Abstract

IUU (illegal, unreported, unregulated) fishing was deemed by Indonesia as a crime thatinflicted many loss. In Indonesia, IUU fishing mostly occured at Arafura Sea whereAustralian sea territory were partially included. The mentioned problems in this researchare why Indonesia and Australia establish a cooperation to deter IUU fishing at Arafurasea and the affects. The purpose of this research is to explain and analyse the cooperationthat undertaken by Indonesia and Australia to deter IUU fishing at Arafura Sea. For thosepurposes, this research using the liberalism theory, cooperation concept, maritime securityconcept and transnational crime concept as a tool of analysis. This research is conductedby using the qualitative research method with explanative research type through interviewsand literature studies. The cooperation between Indonesia and Australia to deter IUUfishing at Arafura Sea were conducted through bilateral an multilateral efforts. For bothstates, particulary Indonesia, the cooperation are the part of their efforts to create amaritime security with the protection of economic and reliability sector of respective statesas the ultimate goal.

Abstract

This research’s goal is to understand how TRAFFIC’s role as an NGO in the fight againtrhino horns smuggling from South Africa in Vietnam. TRAFFIC was present in Vietnamto assist the Vietnam Government in overcoming the rhino horns smuggling, whichVietnam become the highest contributor to the end of the journey of rhino horn smugglingfrom South Africa. As an NGO, what TRAFFIC do is to advise the government and makean approach to the community itself that in the end the expected output is the people andthe Vietnam Government able to solve the problem. In analyzing the role of TRAFFIC, theresearch use the concept of the role of NGO. The result of this study explains TRAFFIC’srole in Vietnam based on definition of role of an NGO by David Lewis.

Abstract

Since 2007, The Government of Nepal has began implementing Human Trafficking and Transportation Control Act 2064 to curb organ trafficking. In reality, the policy is unable to contain organ trafficking from Nepal to India. Therefore, by using explanative method, this research aims to to analyze the causes of the crime. In order to analyze the cause of organ trafficking from Nepal to India, this research will use the public policy implementation framework from Donald Van Horn and Carl Van Meter. This study finds that organ trafficking from Nepal to India still occured because of the unfulfillment of the following factors; standards and objectives, policy resources, interorganizational communication and enforcement activities, characteristics of implementing agencies, economic, social and political condition and the disposition of implementers, therefore the policy cannot work accordingly.

Abstract

The higher number of drugs users in Indonesia, indicated that drugs smuggling inIndonesia is also increasing. The paths that used by drug traffickers also change by seabecause the sea lane is considered a safe path and can generate more profits compared toother routes. One of the biggest drugs suppliers in Indonesia is China. Therefore, both theGovernment of Indonesia and the Chinese Government agreed to create a cooperation thatis contained in the form of a Memorandum of Understanding. This study analyzed how thecompliance of Indonesia and China in running the Memorandum of Understanding that hasbeen formed in dealing with cases of drugs smuggling through the sea. The author will usethe theory of compliance from Ronald B. Mitchell and seen from the point of view ofIndonesia because Indonesia is a destination country of drugs smugglers from China. Acompliance is closely related to the effectiveness of a form of cooperation. The compliancehere will be measured based on the implementation of the MoU. Indicators of theimplementation are seen from the outputs, outcomes, and impacts of the cases raised.

Abstract

The existence of De Ruyter, Java, and Kortenaer site ships was discovered in Indonesian waters in 2002 for the first time. To commemorate the 75th anniversary of the sinking boats, Indonesia had dived once again into the waters in 2016. Because of the aforementioned dived, Netherlands received a report that all the three ships have gone. Therefore, Indonesia and Netherlands relations has been heat up. However, this problem can be solved through Indonesia and the Netherlands cooperation in join verification of the three Netherlands ships. This research used the concept of national interest and theory of compliance in order to explain why Indonesia and Netherlands cooperate in solving the missing ships. The result shows that Netherlands has an interest in the cooperation undertaken with the Indonesia.. It includes how Indonesia asked the Netherland to protect Kortenaer ships that are still under the water and to rearrange the managerial heritage of underwater culture that has bad image in international stage. Both collaborations are conducted as a form of state compliance with UNCLOS 1982 which has the principle of water civic cultural citizenship that must be done together.

Abstract

Aircraft incident has a less probability than other transportation. However, it has greaterimpact when it is occured. Like aircraft incident that happen to Malaysia Airlines flightMH17. That aircraft had been declared missing when flight toward Dnipropetrovskairspace in Ukraina. After the search, the aircraft went completely dispatch and all thepassenger and flight crew had lost their life. Looking through the Annex 13 of Conventionon International Civil Aviation, rights and responsibility of state when the aircraft incidenthappen and the investigation can be held by several different country particularly theaircraft is on international flight. Therefore, role of international organization is needed tointercede and coordinate states that involved. ICAO is an international organizationspecialized on aviation aspect. ICAO necessarily have a role on the case handle of MH17shootdown. This research have a purpoce to seek the role of ICAO on the case handle ofMH17 shootdown. With the perspective of Neoliberalism Institutionalism, will be knownthe role of ICAO on handling the case. Both the roles performed before and after theshootdown occurred as well as after the investigation report was issued. Methodological ofthis research is qualitative and with the descriptive type of the research. Result of theresearch identified the roles of ICAO as instrument, arena, and actor.

Abstract

International trade relations between Vietnam and China in the contemporary era haveshown significant progress. The increase in trading supported by geographical proximityand differences in comparative advantage of both countries. In conducting internationaltrading activities, Vietnam and China have encountered obstacle in the form of armedrobbery. This study aims to explain how Vietnam and China cooperation in tackling armedrobbery in the waters of Vietnam. This research was done by using qualitative researchmethod with descriptive research type. This research was analyzed by usinginterdependence liberalism theory, international cooperation theory and comparativeadvantage theory. The result of this research is Vietnam and China have agreed to domaritime cooperation. The cooperation is joint patrol between Vietnam and China. In theimplementation of joint patrols have demonstrated a sense of compliance between twocountries against international law. Vietnam and China's maritime cooperation aims tomaintain a cooperative relationship between countries as well as maintain the stability ofsecurity and order at sea from non-traditional threats.

Abstract

In 2013, widespread preaching on wiretapping scandal conducted by the United States and its allies. This news comes after a leak of data about the list of people who tapped included their nationality. Edward Snowden, a former NSA contractor who spread the secret data. Australia was mentioned in the news by wiretapping several key people in Indonesia, including President Susilo Bambang Yudhoyono. In response, the Government of Indonesia took some action as a clarification step by withdrawing the Ambassador, also cutting all bilateral aggrement in security and information sector. This study will aim to examine the causes of the Government of Indonesia in issuing such responses. Using the concept of national security based on the actor's understanding of threats coming measured by its own vulnerabilities. This research proves that the reason the Government of Indonesia in doing the response is based on the existence of national insecurity caused by wiretapping’s threats that are been there cause of vulnerabilty of Indonesian’s technology and information security

Abstract

From national, regional, to international level, the issue of drug abuse becomes one of the most important issues to be resolved. This issue of drug abuse also become a big problem in Indonesia and other countries in Southeast Asia. ASEAN as a regional institution in Southeast Asia region considers this as an urgency that must be handled comprehensively that eventually countries in Southeast Asia have a shared commitment to create a drug-free area. This research contains a discussion of the Indonesian manifestazion to the commitment of ASEAN Drug Free Area in President Joko Widodo era. This study uses the concept of an international regime, which draws conclusions and from data collected in the field. The results of this study show that Indonesia in the era of President Joko Widodo government made efforts in eradicating drugs referring to the work plan of the ASEAN Drug Free Area. The ASEAN Drug Free Area focus in the form of supply and demand reduction is manifested by Indonesia through their national policy. Indonesia is also implementing its policies in accordance with the ASEAN Drug Free Area work plan which is divided into six aspects: (i) Preventive education, (ii) law enforcement, (iii) treatment and rehabilitation, (iv) research, (v) alternative development, and ( vi) law and cooperation.
