Abstract

Although a marriage may be deemed valid under Islamic Sharia provided it fulfills the essential pillars (arkan) and conditions (shurut) (such as the presence of a guardian (wali) and witnesses) the practice of unregistered marriage (nikah siri) remains a profound socio-legal concern. This paper argues that while religiously legitimate, unregistered marriages often fail to serve as a sustainable solution for marital relationships. No religious framework inherently recommends bypassing legal registration. The absence of official documentation creates a significant legal vacuum, leading to detrimental consequences primarily for women and children regarding their civil rights and inheritance. This study emphasizes the urgency of preventing the normalization of unregistered marriages. It advocates for a deeper understanding of the "true meaning of marriage," which encompasses not only spiritual fulfillment but also legal certainty and social responsibility to ensure the welfare of the family unit.

Abstract

The rapid advancement of medical science and technology has transformed the health sector, prioritizing patient satisfaction and aesthetic perfection. However, this progress often challenges established moral norms and the ontological nature of the human form, particularly in the realm of plastic surgery—or Jirahah Tajmil. Plastic surgery encompasses procedures aimed at enhancing or repairing body parts to improve function or aesthetics. From an Islamic legal perspective, a crucial distinction must be made between reconstructive surgery (hajah), which restores function and corrects congenital or accidental defects, and purely elective cosmetic surgery (tahsiniyyah) aimed at altering God's creation for vanity. This paper analyzes the boundaries of permissible medical intervention, arguing that while Islam encourages health and well-being, technological application must remain subservient to the preservation of human dignity and divine law.

Abstract

This study explores the diverse landscape of Islamic thought in Indonesia through the perspectives of prominent intellectuals. Ahmad Syafi'i Ma'arif categorizes Islamic thought into four distinct paradigms: modernism (evolving into neo-modernism), neo-traditionalism, exclusive Islam, and Muslim secular-modernism. Similarly, M. Dawam Raharjo identifies four styles: Muslim nationalism, humanism, Muslim socialist-secularism, and secular-modernism. Within this discourse, Nurcholish Madjid posits that modernization is inherently synonymous with rationalization. This conceptual framework originates from the liberalization of thought, which seeks to reform traditional cognitive patterns and non-rational (non-aqliyah) procedures into rational (aqliyah) systems. Furthermore, the emergence of Liberal Islam represents a contemporary milestone in Indonesian Islamic discourse. Driven by a dynamic generation of intellectuals, this movement integrates critical modern scholarship to reshape the existing worldview. Liberal Islam proactively challenges regressive cultural and intellectual trends, offering a transformative "hue" to the development of Islamic thought in Indonesia.

Abstract

This paper illustrates that the basic concepts and principles of zakat from the perspective of Islamic jurisprudence are the main foundation in the implementation of this teaching. Recognized types of zakat, such as zakat mal and zakat fitrah, play an important role in creating social justice. The process of calculating and distributing zakat requires a deep understanding so that the goals of community welfare can be achieved. Zakat, with the function of reducing economic inequality, acts as a tool to create fair social balance. However, inhibiting factors, including ignorance and institutional constraints, can influence the effectiveness of zakat implementation in society. In the context of its impact on social development and welfare of the people, zakat has great potential to advance society and create a just environment.

Abstract

Epistemology within the Islamic educational tradition serves as a critical philosophical anchor for understanding the nature, acquisition, and sources of knowledge. This paper examines the "Trilogy of Islamic Epistemology"—comprising Bayani (text-based), 'Irfani (intuitive/gnostic), and Burhani (rational/demonstrative)—which uniquely defines the intellectual landscape of Muslim scholarship. Unlike secular educational models, Islamic educational thought integrates these three dimensions to form a holistic worldview. By employing a multi-faceted methodology—including deduction, induction, and consultation—this study traces how these epistemological roots contribute to the treasury of Islamic pedagogical theory. The findings suggest that the synergy between these dimensions provides a robust framework for responding to contemporary educational challenges while maintaining authentic Islamic characteristics.
