Abstract

DOSEN PEMBIMBING:1. Budiman Ginting2. Bastari3. Muhd. Yamin Perda (Regional Regulation) on Tax and retribution does not give authority to local government in stipulating the types of new tax and retribution even though local government has bigger opportunity to make Perda on regional tax and retribution. Examination on its regulation becomes very important in the current governmental era. Government’s supervision on Perda is done in order that local government’s policies are not contrary to public interest and to higher regulations. It is also intended to make certain that the Perda has been accordance with the principles of making legal provisions. The result of the research shows that supervision system in making Perda of Districts/Towns is repressive in which Perda on PDRD submitted to the central government can be revoked by the central government when it is contrary to public interest and higher legal provisions. The legal consequence of the violation against the obligations of supervision in Perda on BPHTB is administrative sanction and sanction of delay on the evaluation of Perda draft.Keywords: Regional Tax and Retribution, Supervision on Regional Regulations

Dedi Harianto Financing company is a business which operates in a non-bank financial institution by providing fund or capital by not taking the fund directly from the people in the from demand deposit, deposit, savings, and P.G (promissory note). The result of the research showed that debtor’s default in fiduciary contract between debtor and financing company is that debtor does not fulfill one of the clauses in the contract. He does not keep and take care of the collateral, motor cycle/mobile, from being broken or missing. Legal protection on the execution of the fiduciary collateral by financing company is as follows, debtor has the right to file compensation, execution should be attended by the police, execution should be based on court’s verdict, selling fiduciary collateral is throught public auction, and dispute between debtor and creditor has to be trought litigation in District Court and BPSK (Costumer Dispute Settlement Board).Keywords: Legal Protection, Debtor, Execution of Collateral

Abstract

SuprayitnoDispute in land at the area of 260 ha between TNI AU, in this instance, Lanud Suwondo and tillers at Kelurahan Sari Rejo, Medan Polonia Subdistrict, has not yet settled. Each party claims that they control the land so that they are in conflict. The research used juridical normative method by analyzing legal provisions such as UUPA No. 5/1960, PP No. 24/1997 on Land registration, and the Supreme Court’s Ruling No. 229.K/PDT/1991. The nature of the research was descriptive analytic by describing and analyzing the research problems and finding the correct answers as their solution. The legal consequence of the Supreme Court’s Ruling No. 229.K/Pdt/1991on both the conflicting parties is that TNI AU, in this instance, Lanud Suwondo is required to comply with the Supreme Court’s Ruling No. 229.K/Pdt/1991 which has accepted the claim of 87 plaintiffs for the tillers by handing in the land at the area of 5.6 hectares to the 87 tillers.Keywords: Land Dispute, TNI AU, in this Instance, Lanud Suwondo, Tillers, Kelurahan Sari Rejo

Abstract

DOSEN PEMBIMBING:1. Sunarmi2. Hasim Purba3. Dedi Harianto A leasing contract comes from the relationship between PKPU petitioner and PKPU petitionee. In settling the debtor’s debt which has fallen due, the judge refers to Law No. 37/2004 on Bankruptcy; he, therefore, accepts the request for PKPU within 30 days commencing from the Verdict is handed down. The debt in leasing contract becomes the reason of requesting for filing bankruptcy with the principle of business continuity in helping pay off the debt between PKPU petitioner and PKPU petitionee. By debt restructuring, debtor’s debt will be paid off. Even though the leasing down-payment has been paid, leasing contract cannot be stopped before the period of leasing ends. A creditor, who thinks that the debtor will not be able to pay off  when it falls due, will give an opportunity to the debtor to pay off the debt and reorganize his company based on good faith.   Keywords: Debt, PKPU, Leasing

Madiasa Ablizar Notary is a general official authorized to make authentic deeds as stipulated in the format and content based on the prevailing laws and regulations in the field of authentic deed making in general and authentic notary deeds in particular. The type of research used in this study is normative legal research. The nature of this research is analytical descriptiv. The results of the discussion of the problems that arise in this study is the arrangement of the regional notary honorary assembly in providing answers to approval at the request of investigators, public prosecutors and judges in the judicial process as stipulated in the Regulation of the Minister of Law and Human Rights Number 7 of 2016 concerning Notary Honorary Assembly. Conduct self defense where in the examination conducted by the examining body formed by the notary regional council chairman and the notary can make other legal remedies by filing an objection to the request of the investigator in the judicial process that is given by the notary honor council to the local State Administrative Court. Hasim Purba The research used juridical normative and descriptive analytic method.Secondarydata were gathered by conducting library research and analyzed by usingqualitative data, and the conclusion was drawn deductively. The conclusion isthat the causes of the overlapping legal standing of land in the society arepsychological factor, in which people do not understand the legal aspect of landso that they do not register their land, the weakness in registering their land, theweakness in the regulation of registering their land, incomplete digital map, lackof coordination in surveying and land registering, ignorance in surveying andissuing land certificate, and lad mafia. The efforts made by BPN in forestall it isby improving the performance by controlling administration and coordinationbetween the sections and the village management, and recording registeredcertificatesinto digital maps. Bastari The rights of the Directorate General of Taxes over tax arrears collection to a taxpayer who has been declared to be bankrupt are frequently ignored. In fact, it is one of the revenues of the country which is used for the benefit of the society. There is a legal phenomenon related to such thing found in the case No.759 K/Pdt.Sus-Pailit/2016 in which the authority and rights of the Directorate General of Taxes are restored after they were lost due to the Court Ruling No. 3/G.lain-lain/2016/PN.Niaga.Surabaya. The research problems are about the authority and rights of the Directorate General of Taxes are over the tax arrears collection to PT. Tiga Daratan which has been declared to be bankrupt, about the fulfillment of legal certainty principle in the Ruling of the Supreme Court No. 759 K/Pdt.Sus-Pailit/2016, and about the legal consequence of the Ruling of the Supreme Court No. 759 K/Pdt.Sus-Pailit/2016. Abstract

Dosen Pembimbing:1.  Prof. Dr. Sunarmi, SH, MHum2.  Prof. Dr. Hasim Purba, SH, MHum3.  Dr. Dedi Harianto, SH, MHum The research problems formulated based on this case are: 1) What factors can cause the annulment of reconciliation agreement in PKPU process, 2) How about the legal consequence for the debtor if the annulment of the reconciliation agreement is approved or objected, 3) What the basis of the judge’s consideration to settle and pronounce the case in Case No. 376K/Pdt.Sus-Pailit/2017 and Case No. 749K/Pdt-Sus-Pailit/2016. The research applies normative juridical method with descriptive analysis. Library research and field research are done to collect the data by conducting document study and guided interviews. The data are analyzed qualitatively and the conclusion is drwan deductively, from general to specific things. The results of the resaerch demonstrate that the application for an annulment of a reconciliation aggreement, that has been validated by the Judge and approved by creditor and debtor, can be either objected or accepted.Keywords: Reconciliation, Homologa tie, PKPU (Suspension of Debt Payment Obligation)
