Abstract

Indonesia has been known to have abundant natural resources and culture-based creative industries. The country is therefore vulnerable to the practice of fraud of origin. One of many industrial sectors susceptible to thatparticular crime is the wooden furniture businesses. In many cases, it is apparent that natural products and raw materials of Indonesia are being exported without listing the country as the place of origin. The most commonIndonesian material falls within this illegal practice are timber products. In the province of Central Java, Jepara has been a prominent center of timber industry producing high quality timber products and wooden raw materials.From a unique standpoint, the timber industry in Jepara is deeply rooted to the culture and identity of the natives, making the attempt to separate the discussion between timber industry and the people of Jepara not only  imprudent but virtually impossible. By looking at the statistic in which Jepara’s public education level is assessed to be still below the national standard, and as well bearing to the general fact that the timber actors in Jepara are more focused on product sales rather than important technical aspects such as certification of origin, it should be projected that crimes such as fraud of origin could be easily committed in Jepara. This study is using a comparative advantage theory and theories or models of H-O to investigate how the practice of fraud of origin in Jepara occurs and how to resolve such problem.

Abstract

Illegal logging in Indonesia has contributed to the increasing rate of deforestation andforest degradation at the globa level as it is also responsible for the increase of worldcarbon emissions. Considering that problem, Japan present to initiate the Asia ForestPartnership (AFP) in 2002 to combat illegal logging in Indonesia. This research aimed tofind the background of Japan’s commitment to the relief initiative to decrease illegallogging in Indonesia. In analyzing the background, this research uses ConstructivismParadigm by employing qualitative method with explanative type-analytical techniquesthrough interviews and literatures review. From this research, it can be known that theJapanese action in relation to its commitment to reduce illegal logging in Indonesia isstrongly related to the identity of Japan as a eco-centric country with high concern for theenvironment, as a result of the adoption of Shinto’s values.

Abstract

This study aims to determine the persistence of counterfeiting in China which is also calledshanzhai in Hu Jintao regime. This study also provides an overview of the factors thataffect the persistence of counterfeiting or shanzhai in China. This study uses the theory ofconstructivism, which draws conclusions and from the data collected in the field. Theresults of this study indicate that in the regime of Hu Jintao, a change in the role of newidentity in China is a capitalist communist who will create a policy that gave birth shanzhaiin China. And the norm adopted by the Chinese community is Confucianism which latercan affect the counterfeiting in China. In the norms of Confucianism adopted by thisChinese society, do not prohibit the existence of counterfeiting due to counterfeiting issomething that does not violate the norm. Thus, both of these have an effect on the lessefficient and less effective enforcement of intellectual property rights in China.

Abstract

Human trafficking and forced labor has become most vital problem in the industrial world,especially in agriculture, such as agriculture, manufacture, construction and domestic work.Malaysia is well known as one of countries that has not succeed yet in controlling humantrafficking. In 2009 Malaysia has been classified on Tier3. Before 2007, Malaysia did nothave any law that specifically control human trafficking or people smuggling. However,Malaysia has made efforts to combat human trafficking cases in the previous year. UsingMarxism approach, this research tried to explain the reason behind increasing number ofhuman trafficking in Malaysia, in spite of existed regulations. The type of this research isexplanatory, using qualitative method. This research finds that there is exploitation cultureembedded in Malaysia’s social structure which causes high rate number of humantrafficking cases. Exploitation culture itself, as defined by Marxism, is attitute from masterto treat worker as an object, instead of human being.

Abstract

The development of money laundering modus has begun to move into the digital and the internet world, which triggers the emerging of potential of new threats. One of these potentials is the potential threat of cyber laundering through online games. The world of entertainment market, especially in the field of online games that continues to grow has the potential to invite potential money launderers. In Indonesia, this market still does not have a strong regulation. It creates a gap for cyber laundering. This research seeks to see how big the potential threat is and whether the Indonesian government has realized about the potential threat, and how are the chances of the issue to be securitized by the Indonesian government. The research method used is quantitative and qualitative by collecting data and analyzing them to find out how big the potential of the threat and the securitization opportunities of the threat. The result of this research shows that there is a lack of securitization from the Indonesian government due to the related parties in the field of gaming and the government itself has not realized the potential of this threat, so there are gaps that can be entered by potential money launderers.

Abstract

Taiwan holds a significance position for Indonesian economy, one of which can be seenfrom the large number of Indonesian Migrant Workers who work in the country. On theother hand, due to the One China Policy, Indonesia does not have diplomatic relations withTaiwan because Indonesia prefers to recognize the sovereignty of the People's Republic ofChina. Related to these facts, this research aims to determine and analyze the implicationsof the One China Policy toward the protection of Indonesian Migrant Workers in Taiwanbetween 2010 until 2014. Research frameworks used in this analysis are the concept ofhuman security, multi-track diplomacy and rational choice. The method of this research isqualitative with explanative type of research. From this research, it is known that theabsence of diplomatic relations between Indonesia and Taiwan, which are the consequenceof the One China Policy, has weakened the human security protection of the IndonesianMigrant Worker in Taiwan provided by the Government of Indonesia. In addition,inadequate protection of Indonesian Migrant Workers in Taiwan is also caused byspineless bargaining power possessed by Indonesia compared to Taiwan, especially inrespect to imbalance economic relationship between the two.

Abstract

2016 was highlighted as the year of the biggest and scandalous tax havens report in all over the world: the Panama Papers. This report contributes into country initiation in tax contribution and tax evasion criminalization. It highlights and offers new concept of tax havens by providing the new definition in offshore utilization as a part of tax havens scheme. Hence this thesis focuses on UK and BVI (British Virgin Islands) relations on how they form mutual relations in tax havens network and give a detrimental effect toward tax contribution. United Kingdom and British Virgin Islands form an umbilical relations as overseas territory and part of their financial services, hence their presence as part of United Kingdom tax havens assesses as part of United Kingdom contrary and ambivalance. Therefore this research focuses on how hegemonic country preserved their relations with their former colony into one affiliation, and aims on how harmful London curbs their former colony as a part of their offshore nexus in tax havens.

Abstract

PEGIDA or Patriotische Europaer gegen die Islamisierung des Abendlandes is a patriotismgroup of European people against the Islamization of the West. Pegida spreads the antiasylum seeker and Islamophobia propagandas in Germany even in many Europeancountries. This research was conducted to determine the multiple factor that can influencethe existence of Pegida. The method of this research is qualitative with descriptive analysistype of research. The results of this research point out that in its movement Pegida spreadsthe hatred demeanor towards asylum seeker and Islam. The existence of Pegida werecaused by internal and external factors. The internal factors are the simillar of values,identity, norms, and language that are supporting the existence of Pegida. The externalfactors is Germany national regulation based on Constitution Republic Federal Germanyarticle 5, 8, dan 9 which ensure the protection of the freedom of expression, assembly, andassociation as the fundamental rights for every citizens.

Abstract

Tobacco issue has become world’s attention in 1990. The issues that arise due to tobaccoconsumption become the background of international tobacco control regimes establishment,called Framework Convention on Tobacco Control, in 2005. In 2001, a tobacco controlalliance also established in Southeast Asia, it is called Southeast Asia Tobacco ControlAlliance. Malaysia is a country that faces high illegal cigarette trade, they are kreteksmuggling and illicit white. Illegal cigarette trade has harmed Malaysia in social, economy,and health. After the establishment of Framework Convention on Tobacco Control, SoutheastAsia Tobacco Control Alliance has a function as the main pillar of tobacco control inSoutheast Asia. Southeast Asia Tobacco Control Alliance has a duty as an implementationcatalyst of the Framework Convention on Tobacco Control in Southeast Asia. Southeast AsiaTobacco Control Alliance encourages the Southeast Asian countries to make policies inaccordance with the Framework Convention on Tobacco Control and to overcome all theexisting tobacco issues to achieve the common goal. The purpose of this study are to identifyand explain the effectiveness of Southeast Asia Tobacco Control Alliance in handling illegalcigarette trade in Malaysia in 2010-2012. The type of this research is explanative. This studyis analyzed by using qualitative data analysis techniques and theory of international regimes.The result of the research shows that Southeast Asia Tobacco Control Alliance as the mainpillar of tobacco control in Southeast Asia is not effective in handling illegal cigarettes inMalaysia in 2010-2012.

Abstract

From national, regional, to international level, the issue of drug abuse becomes one of the most important issues to be resolved. This issue of drug abuse also become a big problem in Indonesia and other countries in Southeast Asia. ASEAN as a regional institution in Southeast Asia region considers this as an urgency that must be handled comprehensively that eventually countries in Southeast Asia have a shared commitment to create a drug-free area. This research contains a discussion of the Indonesian manifestazion to the commitment of ASEAN Drug Free Area in President Joko Widodo era. This study uses the concept of an international regime, which draws conclusions and from data collected in the field. The results of this study show that Indonesia in the era of President Joko Widodo government made efforts in eradicating drugs referring to the work plan of the ASEAN Drug Free Area. The ASEAN Drug Free Area focus in the form of supply and demand reduction is manifested by Indonesia through their national policy. Indonesia is also implementing its policies in accordance with the ASEAN Drug Free Area work plan which is divided into six aspects: (i) Preventive education, (ii) law enforcement, (iii) treatment and rehabilitation, (iv) research, (v) alternative development, and ( vi) law and cooperation.
