Abstract

This research is motivated by the rise of online sales fraud cases on the island of Bali that are detrimental to consumers, the purpose of this research is to analyze it from the aspect of juridical studies and the basis of judges' decisions in deciding cases, this research uses a normative method with a library approach, the results of the study show that online fraud crimes utilize digital technology to manipulate data, here the defendant uses fake transfer evidence as a tool to deceive the store that meets the elements in Article 378 of the Criminal Code, namely the intention to benefit oneself unlawfully, and Article 35 of the ITE Law concerning manipulation of electronic information with the aim of making the data considered authentic, the basis for the judge's consideration to pass a verdict because the existence of photos of transfer evidence and the victim's account balance is sufficient to convince the judge that the defendant is guilty. Legal protection for victims of online fraud has been regulated in the Consumer Protection Law, the ITE Law and government regulations related to electronic transactions, but to strengthen preventive and systemic efforts, public education and increased capacity of law enforcement officers are needed, With the latest regulations such as Law No. 1 of 2024 concerning the second amendment to the ITE Law, Presidential Decree No. Law No. 49 of 2024 concerning the National Strategy for Consumer Protection and Minister of Trade Regulation No. 17 of 2024 concerning the National Action Plan for Consumer Protection have implications for strengthening legal protection for victims of online fraud, which is expected to provide a sense of security in digital transactions.

Abstract

This study examines the role of the private sector in collaborative politics to strengthen human security in preventing human trafficking in Kupang City, East Nusa Tenggara Province. Human trafficking is an extraordinary crime that poses serious threats to human security, particularly for Indonesian Migrant Worker Candidates (CPMI) who are highly vulnerable to exploitation and illegal recruitment. The complexity of this issue requires the involvement of multiple actors, including not only the government but also the private sector. This research employs a qualitative descriptive method, with data collected through interviews, observation, and documentation. The research sites include BP3MI East Nusa Tenggara as a government representative and two private companies, PT Bakti Unggul Sejahtera (PT BUS) and PT AKKA AL-MATAR. The analysis is based on the collaborative governance framework proposed by Ansell and Gash, which emphasizes face-to-face dialogue, trust building, commitment to the process, shared understanding, and intermediate outcomes. The findings indicate that collaboration between the government and the private sector plays a significant role in preventing human trafficking through legal recruitment processes, pre-departure training, capacity building, and supervision of labor placement procedures. Although challenges remain in coordination and policy consistency, these collaborative practices contribute positively to strengthening the protection of migrant workers’ rights and security. This study concludes that collaborative politics between the government and the private sector is a crucial strategy in developing a human security–oriented human trafficking prevention system

Abstract

The rapid development of digital technology has increased the risk of song copyright infringement, thereby requiring effective and adaptive law enforcement mechanisms. Song copyright, as part of intellectual property rights, is protected under Law Number 28 of 2014 on Copyright, with certain infringements classified as complaint-based criminal offenses. This study aims to analyze the handling of criminal cases of song copyright infringement by Civil Servant Investigators at the Regional Office of the Ministry of Law in West Java and to evaluate the effectiveness of their enforcement practices. The research employs a normative-empirical method with a descriptive-analytical approach, combining statutory analysis with empirical data obtained through interviews and field observations. The findings reveal that case handling is conducted through structured stages, including complaint submission, preliminary examination, mediation, and follow-up actions. Mediation constitutes the primary mechanism for dispute resolution, reflecting the application of the ultimum remedium principle and a restorative justice approach. Although the procedural framework has been implemented in accordance with applicable regulations, enforcement effectiveness remains constrained by limited human resources, budgetary limitations, insufficient technical capacity, low public legal awareness, and inadequate inter-agency coordination. These results underscore the importance of strengthening institutional capacity and enhancing enforcement effectiveness to ensure sustainable protection of song copyright.

Abstract

This study aims to analyze the legal status of jointly managed social media accounts within the framework of marital property in Indonesia. The growth of the digital creative economy has transformed social media accounts into productive assets with economic value, yet Indonesian civil law has not provided legal certainty regarding their ownership status following divorce or death. The research method employed is normative legal research with a comparative legal approach. The results indicate a regulatory void in Law Number 1 of 1974, which remains oriented toward physical objects, while digital accounts are often regarded as personal rights tied to the registered individual. Conversely, digital regulations in the European Union, through the General Data Protection Regulation (GDPR) and the concept of digital estate, have begun to accommodate the continuity of access and management of digital assets for relevant parties. The discussion emphasizes the need for a redefinition of assets in Indonesian family law that synchronizes privacy rights with economic rights. In conclusion, productive social media accounts should be qualified as marital property through progressive interpretation or prenuptial agreements. This study recommends the synchronization of personal data protection regulations and marriage law to ensure distributive justice for couples in the digital economy era.

Abstract

Marriage in Indonesian customary law communities is a social institution that not only binds individuals but also involves families and the wider community, encompassing legal, cultural, and spiritual dimensions. Within this diversity, issues arise regarding the alignment between customary law and national law. The major research problem concerns the forms, requirements, and procedures of marriage in customary law communities, while the minor problem focuses on the dynamics between customary law and national law in terms of validation and legal protection. This study is situated within the general context of customary law communities in Indonesia. The objective is to comprehensively examine customary marriage law and its implications for the national legal system. The research applies statutory and conceptual approaches within a normative legal research framework, using a descriptive-analytical method supported by library research and qualitative analysis. The findings indicate that customary marriage law is diverse, including forms such as bridewealth marriage, semenda, independent marriage, and elopement, all influenced by kinship systems. Furthermore, there is a dualism between customary recognition and state legality, making marriage registration essential to ensure legal certainty.

Abstract

Premature designation of a suspect in the criminal justice process may cause significant legal, social, and reputational harm because such status can result in restrictions on individual rights and public stigma. This study examines the role of pretrial proceedings in protecting the constitutional rights of suspects and formulates the juridical parameters for determining when a suspect designation can be considered premature. The research employs a normative legal method using statutory, conceptual, and case approaches through library research of legislation, court decisions, and legal doctrines. The findings indicate that pretrial proceedings serve as a judicial control mechanism over investigative actions, particularly following the expansion of pretrial jurisdiction that enables courts to assess the legality of suspect designation. A designation may be deemed premature if it lacks at least two valid pieces of evidence, is not preceded by lawful investigative procedures, or violates the principle of due process of law. However, the effectiveness of pretrial proceedings remains limited because judicial review is largely formal, conducted within a short time frame, and unable to fully restore the suspect’s reputation. Therefore, clearer procedural guidelines, enhanced legal capacity of judges and investigators, and reforms to criminal procedural law are necessary to strengthen constitutional rights protection.

Abstract

This study aims to analyze the legal position of PT. Jouska Finansial Indonesia in providing investment recommendations to investors under Law Number 8 of 1995 concerning the Capital Market, as well as to examine the implications of its unclear legal status on legal certainty and investor protection in Indonesian capital market practices. This research employs a normative legal research method using statutory and case approaches. The data sources consist of primary and secondary legal materials analyzed qualitatively. The results indicate that the activities conducted by PT. Jouska Finansial Indonesia juridically fulfill the elements of investment advisory services as regulated under Article 1 paragraph 11 of the Capital Market Law, due to the provision of specific and personalized investment recommendations to investors. However, such activities were carried out without authorization from the Financial Services Authority (Otoritas Jasa Keuangan/OJK), resulting in the absence of legal legitimacy within the Indonesian capital market legal framework. The unclear legal status consequently weakens legal certainty and investor protection, particularly concerning supervision, legal accountability, and dispute resolution mechanisms. Therefore, stronger regulations and supervision over financial education and consultation activities related to the capital market are necessary to ensure optimal legal certainty and investor protection.

Abstract

This study analyzes legal certainty in the distribution of inheritance involving heirs declared absent (Afwezigheid) by the court in Indonesia. The issue of inheritance distribution often becomes complex when one of the heirs is missing or whose whereabouts are unknown, resulting in legal uncertainty regarding the management and transfer of inherited assets. This research uses a normative juridical method through the analysis of several Indonesian court decisions related to Afwezigheid, including Decision Number 102/Pdt.P/2014/PN.Kpj, Decision Number 18/Pdt.P/2022/PN Pwr, Decision Number 46/Pdt.P/2022/PN Pwr, Decision Number 108/Pdt.P/2022/PN Unr, and Decision Number 173/Pdt.P/2025/PN Smr. The results show that the determination of Afwezigheid provides a legal basis for managing the property of absent persons through the supervision of the court and the Heritage Hall (Balai Harta Peninggalan). However, such determination does not eliminate the inheritance rights of the absent heir, but only postpones their implementation until legal certainty regarding the person’s status is obtained. Furthermore, if the absent person later reappears after the inheritance has been managed or transferred, they retain the right to reclaim their property or seek compensation in accordance with Article 479 of the Indonesian Civil Code. This condition demonstrates that legal certainty in inheritance distribution involving Afwezigheid remains conditional and requires more comprehensive regulations to balance the protection of heirs, third parties acting in good faith, and the rights of the absent person.

Abstract

Inheritance disputes are among the most complex family disputes because they involve not only the distribution of inherited property but also emotional relationships and family values among heirs. This study aims to analyze the role of mediators in mediating inheritance disputes and the efforts undertaken by mediators to resolve inheritance disputes through mediation at the Bantul Religious Court in 2024 and 2025. This research employs an empirical normative legal research design with a qualitative and descriptive-analytical approach. Data were collected through interviews, observations, and documentation and subsequently analyzed qualitatively through data reduction, data display, and conclusion drawing. The findings reveal that mediators play an essential role in all stages of mediation, namely the pre-mediation stage, the mediation process, and the post-mediation stage. Mediators act not only as communication facilitators but also as neutral parties in managing conflicts, building trust, and encouraging peaceful agreements among heirs. In addition, mediators employ persuasive approaches, provide an understanding of Islamic inheritance law, manage communication effectively, and utilize caucus techniques to overcome deadlocks during mediation. This study concludes that the success of inheritance dispute mediation is strongly influenced by the mediator's ability to manage legal, emotional, and social conflicts, thereby producing fair settlements and ensuring legal certainty for the disputing parties.

Abstract

Legal protection for consumers against defective products is a crucial issue in the development of modern trade, particularly due to the imbalance of power between business actors and consumers in accessing information and ensuring product safety. This study aims to analyze the forms of preventive and repressive legal protection afforded to consumers, as well as to formulate the responsibilities of business actors for losses arising from defective products under applicable laws and regulations. The research employs a normative juridical method with statutory and conceptual approaches, utilizing primary, secondary, and tertiary legal materials analyzed qualitatively. The findings indicate that the Consumer Protection Act, the Trade Law, Government Regulation No. 29/2021, and other sectoral regulations provide a strong legal foundation for consumer protection, including information obligations, product safety standards, product recall mechanisms, and the imposition of civil, administrative, and criminal liability on business actors. Furthermore, the principles of strict liability and corporate accountability strengthen the consumer’s position in claiming compensation. In conclusion, Indonesia’s consumer protection system is comprehensively regulated, yet requires more effective supervision to ensure business compliance and enhance consumer safety.
