Abstract

Hukum merupakan produk dari dinamika sosial, politik, dan ideologis yang tidak pernah netral. Dalam konteks Indonesia, pembentukan KUHP berdasarkan UU No. 1 Tahun 2023 tidak hanya menjadi simbol kedaulatan hukum nasional, tetapi juga medan kontestasi ideologi. Penelitian ini bertujuan mengkaji peran hukum Islam dalam formulasi KUHP melalui perspektif teori hegemoni Antonio Gramsci, serta menganalisis bagaimana proses legislasi mencerminkan dominasi nilai dan konsensus ideologis kelompok tertentu. Dengan menggunakan metode yuridis normatif dan pendekatan kualitatif, studi ini menelaah pasal-pasal kontroversial yang memuat norma moral keagamaan, seperti larangan perzinaan, kohabitasi, dan pembatasan aborsi, sebagai ekspresi hegemonik dari nilai-nilai dominan. Temuan menunjukkan bahwa hukum Islam tidak sekadar hadir sebagai sumber etika publik, melainkan juga sebagai alat hegemonik yang dilembagakan melalui mekanisme legislasi formal. Proses ini berlangsung melalui artikulasi wacana, legalisasi nilai, serta kooptasi institusional oleh elite politik dan keagamaan. Dalam kerangka Gramsci, KUHP menjadi instrumen pedagogis negara untuk membentuk kesadaran sosial yang mengafirmasi nilai mayoritas, namun mengabaikan keberagaman. Oleh karena itu, pendekatan kritis terhadap legislasi diperlukan untuk memastikan bahwa hukum berfungsi sebagai instrumen keadilan substantif, bukan dominasi ideologis.

Abstract

This article examined the practice of baganyi in Minangkabau society, particularly in Nagari Panampuang Ampek Angkek District, which referred to the act of a husband leaving his wife’s residence without clear legal or marital resolution. The study aimed to analyze the social and customary meanings of baganyi, its impact on women’s rights, and efforts to integrate customary law with Islamic law in addressing this practice. The study employed a descriptive qualitative approach. Data were collected through in-depth interviews and documentation involving perpetrators of baganyi, abandoned wives, customary leaders, and community figures. The findings indicated that baganyi was interpreted as a customary mechanism for resolving domestic conflicts. However, this practice often neglected principles of gender justice and failed to provide adequate legal protection for women. Conflict resolution that relied excessively on customary mechanisms without synergy with Islamic law and formal legal institutions tended to perpetuate structural inequalities against women. The study implied the need for an integrative approach that combined customary values, sharia principles, and formal legal protections in order to establish a system of domestic conflict resolution that was just, humane, and civilized.

Abstract

This study examined the importance of determining wali adhal by the Tanjung Pati Religious Court from the perspective of maqashid sharia. The research was motivated by cases in which a legal guardian (wali) refused to marry off a woman under his guardianship, where the reasons for such refusal were not justified under Islamic law. This refusal prompted the woman to submit a wali adhal petition to the Religious Court, as the guardian’s unwillingness to act as a marriage guardian obstructed the performance of the marriage contract and resulted in injustice toward her. To assess the urgency of the Religious Court’s determination in resolving wali adhal cases, the author conducted an in-depth analysis of a specific case decided by the Tanjung Pati Religious Court, namely case number 0041/Pdt.P/2018/PA.LK. This study employed a qualitative and descriptive research approach, using content analysis techniques and a hermeneutical approach to examine the urgency of wali adhal determination in light of the maqashid sharia framework. The findings demonstrated that the determination of wali adhal by the Religious Court played a crucial role in realizing public welfare (mashlahah) when a guardian refused to marry off a woman under his guardianship without a valid sharia-based reason. This determination safeguarded the objectives of Islamic law as articulated in the principles of maqashid sharia, namely hifzh al-nasl (protection of lineage), hifzh al-nafs (protection of life), and hifzh al-din (protection of religion)

Abstract

Marriage in Islam is regarded as a sacred bond (mitsaqan ghalidzan) aimed at establishing a harmonious family and preserving lineage. However, not all married couples are granted children despite sustained efforts. This condition is known as involuntary childlessness, referring to couples who are unable to have children due to medical or biological factors, often resulting in psychological, social, and religious pressures. This study aims to analyze the family resilience of involuntarily childless couples in Simalanggang, West Sumatra, through an integrated perspective of Islamic family law, family psychology, and socio-cultural values of Minangkabau society. The research employs a qualitative method with an empirical approach, combining field research and library research. Data were collected through unstructured interviews and observations involving involuntarily childless couples and local community members, and analyzed descriptively and analytically. The findings indicate that although involuntarily childless couples face social stigma, cultural pressure, and external conflicts, they are able to maintain marital harmony through open communication, emotional support, reinforcement of religious values, and mutual respect. Family resilience is not solely determined by the presence of children, but rather by the quality of the spousal relationship encompassing physical, psychological, social, cultural, and spiritual dimensions. This study contributes to the development of Islamic family law discourse and provides a foundation for formulating social and psychological support policies that are more sensitive to the needs of involuntarily childless couples based on religious and local cultural values.

Abstract

Cases of rape against perimenopausal women in Indonesia often created ethical and legal dilemmas concerning abortion, in which the right to life of the fetus conflicted with the victim’s rights to physical and mental health, as well as human dignity. This study examined the regulation of abortion under positive law (Articles 346–349 of the Criminal Code and Article 60 paragraph (2) of Law No. 17 of 2023) and analyzed it from a human rights perspective in balancing these competing rights, particularly in relation to elderly victims who were vulnerable to prolonged psychological trauma. The study employed a qualitative normative approach based on library research. Research data were derived from statutes, academic journals, and legal literature, and were analyzed using a descriptive-analytical method. The findings indicated that abortion was legally permitted in cases of rape with medical indications. However, the study emphasized that priority should be given to the health of perimenopausal victims, considering the high risks associated with pregnancy at that age. The analysis highlighted the importance of restorative justice, legal protection for medical professionals, and efforts to reduce social stigma. The study recommended regulatory revisions to ensure more responsive access to abortion services that took individual circumstances into account, in order to realize a just human rights framework.

Abstract

This study analyzed Ijtima’ Komisi Fatwa (se-Indonesia) VIII number: 02/Ijtima’ Ulama/VIII/2024 issued by the Indonesian Ulema Council (Majelis Ulama Indonesia) concerning the prohibition of interfaith greetings from the perspectives of maqasid al-sharia and religious moderation in Indonesia. The fatwa generated diverse societal responses due to its implications for tolerance and interreligious relations in a pluralistic context. Supporters viewed the prohibition as a preventive measure to protect Islamic faith (hifzh al-din) and to maintain clear theological boundaries, while critics considered it insufficiently contextualized and potentially detrimental to social harmony and interfaith dialogue. This study employed a qualitative library research approach by examining official MUI fatwa documents, classical and contemporary Islamic legal theories, and relevant academic literature. Data were analyzed using content analysis and a descriptive-analytical method. The findings showed that the fatwa was grounded in the principle of hifzh al-din as a primary objective of Islamic law, aiming to prevent syncretism and ritual imitation. However, a comprehensive maqasid sharia approach required the fatwa to also consider social harmony and mutual respect among religious communities. The study concluded that the fatwa sought to balance doctrinal integrity with social coexistence, thereby contributing to the discourse on religious moderation in Indonesia.

Abstract

The practice of marriage without official registration (nikah 'urfi) has shown a significant increase in various Muslim countries, including Egypt and Indonesia. This phenomenon has generated tension between religious validity and state legal recognition, giving rise to social and legal problems as well as challenges in the protection of civil rights, particularly for women and children. This article aims to analyze the fatwa of Ali Jum’ah on nikah 'urfi using the framework of maqasid al-sharia. This study employs a normative–philosophical approach through content analysis, combined with a comparative examination of Ali Jum’ah’s fatwa and classical as well as contemporary fiqh literature. The findings indicate that although Ali Jum’ah acknowledges the formal validity of nikah 'urfi from a fiqh perspective, he considers the practice to be contrary to the maqa?id al-sharia because it threatens the protection of lineage (hifzh al-nasl), human dignity (hifzh al-'ird), and civil rights (hifzh al-huquq). Consequently, marriage registration is viewed as a shari' obligation aimed at safeguarding family welfare and ensuring social stability. This article concludes that Ali Jum’ah’s maqa?id-based approach represents a model of contemporary ijtihad capable of bridging classical fiqh and the legal demands of the modern nation-state.

Abstract

Unregistered marriage (nikah siri) remains a prevalent marital practice in Indonesia despite its lack of recognition under state law. This practice gives rise to various legal and social problems, particularly affecting women and children, including uncertainty regarding legal status, lineage, and the protection of rights to maintenance and inheritance. These conditions prompted the Indonesian Ulema Council (Majelis Ulama Indonesia/MUI) to issue Fatwa No. 10 of 2008 on Unregistered Marriage. This study aims to analyze the fatwa from the perspective of maqa?id al-sharia. The research employs a normative legal method with a qualitative approach through library research, examining the MUI fatwa, statutory regulations, classical fiqh literature, and relevant scholarly journal articles. The findings indicate that MUI recognizes the validity of unregistered marriage from a fiqh perspective insofar as the essential pillars and conditions of marriage are fulfilled; however, it deems such marriages unlawful when they result in harm (ma?arrat) and recommends official marriage registration as a preventive measure. Nevertheless, the fatwa is considered ambiguous because it fails to provide clear criteria for determining harm. From the perspective of maqasid al-sharia, the practice of nikah siri generally contradicts the objectives of Islamic law, particularly in safeguarding religion, life, intellect, lineage, and property. Therefore, official marriage registration constitutes an essential instrument for realizing public welfare, legal certainty and the protection of family rights within Indonesia’s Islamic legal system.
