Abstract

Keizerina Devi A, SH, CN, Mkn The objective of the research was to find out the correlation between Notarial Protocols and the Removal of archives according to Law No. 43/2009 on Filing, the urgency of removing Notarial Protocols, and how about a Notary’s liability for Notarial Protocols when they are removed. The research used the Theory of Legal Responsibility and Legal Certainty, and juridical normative and descriptive analytic method, supported by the result of interviews with the Head of Regional Supervision Council of Medan and with three Notaries. The result of the research shows that an archive will be in effect for 30 years; after that, it is expired and invalid as evidence before the Court. Therefore, it is futile to maintain it since it has been expired so that a Notary as the holder of Notarial Protocols has to remove them since they are a State Archive.Keywords: Keywords: Notary, Notarial Protocols, Archive Removal

Dosen Pembimbing:1.  Prof. Dr. Budiman Ginting, SH, MHum2.  Prof. Dr. Syafruddin Kalo, SH, MHum3.  Prof. Dr. Saidin, SH, MHum Elimination of hypothecation according to Article 18, paragraph 1 requires hypothecation cancellation. it is done when the debt guaranteed in the contract is paid off. One of its requirements is the existence of land rights certificate and hypothecation certificate for elimination. When it loses, it will be substitued by hypothecation cancellation permit deed or cancellation consent as the prerequisite from the Land Office to process the cancellation. Hypothecation cancellation permit deed is a notification letter made by a Notary which states that hypothecation certificate has been missing. However, it is not regulated clearly and specifically in any law or regulations. The research problems are how about legal consideration for a Notary to make hypothecation cancellation permit deed, how about the procedure and the process of mnaking it, and how about its position. Abstract

Keizerina Devi A, SH, CN, Mhum DNA ( Deoxyribonucleic acid) test is used to find out some information about one's genetics in order to find out his heredity and his risk for a certain illness so that the similarity of genetics between a father and his illegitimate children. The Constitutional Court's Ruling No. 46/PUU-VIII/2010 states that DNA test can be used as valid evidencein the case of an illegitimate child's lineage versus his biological father. The result of the research shows that evidence cannot stand by itself; it has to be supported by witness testimones which say that the child's parents have been married although the marriage does not meet the requirements for its legitimacyKeywords: DNA test, Illegitimate Child, Biological Father

Dosen Pembimbing:1.  Dr. Idha Aprilyana Sembiring, SH, MHum2.  Dr. Yefrizawati, SH, MHum3.  Dr. Utary Maharany Barus, SH, MHum Kinship system in Nias community, especially in Hia clan at Iraonogailavillage, is patrilineal which is referred to male lineage and the offspring. Theresearch problems are as follows: how about inheritance system according to theadat law of Hia clan, how about a widow’ right on joint property, and what effortshould be made by a widow on the joint property at Iraonogaila village. LahomiSub-district, Nias Barat Regency. The research used juridical normative anddescriptive analytic method. A widow has the right to manage and to receive jointproperty but not as an heir as long as she does not violate any norms and does notget married. Her effort is by negotiation (fangosara bawongambato), complaint toVillage Head (salawa), complaint to the adat leader (satuambanua), and bignegotiation (fangatudo bambanua) which is attended by community leaders,religious leaders, government officials, and neighbors. Sales deed made in the office of Notary/PPAT has legal force as evidence since it is made according to law. However, the Notary takes liability for the persons appearing whose deeds are made. An authentic deed as strong evidence plays an important role in every legal case. Right and obligation which are clearly found in an authentic deed guarantees legal certainty and can avoid any dispute.The research used juridical normative which was library research with historical and legal provision approach about the liability of the persons appearing involved in making deeds in the PPAT office with witnesses who sign them.Based on the research done by the writer, he get knowledge about the power of a deed as evidence and how a PPAT who had submitted deed protocol for which the receiver of the deed protocol was involved in making the deed as evidence when the parties file complaint on PPAT’s deeds.Keywords: PPAT Deed, Evidence, the Parties’ Complaint

Abstract

One of them is an auction winner cannot have the object he has bought through the foreclosure sale since the object of the auction done by KPKNL is fictive. The research used juridical prescriptive analytic method. Secondary data were obtained from primary, secondary, and tertiary legal materials. The data were gathered by conducting library research, documentary study, and interviews and analyzed qualitatively. The conclusion is that the fulfillment of the principles of auction on a fictive auctioned collateral for an auction winner, viewed from the perspective of the principles of auction, is not implemented properly. Nowadays, auction is only regulated repressively in its legal protection, but it is not regulated preventively in legal protection for an auction winner in the case of fictive auctioned collateral. The liability of KPKNL for a fictive auctioned object is only administrative.Keywords: KPKNL, Fictive Collateral

It is more difficult to handle since the transfer ( through buy and sell, rent, and others) will cause the conflict between the third party as the controller oh the collateral and the creditor as its real owner. The research problems are how about legal implication if debtor transfer collateral to the third party in a financing contract, how about the implemention of the execution on fiduciary collateral by a debtor to the third party,and how about legal protection for CIMB Niaga Auto, Medan Branch, in the implemention of execution on fiduciary collateral which has been transferred by debtor to the third party.Keywords: Execution; Fiduciary Collateral

Keizerina Devi A, SH, CN, MHum Article 58, figure 1 of Law No. 2/2014 on the Amendment of Law No. 30/2004 on Notarial Position states that a Notary makes the list of deeds, the list of underhanded documents, the list of booked and underhanded deeds, and the other documents required by the laws. The list of deeds is a monthly report to the MPD (Regional Supervisory Council) in a Notary’s work place. The research used juridical normative method. Secondary data were obtained from primary, secondary, and tertiary legal materials. They were gathered by conducting library research, field research, documentary study, and interviews. The result of the research shows that the task and authority of MPD are organizing meetings to identify whether there is violation against the Code of Ethics by a Notary or against Notarial implementation.Keywords: Book of the List of Deeds, MPD (Regional Supervisory Council)

Keizerina Devi A, SH, CN, MHum The objective of the research was to find out the system of protection for traditional knowledge and traditional culture expression in making Batak Toba ulos in Tobasa (Toba Samosir) Regency. Central government and local government play an important role in socializing understanding the importance of protection for knowledge to ulos craftsmen in Tobasa Regency. From its definition and scope, traditional knowledge is closely related to the ownership and characteristics of ulos communal ownership. It also reflects the concept of ulos legal ownership. It becomes new problems in Indonesia because Indonesia has not had specific regulation which regulates Protection for Traditional Knowledge so far. The research used juridical normative and descriptive analytic method by analyzing legal provisions such as Law No. 28/2014 on Copyright, Law No. 13/2016 on Patent Rights, and Law No. 5/2017 on Advancing Culture.
