Abstract

This study aims to analyze the effectiveness of an educational and mentoring program on Sharia business contracts for micro-entrepreneurs in enhancing Islamic economic law literacy and improving their adaptability to digital contracts in the era of economic transformation. The program was motivated by the limited understanding of Sharia contract principles among micro-entrepreneurs and the weak legal aspects in drafting business agreements. The implementation method consisted of three stages: participants’ needs analysis, conceptual education on Sharia contract law, and practical mentoring in drafting and applying digital Sharia-based contracts. Evaluation was conducted through pre-tests and post-tests, contract portfolio analysis, and participatory observation. The results indicate a significant improvement in participants’ understanding, from 54% to 96%, and a 65% increase in their ability to draft Sharia business contracts. Furthermore, 80% of participants successfully produced electronic contract drafts using murabahah and musyarakah schemes consistent with Sharia principles and the provisions of Law No. 11 of 2008 on Electronic Information and Transactions (ITE Law). These findings demonstrate that an educational and participatory approach effectively fosters legal awareness, business ethics, and technological readiness among micro-entrepreneurs. Conceptually, the program strengthens the integration between Sharia values and business digitalization, establishing a foundation for a just, transparent, and sustainable micro-enterprise ecosystem.

Abstract

This study aims to analyze the effectiveness of community-based legal education and advocacy in enhancing legal awareness and expanding access to justice for marginalized communities. These groups often face structural and cultural barriers in exercising their legal rights due to limited knowledge, restricted access to information, and insufficient legal resources. Employing a qualitative descriptive approach, the research was conducted in three urban areas with low-income populations. Data were collected through participatory observation, in-depth interviews, and documentation from legal aid institutions (LBH), and analyzed using the interactive model of Miles and Huberman. The findings indicate that community-based legal education has improved public legal understanding by up to 68%, encompassing awareness of legal rights and obligations, reporting mechanisms, and the principle of equality before the law. The participatory and contextual approach proved effective by providing learning experiences relevant to the participants’ social realities. Local paralegals played a crucial role as intermediaries between communities and formal legal institutions, strengthening both advocacy independence and program sustainability. The study highlights the importance of multi-stakeholder collaboration among legal aid organizations, academia, and local governments in developing an inclusive and sustainable model of community legal empowerment. Thus, legal education functions not only as a medium for enhancing legal literacy but also as an instrument of social transformation toward a legally conscious, empowered, and just society.

Abstract

Penelitian ini bertujuan untuk menganalisis peran strategis Kantor Pelayanan Pajak (KPP) Pratama Bandar Lampung Dua dalam meningkatkan kesadaran dan kepatuhan wajib pajak terhadap kewajiban perpajakan serta meninjau pelaksanaannya dari perspektif Fiqh Siyasah. Pajak merupakan sumber utama penerimaan negara yang berfungsi menopang pembiayaan pembangunan nasional. Namun, rendahnya kesadaran dan kepatuhan masyarakat masih menjadi kendala dalam optimalisasi penerimaan pajak. Penelitian ini menggunakan metode kualitatif dengan pendekatan deskriptif melalui observasi, wawancara, dan dokumentasi di KPP Pratama Bandar Lampung Dua. Hasil penelitian menunjukkan bahwa KPP memiliki peran dominan sebagai pelaksana kebijakan perpajakan di tingkat operasional, khususnya melalui empat fungsi utama: pelayanan, penyuluhan, pengawasan, dan penegakan hukum. KPP aktif melaksanakan kegiatan edukasi melalui sosialisasi langsung maupun media digital untuk meningkatkan pemahaman wajib pajak, memperkuat sistem pengawasan berbasis teknologi, serta menegakkan sanksi bagi pelanggaran administrasi dan pidana. Upaya tersebut terbukti meningkatkan kepatuhan wajib pajak dan memperbaiki realisasi penerimaan pajak daerah. Dalam perspektif Fiqh Siyasah, peran KPP sejalan dengan prinsip tanggung jawab Ulil Amri dalam menjaga kemaslahatan umat melalui kebijakan keuangan publik. Dengan demikian, KPP Pratama Bandar Lampung Dua telah berperan efektif sebagai instrumen negara dalam mewujudkan keadilan sosial dan kesejahteraan masyarakat melalui sistem perpajakan yang profesional dan berintegritas.

Abstract

Tindak pidana korupsi merupakan kejahatan luar biasa yang berdampak sistemik terhadap keuangan negara dan kepercayaan publik terhadap sistem hukum. Salah satu persoalan krusial dalam pemberantasan korupsi adalah inkonsistensi pemidanaan, khususnya pengurangan hukuman oleh hakim pada tingkat banding. Artikel ini bertujuan untuk menganalisis secara yuridis normatif ketentuan penerapan hukum pidana serta pertimbangan hakim dalam pengurangan hukuman pelaku tindak pidana korupsi berdasarkan Putusan No. 10/PID.TPK/2021/PT DKI. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan studi putusan. Bahan hukum diperoleh dari peraturan perundang-undangan, doktrin hukum, serta putusan pengadilan yang relevan. Analisis dilakukan secara deskriptif kualitatif. Hasil penelitian menunjukkan bahwa pengurangan hukuman dari 10 tahun menjadi 4 tahun penjara dalam perkara tersebut tidak memiliki dasar hukum yang kuat dan bertentangan dengan semangat pemberantasan tindak pidana korupsi. Pertimbangan hakim dinilai lebih menekankan aspek non-yuridis dibandingkan prinsip keadilan, kepastian hukum, dan kemanfaatan. Kesimpulannya, praktik pengurangan hukuman yang tidak proporsional berpotensi melemahkan efek jera dan merusak kepercayaan publik terhadap sistem peradilan pidana.

Abstract

A land title certificate is a document that indicates ownership or control over land. Therefore, the government requires land registration throughout Indonesia so that each landowner receives legal guarantees and protection for their land ownership. One type of initial land registration is sporadic land registration, which is the first registration of one or more land registration objects within a village/sub-district, either individually or collectively. Based on this background, the author wishes to examine the use of Letter C in sporadic land registration in Regency. The research method used is empirical juridical, looking at social phenomena related to law in legislative practice in Indonesia. The empirical juridical approach examines how normative provisions are actually realized in society. The results of the study show that Letter C is still used today as an absolute requirement for sporadic land registration

Abstract

This research aims to analyze the legality and procedures for seizing virtual assets in criminal cases in Indonesia and identify execution challenges for Registered Crypto Asset Traders. The transformation of national criminal law through Law No. 1 of 2023 shifts the paradigm towards corrective justice emphasizing asset recovery, yet digital asset technology creates new juridical complexities. The research method used is normative juridical with a statutory and conceptual approach through literature study techniques. The results show a procedural legal vacuum in Law No. 20 of 2025 on the Criminal Procedure Code, which is still based on the physical asset paradigm, thus failing to reach decentralized digital asset characteristics. Although Law No. 4 of 2023 and OJK Regulation No. 23 of 2025 recognize crypto as a digital financial asset, its position in corporate capital structures under Law No. 40 of 2007 remains ambiguous. The main execution hurdles lie in extreme price volatility and the absence of technical protocols for investigators to gain digital access. This study recommends a seizure concept through a mechanism of converting virtual asset values into Rupiah at the time of seizure to lock the asset's economic value. This step is crucial to provide legal certainty for the state in recovering losses and protecting the defendant's rights from asset value depreciation during the judicial process. Therefore, regulatory synchronization between criminal procedure law and digital financial sector law is an absolute prerequisite for effective economic law enforcement in the digital era.

Abstract

Land administration institutions play a central role in ensuring legal certainty over civil rights attached to land. This article comparatively examines the legal status, legal basis, and institutional structure of the National Land Agency (Badan Pertanahan Nasional/BPN) in Indonesia and the Dutch Cadastre, Land Registry and Mapping Agency (Het Kadaster) in the Netherlands, two institutions historically connected through the legacy of Dutch colonial law. Using a normative juridical legal research method with statutory and conceptual approaches, this study finds that although Indonesia's land law system has been significantly influenced by the Dutch legal tradition, the two countries have developed different institutional models. The National Land Agency (BPN) remains a centralized government institution under the authority of the President of Indonesia, whereas the Dutch Kadaster has operated as an autonomous administrative body (zelfstandig bestuursorgaan) since 1994. These institutional differences have implications for the level of flexibility, accountability, and the pace of digital transformation in each organization. This article recommends strengthening the functional independence of BPN and accelerating the digitalization of land administration services as key priorities for future institutional reform.

Abstract

Waqf land certification plays a crucial role in providing legal certainty and protection for waqf assets in Indonesia. This study aims to analyze the optimization of waqf land certification as a form of legal protection in Sekanah Village, North Lingga District, Lingga Regency, and to examine it through the perspective of hifz al-mal (protection of property) within maqasid al-shariah. Using a qualitative method with a socio-legal (empirical juridical) approach, data were collected through interviews, observation, and documentation involving the Head of the Religious Affairs Office (KUA) as PPAIW, the village head, nazhir, religious leaders, and the Indonesian Waqf Board (BWI). Data were analyzed using the interactive model of Miles, Huberman, and Saldaña. The findings reveal that several plots of waqf land used for mosques and public facilities remain uncertified due to the absence of Waqf Pledge Deeds (AIW) for orally declared old waqf, incomplete ownership documents, and weak coordination among stakeholders, compounded by the archipelagic geography of Lingga Regency. These obstacles are administrative and technical rather than related to the shariah validity of the waqf. The study concludes that certification serves as a substantive instrument of hifz al-mal, ensuring legal certainty and the sustainability of waqf benefits for the community

Abstract

Disparities in access to justice across Indonesia place paralegals as essential frontliners in delivering pro bono legal aid to impoverished and marginalized communities. However, legal standing of paralegals has experienced severe normative restrictions following Supreme Court Decision Number 22 P/HUM/2018, which revoked their litigation authority due to conflicts with the Advocates Law. This study aims to analyze the contemporary regulatory dilemmas surrounding paralegals and formulate  comprehensive legal reconstruction concept grounded in substantive justice and legal certainty. Employing normative legal research, this study applies statutory, conceptual, and comparative approaches using descriptive-prescriptive analysis based on extensive library data. The findings reveal that the current framework under Law Number 16 of 2011 and Ministerial Regulation Number 3 of 2021 exhibits fundamental normative frailties. These deficiencies include the absence of statutory immunity rights, ambiguous boundaries of authority in case handling, fragmented training curricula, and the inadequate hierarchical binding force of ministerial regulations over other law enforcement agencies. Consequently, regulatory reconstruction is imperative through legislative reforms anchored in Dignified Justice and Social Engineering legal theories. This reconstruction entails establishing a graduated limited right of audience for minor offenses and preliminary examinations, standardizing national competencies through the Indonesian National Qualifications Framework.
