Abstract

This type of research is library research, the data sources are primary, secondary and tertiary data sources. The data collection techniques used are in the form of laws and regulations, books, journals, papers, articles and others. Using analytical descriptive method. From the results of the study it is concluded that domestic violence in the form of beatings against wives or other forms of physical violence is not justified in positive law, namely in Law No. 23 of 2004 concerning the Elimination of Domestic Violence in any form. In Islamic Law domestic violence is not justified. it is allowed to beat the wife on the grounds of disobedience to the husband, namely with stages by stages. Abstract

This article reviews the concept of Islamic economics related to the role of money according to the thought of Abu Ubaid (154-224 AH). In his work, Kitab Al-Amwal, Abu Ubaid highlights the importance of justice as a fundamental principle. Although written in the past, Abu Ubaid's ideas remain relevant in the current economic and social context, especially in efforts to maintain fairness in wealth distribution and transparency in public financial management. Money in Abu Ubaid's view has a dual role, as a standard and medium of exchange. The principles advocated by Abu Ubaid can be valuable guidelines for policy makers in designing an inclusive and sustainable economic system. Thus, an understanding of Abu Ubaid's thought can provide valuable insights in the development of a just and efficient Islamic economy.

Abstract

Child marriage remains a serious social issue in Indonesia, as observed in Pare, Kediri Regency, despite Law No. 16 of 2019 setting the minimum age for marriage at 19 years. This phenomenon is triggered by various factors such as economic pressure, low educational attainment, and cultural and family norms. The negative impacts of child marriage are highly detrimental, including health risks such as pregnancy and childbirth complications, limited access to education, psychological distress, and financial instability. From the perspective of Islamic economic law (hukum ekonomi syariah), financial readiness is a crucial aspect for household sustainability and well-being, as emphasized in the principle of al-qudrah 'ala an-nafaqah. Therefore, the socialization activities on preventing child marriage carried out by Hasyim Asy'ari University students at SMP Negeri 3 Pare are a strategic step to equip adolescents with an understanding of the importance of delaying marriage until an ideal age and achieving comprehensive readiness, including economic aspects, to secure the future of the younger generation.

Abstract

This study examines the behavior of producers in fulfilling the obligation of halal certification for processed tempeh products at UD. Muncul Jaya from the perspective of Islamic business ethics. Using an empirical juridical method, the research explores the producer’s traditional background and their transition toward compliance with legal and sharia principles. The findings show that UD. Muncul Jaya has made efforts to uphold the principles of trustworthiness (amanah), honesty (ṣidq), halalan thayyiban, and to avoid deception (tadlīs) and uncertainty (gharar). Although halal certification was only pursued after decades of operation, the producer has shown a positive transformation through increased halal literacy and commitment to ethical Islamic values in business. Abstract

This study examines the implementation of halal certification prerequisites in production management at Bakso Barokah Home Industry in Kayen Hamlet, Kayangan, Jombang, in the perspective of Islamic business ethics. In the midst of increasing Muslim awareness of the importance of halal consumption, halal certification is a crucial legal instrument as stipulated in Law Number 33 of 2014. However, at the micro and small business level, the process of implementing this certification often faces various challenges, both administrative, technical and socialization. This study uses a juridical-empirical approach with data collection techniques through observation, interviews, and field documentation. The results showed that business actors have moral and spiritual awareness of the importance of halal products, but have not been able to fulfill all formal requirements set by the halal certification authority, especially in the aspects of raw material documentation, supply legality, and production traceability. Of the five indicators of Islamic business ethics of the halalness of raw materials, production processes, worker welfare, product quality, and social responsibility, only two are adequately met. This lack of formal standards is rooted in limited knowledge, access to information, and cost constraints. This research recommends the need for synergy between business actors, government, and religious institutions to provide intensive education and assistance. The implementation of Islamic business ethics not only strengthens the spiritual integrity of business actors, but also becomes the foundation for legal, ethical, and competitive business sustainability in the national and global halal market. Abstract

This study examines the Qur’anic and Prophetic evidences (dalil) in a clearer, adaptive, and applicative manner concerning the principles and contracts of Islamic financial management. The study is motivated by the growing need for financial management concepts that are not only technically effective but also aligned with ethical and religious values, grounded in the definitive sources (al-Qur’an and Sunnah) in a more explicit, adaptive, and applicative framework. Principally, Islamic financial management applies foundational principles such as the prohibition of riba (usury), prohibition of maysir (speculative behavior), obligation to fulfill contracts, the principle of money as a medium of exchange, risk-sharing, compliance with Sharia rules, and the command to uphold justice. In practice, Islamic financial management employs various contracts, both tabarru’ contracts (benevolent contracts) such as hibah, wakalah, kafalah, hawalah, rahn, qard, and wadi‘ah, as well as tijari contracts (commercial-oriented contracts) such as murabahah, mudharabah, ijarah, musyarakah, and sharf. The findings indicate that the principles and contracts of Islamic financial management are explicitly established and legitimized in the Qur’an and Sunnah, as supported by Qur’anic exegesis from classical scholars and hadith commentaries.
