MKn3.  Notaris Dr. Henry Sinaga, SH, MKn The Implementation of PP No. 24/1997 on Land Registration, concerning AJB, in its closing remark, states that the Deed is signed by or affixed with thumbprints of the persons appearing, witnesses, and PPAT. The research used juridical normative and descriptive analytic method. Repudiation of signatures in the AJB is caused by some factors such as the persons appearing do not come, they do not receive the money of the transaction, or they do not sign the AJB. The Supreme Curt’s Ruling No. 1175 K/Pid/2016 on 1 year and 8 month-imprisonment is handed down based on the evidence of authentic Deed forgery according to Article 264 of the Penal Code in conjunction with Article 55 of Penal Code. He should not do in his Deed which serves one’s own purposes and harms other parties. Besides signing AJB, the persons appearing should also give the thumbprints to avoid signature repudiation. In consequence is that the Deed can be revoked, the Notary can be sued when he does not want to revoke them with the reasons that he does not know about them and he argues that they are signed by his staffs. When the accusers owe someone else, the latter will be harmed since the former does not want to pay off his debt. The Notary also argues that he was out when signing the Deedwas in process and delegated the authority to his staffs. Regional Supervisory Board has given the right decision in imposing a warning to the Notary asitis stipulated in Article 16, paragraph 1, letter a of Law No. 2/2014 which states,in doing his job, a Notary is required to do it with liability, honesty, accuracy, independence, impartiality, and keeping the interest of the related parties concerning legal act.”Keywords: Liability, Underhanded Deed, Notary

Hasballah Thaib, MA, PhD3.  Notaris Dr. Suprayitno, SH, MKn Right and obligation of objection is stipulated in UUJN (Notarial Act No. 2/2014 on the amendment of UUJN No. 30/2004 for a Notary in doing his job as a public official in keeping confidentiality of the deeds he has made and the privacy of the persons appearing. Aricle 4, Article 16, paragraph 1, letter f, Article 54, and Article 66 of UUJN are legal ground for the implementation of the right and obligation of objection.The research used juridical normative method which was aimed to analyze legal provisions such as UUJN No. 30/2004 which was amended to UUJN No. 2/2014. It also used descriptive analytic approach by giving argumentation from the research result. The results of the discussion of the problems that arise in this study are that legal arrangements regarding the rights and obligations of notaries to deny are contained in paragraph Aricle 4, (1) (f) of Article 16, paragraphs (1), (2), (3), and (4) of Article 66 and Article 54 of Law No. 30 of 2004 concerning Notary Position which requires the notary to keep the contents of the deed made from another party if the other party does not have a strong legal basis to request that the notary notify the contents of the deed made by the notary.Keywords: Right, Obligation, Notary’s Objection

Dosen Pembimbing:1.  Prof. Dr. Suhaidi, SH, MH2.  Dr. Sutiarnoto, SH, MHum3.  Dr. Jelly Leviza, SH, MHum The mechanism of making the design of cooperative agreement between PT Pelindo I of Belawan International Container Terminal (BICT) and PT. Prima Indonesia Logistic on cooperation in Managing and Operating Reach Stacker at BICT terminal is made based on negotiation. This agreement should meet the requirements as stipulated in Article 1320 of the Civil Code, and its implementation does not give any balance between right and obligation since the First Party has more portion of right than the Second Party, while it has less responsibility than the Second Party does. In practice, the clause of the agreement which often makes the Second Party default is about “providing backup device at least 1x24 (one times twenty four) hours when there is damage which can cause the delay in lift on/lift off service or one day after it damages, and all costs will be imposed on the Second Party.” In reality, the repairmen cannot be done in 24 hours plus the absence of backup device. In consequence, receiving and delivery activities cannot be served.Keywords: Cooperative Agreement, Reach Stacker.

In the Islamic concept, a dead person will not be the burden of his heirs since debt is not bequeathed. It is the responsibility of the dead person, relating to his property. An heir is responsible only for paying off the debt from the existing property. The research used the theory of justice with judicial normative approach, by analyzing deeply legal provisions, jurisprudence, and the opinions of legal experts. The data were gathered by conducting library research. On the other hand, Article 833, paragraph 1 of the Civil Code requires an heir to pay off the whole debt, will, and others left by a testator.Keywords: Juridical Analysis, Responsibility, Debt

Yamin, SH, MS, CN2.  Prof. Dr. Syafruddin Kalo, SH, MHum3.  Notaris Dr. Suprayitno, SH, MKn One of the problem in this case related to the land as the collateral given by the debitor to the creditor is not based on Law on Hypothecation but on the mutual agreement to make a sales contract before a Notary with additional agreement. The result shows that the legality of loan and credit is not correct if it is related to a plot of land as collateral by using Notarial Deed, because it has to refer to UUPA No. 4/1996 which has to be registered to the local Land Office. Meanwhile, legal protection for the parties involved in the agreement is that they can make a complaint against the Notary to the Supervisory Council as it is stipulated in Article 73 of UUJN. Those who are harmed can complaint against the Notary, personally, in criminal law, or in civil law. Legal protection for the Notary is in the form of repression as it is stipulated in the Decree of Menkumham No. 7/2016 on Notarial Honorary Council. There is no legal certainty on the position of loan and credit and right transfer because they are two different things and cannot be equalized, as it is stipulated in Article 1754 of the Civil Code.Keywords: Loan and Credit, Individual, Land Right Transfer

Dosen Pembimbing:1.  Notaris Dr. Suprayitno, SH, MKn2.  Notaris Dr. Henry Sinaga, SH, MKn3.  Notaris Dr. Tony, SH, MKn According to Law No 2/2014 on the Amendment of Law No. 30/2004 on Notarial Position, a Notary is a public official who has the authority to draw up authentic deeds and other authorities as stipulated in this law. One of the prerequisites to be a Notary is apprenticeship or having been working as a notarial employee for at least 24 (twenty four) months consecutively in a Notary’s office, or on his own effort or on the recommendation of a Notarial organization after he has passed Notarial graduate program. The objective of apprenticeship is that a Notarial candidate gets skill and knowledge his job in the future. In reality, however, apprenticeship program does not run smoothly. There are some obstacles such as lack of attendance, lack of apprentice’s participation, and lack of Notaries’ development because of confidentiality and their hectic schedule. The result used juridical empirical and descriptive analytic method by analyzing Law No. 2/2014 on the Amendment of Law No.30/2004 in Notarial Position, Regulation of INI (Indonesian Notarial Association) No. 10/Perkum/INI/2018 on Apprenticeship and Technical Manual on ALB (Apprenticeship for Extraordinary Members) of INI, supported by the result of interviews with 5 Notaries and 2 notarial candidates as apprentices. The result of the research shows that the implementation of apprenticeship is very important for notarial candidates to adjust their knowledge obtained from their Notarial Graduate Program to the practice in the field. They can also practice directly a Notary’s daily activities.Therefore, apprenticeship is very important in determining a Notary’s quality.Keywords: Notarial Apprenticeship, Effectiveness in Implementing Apprenticeship, for Notarial Candidates

Keizerina Devi A, SH, CN, MHum The establishment of the principle of recognizing a service owner began with the issuance of Government Regulation No. 43/2015 on Notary’s Obligation to be an informer in TPPU (Money Laundering Criminal Act). This is because Notary’s service is vulnerable to concealing the origin of property which comes from criminal act. The research was about the conflicting norms regulated in Article 16, paragraph 1, letter f of UUJN (Notarial Act) on Notary’s Liability for the confidentiality of deeds and as an informer of TPPU is responsible to apply PMPJ (Principle of Recognizing Service Users) according to the Ministerial Decree No. 9/2017. The objective of the research was why it was necessary to apply PMPJ, how about a Notary’s liability to keep the confidentiality of deeds, and how the Notaries in Medan implement PMPJ.The result of the research shows that in playing his role in social ultimate goal to detect the use of a notary’s service by TPPU perpetrators, a Notary is liable to implement PMPJ.Keywords: Principle of Recognizing Service Users, Money Laundering Criminal Act, Notary, Informer
